DRAFT MINUTES


 

1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, February 9, 2012 at 7:00p.m.  at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENTLouis Steinbrecher, Chairman, Elaine Boissevain, Vice-Chair, Joseph Siner, Secretary, Wayne Wilkinson and Ann Brown     

    

COMMISSIONERS ABSENTAlternate Members Andrew Gaskins and Loretta Aiken  

 

 STAFF PRESENTSr. Planner & Zoning Official Juliet Leeming, Administrative Assistant Cheryl Konsavitch and Commission Attorney Michael Carey

 

2.  ADDITIONS TO THE AGENDANone 

 

MOTION by L. Steinbrecher, SECOND by J. Siner to amend the agenda to do Commission Review before the Public Hearing.  MOTION CARRIED UNANIMOUSLY.

 

3.  PUBLIC COMMENT

 

Mr. Ernie Richards came before the Commission to discuss Day Camps.  Mr. Richards would like to put a 14 x 14 structure on property he owns on Blue Lake.  The Commission discussed briefly and will revisit this topic at a later date.

 

4.  COMMISSION REVIEW

 

ZP  #12-007 (Zoning Permit) Application of Philip J. Katz, P.E., Stantec Consulting Services, Inc., 50 West 23rd Street, New York, NY  10010 to construct an access drive to Signal Hill Common Interest Community on Jeremy Hill Road on property owned by Arlene Ferrucci Steinlauf & Stephen W. Yardan, Trustee in an R-60 Zone.  The Signal Hill Common Interest Community is located on the same parcel of land as the access road, but all the condominium structures are located in the Town of Stonington. Tax Map #115, Parcel #7823

 

Secretary Siner read the application into the record.

Atty. Tim Bates was present representing the applicant.

 

Atty. Bates stated he would like the opportunity to have the engineer come to the next meeting and make a presentation.  Atty. Bates stated the driveway is an accessory use to a principal use established in another Town. 

 

Attorney Carey asked if the application was a zoning permit or a site plan.  Atty. Bates stated that this application is being treated as a zoning permit and it is not a site plan.  Atty. Bates stated the applicant would voluntarily contribute $4500 for engineering costs.

 

Atty. Bates stated that the Planning & Zoning Commission is advisory to the ZEO on this application.  Atty. Carey went over the regulations as to what section of the regulations this application would pertain to. 

 

ZEO Leeming went over her memo of 2/09/12 pertaining to this application.  The Commission discussed as to whether this is a zoning permit or site plan.

 

MOTION by E. Boissevain, SECOND by J. Siner to have ZEO Leeming act on the application with the Commission’s guidance, as they do not have enough information to approve, and for any such other reasons as ZEO Leeming deems necessary.  MOTION CARRIED UNANIMOUSLY.

 

5.  PUBLIC HEARINGS:

 

RC #11-109 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to add new sections 1305.6 (Projections) and 1305.7 (Fences, Walls & Terraces) of the North Stonington Zoning Regulations. 

(PH opened on 1/12/12 & continued to 2/09/12; Commission received on 12/01/11

 

Secretary Siner read the application into the record.

ZEO Leeming went over her memo pertaining to the regulation change.  The Commission discussed.

 

Chairman Steinbrecher asked if there was anyone from the public wishing to comment or make general remarks.  The following person spoke:

MOTION by J. Siner, SECOND by E. Boissevain to close the Public Hearing on RC #11-109.  MOTION CARRIED UNANIMOUSLY.

 

6.  PENDING APPLICATIONS

 

RC #11-109 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to add new sections 1305.6 (Projections) and 1305.7 (Fences, Walls & Terraces) of the North Stonington Zoning Regulations. 

(PH opened on 1/12/12 & continued to 2/09/12; Commission received on 12/01/11

MOTION by E. Boissevain, SECOND by J. Siner to approve RC #11-109 Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to add new sections 1305.6 (Projections) and 1305.7 (Fences, Walls & Terraces) of the North Stonington Zoning Regulations with the Effective Date of 2/17/12.  MOTION CARRIED UNANIMOUSLY.

 

7.   NEW APPLICATIONSNone 

 

8.  PLANNING ISSUES & DISCUSSION:

 

A.  Section 1505 – Non Conforming Uses, Structures and Lots

 

The Commission discussed what percentage to allow for an increase in cubicle content.  ZEO Leeming will look at other Town’s regulations to see what they allow and will discuss further with the Commission.

 

B.  POCD Update

 

ZEO Leeming stated she updated the Website for Planning, with information on topics that were most asked about.

 

9.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:   

     

   10.  NEW BUSINESS

 

A.  Requesting an extension of 90 days until 6/13/12 to file the approved SPEC #11-074 (Special Permit) Application of Richard E. White, 189 Norwich-Westerly Road, North Stonington, CT  06359 for closure plans for a gravel operation in 3 phases on property located at 150 Norwich-Westerly Road in an R-40 Aquifer Protection Overlay Zone.  Tax Map #117, Parcel #7908

B.  Appropriation of Funds for Attorney Line Item

 

The Commission discussed and will ask the BOF for an additional $20,000 for their attorney line item.  There have been several enforcement cases that have gone to court resulting in legal fees.

   11.  OLD BUSINESS:    

 

Discussion and possible appointment of new member

 

Chairman Steinbrecher stated he had talked to Alternate Member Andrew Gaskins and Mr. Gaskins stated that because of other obligations he is unable to fulfill his duties as an Alternate Member on the Commission.  Mr. Gaskins stated he would send an e-mail giving his resignation. 

 

The Commission will discuss at their March 1st meeting.

Review minutes of Regular Meeting of 2/02/12

 

MOTION by E. Boissevain, SECOND by W. Wilkinson to approve the regular meeting minutes of 2/02/12 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

14.  ADJOURNMENT:

 

MOTION by J. Siner, SECOND by E. Boissevain to adjourn the meeting at 9:30 p.m.  MOTION CARRIED UNANIMOUSLY.
