DRAFT MINUTES
1. CALL MEETING TO ORDER: Vice-Chair Elaine Boissevain called the Special Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, January 17, 2013 at 4:02 p.m. at the New Town Hall, Conference Room.
COMMISSIONERS PRESENT: Elaine Boissevain, Vice-Chair, Joseph Siner, Wayne Wilkinson, and Alternate Member Julie Lanier
STAFF PRESENT: Sr. Planner & Zoning Official Juliet Leeming, Administrative Assistant Cheryl Konsavitch and Commission Attorney Michael Carey
2. COMMISSION REVIEW:
SP #12-107 (Private Roadway) Application of Arlene F. Steinlauf & Scott H. Hurwitz, Trustees of Edward G. Steinlauf Trust & Lorraine Yardan, Trustee of Stephan W. Yardan Trust, 55 Sound View Heights, Branford, CT 06405 for site plan approval for the construction of a private roadway on Jeremy Hill Road in North Stonington, CT 06359 in an R-60 Zone to access subdivision in Stonington. Tax Map #115, Parcel #7823 (a) Consideration and action on a motion to reconsider the vote the Commission took on this application on January 10, 2013 (b) Re-consideration of and action on this application
Secretary Siner read the application into the record.
1. MOTION by W. Wilkinson, SECOND by J. Siner to move that the Commission reconsider the vote it took at its regular meeting on January 10, 2013 to approve Application SP #12-107 with conditions, for the purpose of considering adding one condition to the approval. MOTION CARRIED UNANIMOUSLY.
2. MOTION by J. Lanier, SECOND by W. Wilkinson to move to approve Application SP #12-107 with the waivers shown on the attached Exhibit A, incorporated herein and made a part hereof, and subject to all of the terms and conditions set forth on the attached Exhibit B, incorporated herein and made a part hereof, all of which waivers were granted and conditions were imposed by the Commission when it voted to approve this Application with waivers, conditions and modifications at its regular meeting on January 10, 2013; and to add the following condition to the Commission’s approval:
The applicant shall post a surety bond in the amount of $140,000.00 to assure construction of all approved site improvements, including without limitation the private driveway and all of its associated drainage and other facilities or to restore the property if the project is uncompleted at the Town’s discretion. Said bond shall be with a surety company and in legal form and content satisfactory to the Commission Attorney. The bond shall be posted by the Applicant or any successor in interest to the Applicant in the property or any part thereof in either Stonington or North Stonington before site work may begin, and no individual lot or lots in the Stonington subdivision shall be sold until the bond is posted. A copy of this approval shall be recorded on the land records of the Town of
Stonington. At the time the surety bond is posted the applicant shall post a savings passbook in the amount of $24,000.00 to cover soil and erosion measures.
MOTION CARRIED UNANIMOUSLY.
3. ADJOURNMENT:
MOTION by W. Wilkinson, SECOND by J. Leeming to adjourn the meeting at 4:50 p.m. MOTION CARRIED UNANIMOUSLY.
