The Chair called the meeting to order at 7:10 PM.
Mr. Smith asked Mr. Curry to sit in for Ms. Jones.
BUILDING CODE WORDING CHANGE:
The Chair opened the Public Hearing on the Building Code & Zoning Ordinances wording change at 7:10 PM.
Mr. Colby explained that he had recently attended a State Building Officials meeting and was informed by an Attorney speaking at that meeting that they are required to follow the State of New Hampshire Building Code and the State of New Hampshire Fire Code, not the International Code Council’s Building, Fire, Plumbing, Energy, and Residential Codes. Mr. Colby stated that in follow up to that, Mr. Seaverns had stopped in to his office and they had gone through the rest of the Building Codes to see what other ramifications this change had.
Mr. Smith noted that the only changed that was noticed was the change to Article II Section A of the Building Codes. Ms. Beauchamp noted for the record that any of the changes on the additional sheet that were taking place specifically because of the noticed change was ok to follow through on. If the change is not directly related to the noticed change, then it could not be done this year.
Mr. Curry asked Mr. Colby to go through the list of other items in the Building Codes affected by this change. Mr. Colby stated and the Board concurred that the existing Articles III, IV, V, IX, X, XI, XII, XIII, and XV, do relate to the noticed change and could be deleted. Existing VI can become III, VII can become IV, VIII can become VI, XIV can become V, XVI can become VII, XVII can become VII, XVIII can become IX, and XIX can become X.
Ms. Mills stated that she felt if other Articles were going to be changed or deleted based on the people’s vote of the noticed Article change, there should be a synopsis available of the effects of the vote on the warrant article. Mr. Seaverns stated that based on the recommended change required to comply with the State, those articles are null and void and can be removed.
Mr. Colby recommended the Board only vote on the change to Article II Section A and spend the next year working on cleaning up the Building Code and Zoning Ordinances. He stated that most Towns do not have the Building Code in their Zoning Ordinances. He noted that it is an archaic practice.
Mr. Gylfphe made a motion to adopt the recommendation for change to Building Code Article II Section A to read as follows, “The Building Inspector shall not issue a Building Permit unless the provision of the Zoning Ordinance, as most recently amended, and the Stator of New Hampshire Building Code and State of New Hampshire Fire Code, as most recently adopted and amended, have been complied with.” as noticed. Mr. Curry seconded the motion.
Ms. Mills confirmed with the Board that the additional Articles to be changes were not going to be presented on the warrant article. Mr. Seaverns again stated that the change being proposed automatically changes the others. He stated that a synopsis could be provided and that would be sufficient. Mr. Seaverns stated that the Planning Board will put together a synopsis to be available to the public. Mr. Smith confirmed that the intent of the vote was to put only what was noticed on the ballot, but based on the vote, make all recommended changes to the other effected articles.
Mr. Gylfphe, Mr. Smith, and Mr. Seaverns voted in favor. Mr. Curry and Ms. Mills voted against. Motion passed 3-2.
Mr. Gylfphe made a motion to have “Recommended by the Planning Board” placed on the ballot. Mr. Seaverns seconded the motion. All in favor. Motion passed 5-0.
Mr. Smith informed Mr. Colby that there would be a workshop coming up dealing specifically with setbacks. He stated he though Mr. Colby should attend and bring with him the building codes definition of structure. Mr. Curry found the definition of structure on Page 272 of the Land Use Books. Mr. Colby pointed out that that definition was under Shoreland Protection and could be different that the building code definition. After retrieving his book, he read, “Structure: That which is built or constructed.” Members of the Board chuckled.
Ms. Chauvey confirmed with Members of the Board that she was to draft a synopsis of the proposed change for their review.
Mr. Colby left the meeting.
SUBDIVISION APPLICATION WORKSHOP:
Ms. Chauvey confirmed with Ms. Beauchamp the date of the application they were working on was 01/03/07.
Ms. Beauchamp stated that the most recent changes are in red and pink is what has been done. She stated that the Board was working on the Compliance section.
The Board agreed that Section V A-10(b) should stated “Road Agent” for existing roads and “Engineer” for new roads. That section should not have the Building Inspector listed. Section V A-13 was accepted. Mr. Seaverns noted that the proposed Subdivision Regulations Section V B-2(a)(2) should not say, “…or Selectmen’s Designee…” The Board asked Ms. Beauchamp to reword Section V A-6 to read, “Physical street numbers…” The Board approved of Attachment B, Certificate of Monumenation.
In regards to fire protection, Mr. Curry raised the subject of major subdivisions stating that in other towns, a 2 lot subdivision is considered major because of the possibilities. Mr. Seaverns stated that the developer should be impacted with fire protection (i.e., cisterns, etc.), not the home owners. Mr. Curry stated he thought that the Board was going to signify where areas do not apply to lot line or site plan applications. Mr. Seaverns stated that they are not there, yet.
Subdivision Application review is complete.
OTHER BUSINESS:
Ms. Chauvey informed the Board that Ms. Witham had called and asked for a postponement of their hearing, Map 59 Lot 37, Case P07-03-SUB, until February 21 because both her and her husband would be out of Town on February 7, 2007.
Mr. Smith read for the record the Planning Board’s submission for the 2006 Town Report.
Ms. Chauvey stated that she had gone back over the minutes of December 20, 2006 several time trying to comply with the request of Ms. Mills and Ms. Bonser to do a section of them verbatim, however, it has not been an easy task. She stated they are not legible and people have talked over each other. She stated she would make another attempt, if it was the Board’s request. Ms. Mills stated she would withdraw her request.
Mr. Seaverns made a motion that it not be the policy of the minutes to reflect conversations verbatim. A vote of the Board is required for a verbatim request. Mr. Curry seconded the motion. All in favor. Motion passed 5-0.
Mr. Seaverns said it is the option of Board Members to review something verbatim, however, that should not be part of the minutes.
Ms. Beauchamp stated that Ms. Copeland from Strafford Regional Planning Commission was looking for vicinity maps.
Mr. Gylfphe made a motion to adjourn the meeting. Ms. Mills seconded the motion. All in favor. Motion passed 6-0.
