1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, September 12, 2013 at 7:06 p.m. at the New Town Hall, Conference Room.

4.  COMMISSION REVIEW:
 
SP #13-054 (Site Plan Modification) Application of Stano Trombino, 26 Main St., Ashaway, RI  02804 to utilize the northern side for retail space with auctions. The existing Subway restaurant will remain.  No site changes.  Will utilize the existing lawn area to the south as overflow parking for auction on property located at 323 Clarks Falls Rd., North Stonington, CT  06359 in the HC Zone.  Tax Map #112, Parcel #261   Commission received on 8/08/13 & must act on or by 10/11/13)

Mr. Tony Nenna, Engineer representing the applicant gave a brief overview of the application that was continued from August 8th because the Inland Wetlands Commission had not yet acted on this application.  The Inland Wetlands Commission approved the application on September 11th.
 
The Commission asked questions pertaining to parking.
 
WAIVER
 
MOTION by A. Brown, SECOND by J. Lanier to grant the waiver request of Section 1902(B) to allow the overflow parking within the front setback.  The 13 proposed spaces will be 17.5’ from the front property line and buffered with privet hedge as depicted on the plan for the following reasons: 
 
The site is restricted by wetlands and the proposed overflow parking will not be used on a daily basis.  The site will be screened by a hedge and a variance has already been granted to allow 6 existing parking spaces to remain in the front yard setback.
 
MOTION CARRIED UNANIMOUSLY.
 
COMMISSION ACTION
 
MOTION by E. Boissevain, SECOND by J. Siner to approve SP #13-054 (Site Plan Modification) Application of Stano Trombino, 26 Main St., Ashaway, RI  02804 for a site-plan modification to an existing retail & restaurant within the same building to utilize the northern side for retail space with auctions.  The existing Subway restaurant will remain.  No site changes and will utilize the existing lawn area to the south as overflow parking for auction on property located at 323 Clarks Falls Rd., North Stonington, CT  06359 in a HC Zone.  Tax Map #112, Parcel #261 with the following conditions:     
            
1.  If parking becomes a problem on Clarks Falls Road, the applicant will return to the Commission with a solution.
 
2.  A parking attendant will be present at all auctions.
 
MOTION CARRIED UNANIMOUSLY.
 
 
5.  PLANNING ISSUES & DISCUSSION:
 
Don Poland to discuss on-going Zoning Regulation revisions
 
Don Poland came before the Commission to guide a general discussion regarding zoning, uses, and aesthetics in the Town of North Stonington to gain direction from the Planning & Zoning Commission regarding ongoing updates to the North Stonington Zoning Regulations.
 
Mr. Poland will return for the Commission’s October 3rd meeting.
 
6.  NEW APPLICATIONS:
 
A. SPEC #13-061 (Home Occupation Class II) Application of Donald Welch, 246 Mystic Rd., N.                                            
Stonington, CT  06359 for a Special Permit for a Class II Home Occupation to operate a home      auto repair service on property located at 246 Mystic Rd., North Stonington, CT  06359 in an R-80 Zone.  Tax Map #107, Parcel #6173.
         (Commission to receive on 9/12/13 & schedule for PH on or by 11/15/13)
 
B.  SPEC #13-062 & SPEC/APOA #13-063 (Special Permit & Aquifer Overlay) Application of A&J Landscaping, c/o Adam Marsiglio, P.O. Box 12, Ashaway, RI  02804 for a Special Permit in the Aquifer Overlay Area to utilize an existing building to support a landscaping business & retail store for the sale of plants & landscaping mulch with no major site changes proposed on property located at 217 Providence-New London Turnpike, North Stonington, CT  06359 in the VC/AP Zone.  Tax Map #117, Parcel #4165 (Commission to receive on 9/12/13 & schedule for PH on or by 11/15/13)
 
The Commission set the Public Hearings on items A and B for October 10, 2013
