MINUTES APPROVED ~ FEBRUARY 9, 2012


 

1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, February 2, 2012 at 7:03 p.m. at the New Town Hall, Conference Room.

2.  ADDITIONS TO THE AGENDANone 

 

MOTION by E. Boissevain, SECOND by W. Wilkinson to amend the agenda to move Item 6B before 6A.  MOTION CARRIED UNANIMOUSLY.

 

3.  PUBLIC COMMENTNone 

 

4.  PUBLIC HEARINGS:

 

RC #11-109 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to add new sections 1305.6 (Projections) and 1305.7 (Fences, Walls & Terraces) of the North Stonington Zoning Regulations. 

(NO ACTION NEEDED; PH opened on 1/12/12 & continued to 2/09/12; Commission received on 12/01/11

 

Secretary Siner stated no action was needed on this item.

 

 

 

 

 

5.  COMMISSION REVIEW

 

B.  ZP #12-009 (Accessory Apartment) Application of Sharon Banker, 214 S. Anguilla Rd., Pawcatuck, CT  06379 to construct an In-Law Apartment greater then 700 square feet on property located at 97 Jeremy Hill Rd. in an R-60 Zone.  Tax Map #115, Parcel #2565.

 

Secretary Siner read the application into the record.

 

Seated:  L. Steinbrecher, E. Boissevain, J. Siner, A. Brown, W. Wilkinson

 

Sharon Banker was present for this application and stated the in-law apartment would be built for her mother, and they would like to increase the square footage of the apartment to accommodate wheel chair access if needed in the future. 

 

ZEO Leeming went over the site-plan with the Commission.

 

MOTION by E. Boissevain, SECOND by J. Siner to approve ZP #12-009 of Sharon Banker, 214 S. Anguilla Rd., Pawcatuck, CT  06379 to construct an In-Law Apartment greater then 700 square feet on property located at 97 Jeremy Hill Rd. in an R-60 Zone.  Tax Map #115, Parcel #2565 was APPROVED from 700 square feet to an increase up to 1000 square feet.  MOTION CARRIED UNANIMOUSLY.

 

A.  ZP  #12-007 (Zoning Permit) Application of Philip J. Katz, P.E., Stantec Consulting Services, Inc., 50 West 23rd Street, New York, NY  10010 to construct an access drive to Signal Hill Common Interest Community on Jeremy Hill Road on property owned by Arlene Ferrucci Steinlauf & Stephen W. Yardan, Trustee in an R-60 Zone.  The Signal Hill Common Interest Community is located on the same parcel of land as the access road, but all the condominium structures are located in the Town of Stonington. Tax Map #115, Parcel #7823

 

Secretary Siner read the application into the record.

 

A. Brown recused herself

 

Atty. Tim Bates was present representing the applicant.

 

Atty. Bates stated the application was for a single driveway that connects a condominium community all on one lot with this driveway being the only access.  A future access on another part of Jeremy Hill Road will be considered at a later date.

 

Atty. Bates gave a history of the site and stated he believes the application should be a zoning permit for a single lot with condominiums.  There will be 20 units on one parcel of land. 

 

The Commission along with Atty. Bates and Atty. Carey discussed what form the application should be submitted on.  The discussion involved whether it should be a site-plan or not.

 

The Commission felt it should be a site plan application and the applicant would need to comply with the fee ordinance.  Atty. Bates stated the applicant is willing to follow the fee ordinance.

 

ZEO Leeming went over her memo pertaining to this application and the Commission discussed if it should be a site plan or zoning permit. 

 

Nicholas Mullane, 1st Selectman stated this is an undesirable situation and the Town would take no responsibility for the driveway and the Towns would use mutual aid for emergency and plowing if necessary.

 

Atty. Bates stated the Condo Association would plow and maintain the driveway.

 

The Commission discussed on how to proceed with this application and will discuss at their February 9th meeting.

 

6.  PENDING APPLICATIONS

8.  PLANNING ISSUES & DISCUSSION:

 

A.  Section 1505 – Non Conforming Uses, Structures and Lots

 

ZEO Leeming and the Commission went over correspondence pertaining to Section 1505.  The Commission discussed the wording of the regulation which now states that a legally non-conforming structure cannot expand their cubical content even if the footprint is not being expanded.  The Commission will review Section 1500 and also definition of a structure for the Commission’s 2/09/12 meeting.

 

ZEO Leeming updated the Commission on the EDC Plan and gave them a questionnaire to fill out from Mark Waterhouse and Leslie Cosgrove

 

B.  POCD Update

 

ZEO Leeming stated there will be a kick off meeting with Jason Vincent and Mark Waterhouse on April 24th.  More information will follow as the date gets closer.

 

9.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:   

  

    ZEO Activity Report/January

 

    ZEO Leeming went over her activity report for the month of January and also discussed allowing structures

    On day camps with the Commission.

 

    The Commission discussed changing the regulations to allow sheds on day camps for storage only with no

    Utilities and up to 160 square feet and no more than 12 feet high.

Discussion and possible appointment of new member

 

The Commission tabled this item and will discuss at their February 9th meeting.
