BOARD OF HEALTH MEETING

May 17, 2004

132 Tiffany Road - Grady Consulting – Variances:  No one representing Grady Consulting has arrived yet.


EZ Mart – Tobacco Violation:  No one representing EZ Mart has arrived yet.


Lot 7 Tara Drive – Merrill Associates – Josh Bowes – Variance:  Mounded system setback requirement of the board is an issue.  Groundwater high, which resulted in mound and wall.  G. Cavanagh informed engineer this is not a variance by new regulations but board needs to review the proposed drainage.  Board would like swale to be reviewed by Paul Foulsham, Highway Surveyor.  B. Flynn asked that diameter of pipe be put on plan.  G. Cavanagh made suggestion that this discussion be tabled until plan reviewed by Paul Foulsham and Brian Flynn.  J. Litchfield moved to table Lot 7 Tara Drive until review is complete.  P. Dillon seconded with board voting to table discussion.

132 Tiffany Road – Grady Consulting – Kevin Grady – Variances:

1.      P. Dillon moved to approve use of sieve analysis in lieu of perc test at 132 Tiffany Road.  J. Litchfield seconded with board voting unanimously to approve.  

2.      P. Dillon moved to approve reduction in separation between bottom of SAS and groundwater from 4’ to 3’.  J. Litchfield seconded with board voting unanimously to approve.

3.      Toe of slope setback to property line from 19.5’ to 6.3’.  This is not a variance.  Board interested in drainage and swale.  Swale to be put in to keep water off neighbors property.


EZ Mart – Tobacco Violation – Mohammed Saleem:  Owner before board for selling tobacco product to minor.  J. Litchfield asked if any training been given to employees.  G. Cavanagh told owner he is being fined $100.00 for first offense according to BOH regulations.  Fine is due in BOH office within 14 days.


Discussion Items:  


Tiffany Hill:  G. Cavanagh informed board members that after he and Brian Flynn looked over Tiffany Hill plan it looks like developer appears to want waivers from most BOH regulations.  G. Cavanangh stated to members that no variances will be granted on any BOH regulations.  Profile of wall not on plan.  Whole town is nitrogen sensitive.  This project sensitive because of 3rd Herring Brook.  Board will request treatment.  Board will put project on Agenda and David Turner will provide information to board by meeting date.

Tara Drive:  Homeowner has 11 rooms which requires 5 bedrooms and only room for 4 bedrooms.  Scaled model of rooms shown to board members. J. Litchfield feels house inappropriate for size septic and needs to reduce the number of bedrooms.  Board members agree deed restrictions are not appropriate with new construction.  Board is afraid they will have too many deed restrictions.  G. Cavanagh told B. Flynn to inform homeowner he can only have 9 rooms.
