1. CALL MEETING TO ORDER:
Chairman Lou Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, April 14, 2016 at 7:00 p.m. at the New Town Hall,
Conference Room.
COMMISSIONERS PRESENT:
Lou Steinbrecher, Chairman, Elaine Boissevain, Vice-Chair Joseph Siner, Secretary, Ann Brown and Wayne Wilkinson
COMMISSIONERS ABSENT:
Alternate Members Pat Lewis, Ed McGowan and Julie Lanier
STAFF PRESENT:
ZEO/Planner Tom Zanarini and Administrative Assistant Cheryl Konsavitch,
2. ADDITIONS TO THE AGENDA:
None
3. PUBLIC COMMENT:
Anne Nalwalk submitted a newspaper clipping from The Day on an affordable housing 24-unit complex in Westerly, RI where the developer is proposing to pay a fee in lieu of building the required affordable units.
MOTION by E. Boissevain, SECOND by W. Wilkinson to go to Senior Planner & Zoning Official’s Report/Issues before Planning Issues & Discussion. MOTION CARRIED UNANIMOUSLY
(NO ACTION NEEDED; Commission received on 02/04/16 & must act on or by 04/08/16; Extension given to extend to 06/12/16)
5. SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:
ZEO Zanarini asked the Commission for an interpretation of the Land Disturbance Permit and read regulation 1006.2(D)4 which states that no activity results in the removal of more than 500 cubic yards of earth
products or filling more than 500 cubic yards of earth products for each parcel in any calendar year.
ZEO Zanarini asked if the interpretation is that 500 cubic yards in any calendar year is a onetime deal or renewable ever calendar year. Chairman Steinbrecher stated the way he reads the regulation is that
it is for one time and if you wanted to move more then you need to come in for another Land Disturbance Permit. He stated this regulation was not meant to be an open-ended permit or for an excavation site that only moves 500 cubic yards a year. The purpose
of the regulation was if someone needs to fill in a hole or prepare the site.
Mr. Jim Rossman, Stadia Engineering who prepared Mr. Perkins permit had some questions pertaining to the regulation.

7. SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:
ZEO Zanarini gave an update on enforcement issues and Chairman Steinbrecher stated he would like to see some progress made on the open enforcement issues.
Chairman Steinbrecher read a letter from Atty. Branse’s office pertaining to the Land Disturbance application for 586Z Lantern Hill Road.
The Commission also discussed the current regulations pertaining to Excavation and directed ZEO Zanarini to draft language pertaining to regulation 1006.3 to change the wording to make it a Special Permit
and also change the language pertaining to the Land Disturbance Permit.

Zoning Regulation Sections 202 (Specifically Prohibited Uses); 704 (Seasonal Use Overlay District) 1302.2 (Site Plan Submission Requirements); 1303.2 (Special Permit Submission Requirements); 1304.B (Text Amendment Application Submission Requirements); and
1305.B (Zone Change Application Submission Requirements) (Commission to receive on 04/14/16 & schedule for PH on or by 05/19/16)

Review minutes of Regular Meeting of 04/07/16
MOTION by A. Brown, SECOND by E. Boissevain to approve the minutes of 04/07/16 as amended. MOTION CARRIED UNANIMOUSLY
12. ADJOURNMENT:
MOTION by E. Boissevain, SECOND by A. Brown to adjourn the meeting at 9:15 p.m. MOTION CARRIED UNANIMOUSLY.
