MOTION by R. Hall, SECOND by W. Wilkinson to approve application #09-002 for the variance requested to Section 1305 of the Zoning Regulations to allow a structure to be placed within the required 15’ for the side yard setback at 4 Forest Drive located in an R-40 Zone. The applicant is specifically approved for a 13’ variance, allowing the structure to be 2’ from the property line for the following reasons:
1. A strict application of the Regulations unreasonably restricts the use of the applicant’s property for permitted uses allowed in the zone, and causes an unusual hardship unnecessary to carrying out the general purposes of the zoning plan.
