MINUTES APPROVED ~ AUGUST 17, 2010

 

1.   CALL TO ORDERChairman Burger called the Regular Meeting of the North Stonington Zoning Board of Appeals to order at 7:03 p.m. at the Sr. Center, Holly Green Plaza.

 

BOARD MEMBERS PRESENTCharlie Burger-Chairman, Candy Palmer Vice-Chairperson, Robin Hall-Secretary, Jim Lord (arrived at 7:10 p.m.) and Alternate Member George Brown

 

COMMISSIONERS ABSENTAllana York and Alternate Members Hilaire Cote and Heather Chrissos

 

STAFF PRESENT:  Sr. Planner/ZEO Juliet Leeming and Administrative Assistant Cheryl Konsavitch

 

Chairman Burger read the Rules of Procedures into the record.

 

2.  ADDITIONS TO THE AGENDA:  None          

 

3.   REVIEW MINUTES:

 

Review minutes of April 20, 2010 meeting.

 

MOTION by R. Hall, SECOND by G. Brown to approve the minutes of April 20, 2010 as written.  MOTION CARRIED UNANIMOUSLY.

 

The Zoning Board of appeals recessed until 7:11 p.m. when a full Board was present as the applicant did not want to proceed with only four members.

 

4.   PUBLIC HEARINGS

 

Chairman Burger read the application into the record.

 

ZBA Application #10-003, of Courtney Gumbiner for property known as 156 Mystic Road, North Stonington, CT  06359, located on the northerly side of Route 201, approximately 1200 feet west from the intersection of Jeremy Hill Road with Route 201 in an R-60 Zone.  Applicant is requesting a variance to Section 1505.2A (Non-conforming Buildings & Structures) to allow a portion of a non-conforming structure to be enlarged/expanded and Section 1305.1 (Setback Dimensions) to reduce the rear setback from 25’ to 3’ in the vicinity of the garage only & to reduce the front yard setback from 50’ to 21’ in the vicinity of the house only.    The variance is requested to construct accessory structures & addition.  Tax Map #107, Parcel #9664

Mr. Robert Gumbiner was present representing Courtney Gumbiner and submitted his proof of mailings to the abutters and Power of Attorney.

The Board asked questions of Mr. Gumbiner pertaining to the permitting process and general questions about the land and what he has constructed on the premises. 

 

ZEO Leeming went over her review of this application stating that the applicant is requesting a variance to allow existing structures built and/or partially built without permits and within setbacks to remain.

 

Chairman Burger asked if there was anyone from the public speaking in favor of this application. There were none.

Chairman Burger asked if there was anyone from the public wishing to make general remarks pertaining to this application.  There were none.

 

Chairman Burger asked if the applicant would like to make a rebuttal or summarization.  Mr. Gumbiner did not.

 

MOTION by G. Brown, SECOND by J. Lord to close the Public Hearing on ZBA application #10-003.  MOTION CARRIED UNANIMOUSLY.

 

5.   PENDING APPLICATIONS:

The Commission deliberated on this application and discussed the front yard setback numbers which reduce it from 50’ to 21’ and determined it should be noticed as 5’ not 21’ as stated in the Notice of Hearing.

 

MOTION by C. Palmer, SECOND by G. Brown to deny ZBA application #10-003 without prejudice.  MOTION CARRIED UNANIMOUSLY.
