DRAFT MINUTES
1. CALL TO ORDER: Chairman Burger called the Regular Meeting of the North Stonington Zoning Board of Appeals to order at 7:00 p.m. at the Sr. Center, Holly Green Plaza.
BOARD MEMBERS PRESENT: Charlie Burger, Chairman, Candy Palmer, Vice-Chairman Allana York, Winnie Pattison, Helen Quallich and Alternate Member Wayne Wilkinson
COMMISSIONERS ABSENT: Alternate Members Richard Bennardo and William Ricker
STAFF PRESENT: Craig Grimord, Sr. Planner & Zoning Official and Administrative Assistant Cheryl Konsavitch

3. PUBLIC HEARINGS:
A. ZBA Application #07-005, of Wesley Lamphere for property known as 413 Cossaduck Hill Road (Rt. 201), owned by Leonard & Blanche Rainville and bounded by Cossaduck Hill Road to the East, Lakeside Drive to the North & West and Cheryl Avenue to the South. Applicant is requesting a variance to Zoning Regulation Section 507.1-a, of 3,111.9 sq. ft. (20,000 sq. ft. required) of the minimum lot area requirement for the R-80 SUOA Zone. The variance is necessary to construct a new single-family seasonal residence on an existing non-conforming lot. Map #45, Parcel #3455

MOTION by C. Palmer, SECOND by W. Pattison to close the Public Hearing on ZBA application #07-005. MOTION CARRIED UNANIMOUSLY.
B. ZBA Application #07-006, Thomas Burdick, Sr. for property known as 44-Q Wyassup Lake Road, located on the North side of Armstrong Pentway, approximately 710’ east of the intersection of Armstrong Pentway and Wyassup Lake Road. Applicant is requesting variances to Zoning Regulation for Seasonal Use Property Section(s) 505.1 & 507.1-c of 100’ of lot frontage (100’ required) on a Town or State Road, Section 507.1-a of 3,135 sq. ft. (20,000 sq. ft. required) of the minimum lot area requirement for the R-80 SUOA Zone, Section 507.1-b of 36.31’ of lot width (100’ required). The variances are necessary to construct a new single-family
seasonal residence on an existing non-conforming lot. Map #70, Parcel #3935

ZEO Grimord advised the Board to keep the Public Hearing open on this application as the applicant has not yet received a wetlands approval.
MOTION by W. Pattison, SECOND by A. York to continue the Public Hearing on ZBA application #07-006 to October 16, 2007. MOTION CARRIED UNANIMOUSLY.
4. PENDING APPLICATIONS:
A. MOTION by H. Quallich, SECOND by C. Palmer to approve ZBA application #07-005 for the variance requested to Section 507.1-a of the Zoning Regulations of 3,112 square feet of lot area in the R-80 Seasonal Use Overlay Area Zone to construct a SEASONAL USE single-family residence with the condition that the foundation must be slab on grade and for the following reasons:
1. A strict application of the Regulations unreasonably restricts the use of the applicant’s property for permitted uses allowed in the zone and causes an unusual hardship unnecessary to carrying out the general purpose of the zoning plan.
2. The variance is in harmony with the general purpose and intent of the Regulations.
3. A valid hardship has been demonstrated: the lot pre-dates Zoning is surrounded by roads and more contiguous land cannot be purchased to make the lot conforming. MOTION CARRIED UNANIMOUSLY.
B.
