DRAFT MINUTES


 

1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, April 5, 2012 at 7:00p.m.  at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENTLouis Steinbrecher, Chairman, Elaine Boissevain, Vice-Chair, Wayne Wilkinson, Ann Brown and Alternate Members Julie Lanier and Pat Lewis

4.  PLANNING ISSUES & DISCUSSION:

 

Discussion on Richard White bonding issue

 

Atty. Garon Camassar was present representing Mr. White.

 

Atty. Camassar stated nothing has changed with the bonding issue since his letter of February 21, 2012 in regards to a proposed alternative security arrangement, which consists of a first mortgage on parcel 150 Norwich-Westerly Road.  Atty. Camassar stated that any parcel is negotiable.  The Commission discussed with Atty. Carey dividing the bond for phases, taking a parcel of land or equipment for security.  Atty. Carey stated the stipulation of judgment would need to be modified to address the bonding issue.

 

The Commission will discuss this issue further at their May 3rd meeting and discuss the modified stipulated judgment.  The Commission asked that ZEO Leeming be presented with the proposed modification 1 week prior to the May 3rd meeting.

 

5.  WORKSHOP:

 

Preliminary discussion of division of property owned by Marjorie McIntosh, Pine Woods Rd. & Denison Hill Rd. Lot #9306

 

Atty. Thomas Londregan and John Guszkowski, Planner at CME Associates were present representing Marjorie McIntosh.  Atty. Londregan stated that Ms. McIntosh would like to divide her land located on Denison Hill and Pine Woods Road into a 10-acre house lot with an existing house on it and a 75 acre piece that will be protected as conservation land.

 

Atty. Londregan stated they would like to discuss options to subdivide the land, and keep it as buildable land only for the purpose of the appraiser and tax benefits.

 

The Commission consensus was to divide the land by site plan approval.

 

6.  PUBLIC HEARINGS

 

RC #12-024 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to add new sections 1105.2 (Seasonal Use Overlay Area) & 202.1 D (Interpretation of Regulations-Prohibited if not permitted) of the North Stonington Zoning Regulations.  (NO ACTION NEEDED; PH scheduled to open on 4/12/12; Commission received on 3/08/12)

 

7.  COMMISSION REVIEW:

 

A.  SI #12-035 (Signage) Application of John MacNeil (Aldin Assoc.), 77 Sterling Road, East Hartford, CT  06108 to reface existing sign and requesting to increase existing height of sign from 13’ to 15’ on property located at 1 Mystic Road, North Stonington, CT  06359 in an R-40 Zone.  Tax Map #108, Parcel #6846

 

Chairman Steinbrecher read the application into the record.

 

Seated:  L. Steinbrecher, E. Boissevain, W. Wilkinson, A. Brown, J. Lanier

 

Mr. John MacNeil was present for this application and went over his request with the Commission.

 

The Commission reviewed the request and under Section 2008.1 (3) the height of the sign in a residential zone cannot be increased by the Commission.  Mr. MacNeil would have to keep the sign at its present height or go to the Zoning Board of Appeals and apply for a variance.

 

MOTION by A. Brown, SECOND by W. Wilkinson to deny SI #12-035 for the reason the Commission cannot approve an increase in the height of a sign in a Residential Zone.  MOTION CARRIED UNANIMOUSLY.

 

B.  SP #12-026 (Site Plan Modification) Application of the Town of North Stonington, Highway Department, 40 Main Street, North Stonington, CT  06359 to construct a building addition for use as a vehicle wash station.  Property is located at 11 Wyassup Road, North Stonington, CT  06359 in an R-80 Zone.  Tax Map #109, Parcel #5292  (Commission  received on 3/08/12 & must act on or by 5/11/12)

 

Chairman Steinbrecher read the application into the record.

 

Seated:  L. Steinbrecher, E. Boissevain, W. Wilkinson, A. Brown, P. Lewis

 

Nicholas Mullane, 1st Selectman went over the application with the Commission.  The Commission asked questions pertaining to the application and will continue discussion on this application at their April 12th meeting after the Wetlands Commission has acted on the application at their April 11th meeting.

 

MOTION by A. Brown, SECOND by W. Wilkinson to table SP #12-026 until April 12, 2012.  MOTION CARRIED UNANIMOUSLY.

10.  PLANNING ISSUES & DISCUSSION:

 

A.  POCD Update

 

ZEO Leeming reviewed the POCD schedule and asked for 1 or 2 representatives from Planning & Zoning to be on the POCD Committee which will involve about six meetings.  J. Lanier and E. Boissevain volunteered with A. Brown as a back up when needed. 

 

B.  Housing & Economic Development Planning Workshop scheduled for Saturday, April 28, 2012 at 9:30 a.m. at the Elementary School Multi-Purpose Room, 311 Norwich-Westerly Road

 

ZEO Leeming went over the workshop scheduled for April 28th.

MOTION by E. Boissevain, SECOND by W. Wilkinson to approve the regular meeting minutes of 3/08/12 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

MOTION by E. Boissevain, SECOND by W. Wilkinson to adjourn the meeting at 9:21 p.m.  MOTION CARRIED UNANIMOUSLY.
