1.   CALL TO ORDERChairman Charlie Burger called the Regular Meeting of the North Stonington Zoning Board of Appeals to order at 7:00 p.m. at the Sr. Center, Holly Green Plaza.

 

BOARD MEMBERS PRESENT Charlie Burger, Chairman, James Lord, Vice-Chair, Candy Palmer, Robin Hall, Heather Chrissos, and Alternate Member Gary Thompson (arrived at 7:05 p.m.)

3.   PUBLIC HEARINGS

 

ZBA Application #15-001, of Vincent J. Nadolny and Barbara Jo Chimenti for property known as 435 Providence-New London Turnpike, North Stonington, CT  06359, located on the northerly side of CT Route No. 184 a/k/a Providence-New London Turnpike approximately 2,000 feet, easterly from the intersection of CT Route No. 184 with Stillman Road in an R-60 Zone.  Tax Map #111, Parcel #8948 Applicant is requesting a variance to Section 313.1(B)(1) Variance to allow three (3) parcels to share a residential driveway and Section 313.1(e) Variance to allow a maximum driveway grade of 14% to accommodate the grade of the existing shared driveway.  Variances are requested in conjunction with the proposed subdivision of the adjoining Elias property into three (3) residential building lots, 2 built lots and 1 vacant.

 

Chairman Burger read the Rules of Procedure into the record.

Atty. Harry Heller was present representing the applicant Joyce Elias.

 

Atty. Heller went over the variance application to allow 3 parcels to share a residential driveway and to allow a maximum driveway grade of 14% to accommodate the grade of the existing shared driveway.

 

Atty. Heller stated the variances are requested in conjunction with the proposed subdivision of the adjoining Elias property into 3 residential building lots, one of which is a 10.12 acre parcel which accommodates the existing Elias dwelling house, which currently shares a driveway with the property of Vincent J. Nadolny and Barbara Jo Chimenti, and a proposed 9.87 acre lot which will share the common driveway currently in existence on the Nadolny and Chimenti property.

 

Atty. Heller stated the frontage of the Elias and Nadolny property along the northerly side of Providence-New London Turnpike is encumbered by a significant wetland system and a wetland crossing would disturb approximately 2000 square feet and create more impervious surface.  Atty. Heller stated there is also a spring and culvert under the existing drive.  Atty. Heller stated the variance request is consistent with the comprehensive plan of the Town of North Stonington.

 

Atty. Heller submitted Adams v. Warren Planning and Zoning (Exhibit 1) and Camp v. Planning and Zoning (Exhibit 2)

 

C. Palmer stated for the record she did not realize her sister-in-law was an abutting property owner and asked Atty. Heller if that was a problem.  He stated that was up to her if she felt she couldn’t be impartial.  C. Palmer stated she would be able to be fair and impartial and would remain seated.  

 

The Board asked questions of the applicant and why they didn’t go to Wetlands first.  Atty. Heller stated they had to start somewhere and because the wetlands disturbance would be at least 2000 square feet they came to ZBA first.

 

Atty. Heller submitted for the record a survey of the property (Exhibit 3) and a GIS property map (Exhibit 4).

 

ZEO Zanarini went over his review of the application and stated the applicant has not presented an application to the Inland Wetlands Commission who would determine if such access is permissible and therefore the applicant has not extinguished all possible remedies.

 

Chairman Burger asked if there was anyone from the public speaking in favor of this application.  There were none.

Chairman Burger asked if there were any general remarks or comments from the public regarding this application.  There were none.

 

The Board discussed having the applicant submit an application to the Wetlands Commission and Atty. Heller stated he would give any extensions that are needed to continue the hearing.

Chairman Burger asked if the applicant would like to make a summarization or rebuttal. 

 

Atty. Heller stated that he is saying cost is not a factor in creating a Town Road, but you would have 700 feet of Town Road for 1 house and the property is encumbered by wetlands.

 

MOTION by C. Palmer, SECOND by J. Lord to continue the Public Hearing on application #15-001 to wait for the Wetlands Commission to render a decision.  MOTION CARRIED UNANIMOUSLY
