MINUTES APPROVED ~ APRIL 17, 2007




COMMISSIONERS PRESENT:   C.Palmer, W.Pattison, W.Wilkinson, B.Ricker, and Chairman Charlie Burger.  Richard Bennardo arrived at 7:31.

 

STAFF PRESENT

Craig Grimord, Zoning Enforcement Officer

Robin Hall, ZBA Secretary.

CALL TO ORDER:

Chairman Burger called the meeting to order at 7:03.

MINUTES:

MOTION by C.Palmer, SECOND by W.Pattison to APPROVE minutes from the December meeting.  MOTION ACCEPTED UNANIMOUSLY.

PUBLIC HEARING

1.      ZBA Application 07-001 – Travers – 59 Hangman Hill Road of Olga Travers, for property known as 59 Hangman Hill Road, approximately 450’ Northerly of the intersection of Hangman Hill Road and Reutemann Road.  Applicant is requesting a reversal of the Zoning Enforcement Officers decision regarding the use of the referenced property.

               

Chairman Charlie Burger read the Rules of Procedure into the record.

Chairman Burger read the Commission members names who were seated on tonights

Public Hearing into the record.  The members seated were: 

           C.Palmer, W.Pattison, W.Wilkinson, B.Ricker, and Chairman Charlie Burger. 

          

            Attorney Tom Collier was present for this application.

Commission member Candice Palmer the Applicant if she would like her to  recuse

Herself as she had hired Mr. Travers to do work for her.

Ms. Travers  said that she had no problem with C.Palmer being seated on this

Application.

The Applicant, Olga Travers explained the application to the Commission.

Ms. Joyce M. Elias, 433 Providence New London Tpke. Represented the applicant.

Ms. Elias handed out information for the Commission to see, these were added to the

File as exhibits. 

EXHIBITS: 

A.      Book of photos.(40 photos)
B.      Letter to Ms. Tillinghast dated January 3, 2006 from Craig Grimord.
C.      10 pages, baseline info. With aerial photos (2) and deed.

      D.   5 page hand out, baseline of Joseph Traverse property from:

             May 21, 1964, expansion, March 19, 2007, NS Regs. 2/11/07.

             Meaning of physical expansion of a non conforming use.

             Community Resource Inventory Map Series made by J.Elias.



 E.   Old street card, two pages for 59 Hangman Hill Rd. 



Attorney Collier made mention that the maps presented by Ms. Elias had North

Stonington Town letter head but were created by Ms. Elias from different map

Services.  These maps were not created by the town.

The applicant felt there had been intensive expansion of the business.

Ms. Elias told the Commission about the various equipment and structures

Located on Mr. Travers’s property.

Chairman Burger asked if there was anyone AGAINST this application.

Joseph Travers Jr., 59 Hangman Hill Road spoke against this application.

Mr. Joseph Traverse Jr. explained a photo, and spoke about a shed that was being

Used for household items, not business related.

Joey Travers explained how he has been cleaning up the brush and yard.




Joseph Travers, (Sr) 59 Hangman Hill Rd spoke against.

Mr. Travers gave a history of the ownership of his property.

Mr. Travers stated that this was a domestic dispute.

Tina Parker, 59 Hangman Hill Road spoke against the application.

Ms. Parker explained the clean up of the property to the Commission.

Chairman Burger asked if anyone speaking for the applicant.

Craig Grimord, Zoning Enforcement Officer spoke in regards to the enforcement

Action taken.

Mr. Grimord explained the Notice of Violation that was issued. (10x20 shed)

And how it was used for garden equipment and household items.

Mr. Grimord explained how a smaller shed replaced a larger shed

That was dismantled.

Commission member W.Ricker asked question about the size of the sheds.

W.Pattison asked how tall the trees are.

Chairman Burger asked if there were any questions from the Public.

Joyce Elias had questions about Residential determination.

Joyce Elias had mobile home questions.

MOTION by C.Burger SECOND by W.Pattison to close the Public hearing.

MOTION CARRIED UNANIMOUSLY.

NEW BUSINESS

There is no NEW BUSINESS.

CORRESPONDENCE

Commission members went over any Correspondence.

    

BILLS TO BE PAID

MOTION by W. Pattison, SECOND by C.Palmer to pay the bills.  MOTION ACCEPTED UNANIMOUSLY.

MOTION by W.Pattison, SECOND by W.Wilkinson to adjourn at 9:07.
