DRAFT MINUTES


 

1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, October 6, 2011 at 7:05 p.m. at the New Town Hall, Conference Room.

4.  PUBLIC HEARINGS:

 

A.  SPEC #11-074 (Special Permit) Application of Richard E. White, 189 Norwich-Westerly Road, North Stonington, CT  06359 for closure plans for a gravel operation in 3 phases on property located at 150 Norwich-Westerly Road in an R-40 Aquifer Protection Overlay Zone.  Tax Map #117, Parcel #7908  (PH opened on 9/01/11 & continued to 10/06/11; Commission received on 8/11/11 & PH must close on or by 11/09/11-35 day extension granted from 10/06/11)

 

Secretary Siner read the application into the record.

 

Joe Siner and Wayne Wilkinson stated for the record they had each listened to the tape of the last hearing for SPEC #11-074.

Atty. Garon Camassar and Susan Mattern, Land Surveyor was present representing the applicant. 

 

Ms. Mattern stated she had not made any changes to the plan per Juliet or Mr. Aubrey’s comments as she was waiting for the Inland Wetlands Commission’s decision.

 

Mr. Aubrey stated that during continuing communications with ZEO Leeming, the issues relating to background considerations as well as what would constitute a reasonable permit period , appears to deserve further comment which Mr. Aubrey discussed with the Commission from his report of October 6, 2011.

 

Chairman Steinbrecher asked if there were any question or comments from the public pertaining to this application.  The following person spoke:

 

Bill Ricker, Conservation Commission

 

The Commission asked questions and discussed the time frame for completing the work and 1st Selectman Nick Mullane stated that additional testing has been done on the site and the report is not yet available, but he hopes to have it in a week or two.

 

Atty. Camassar asked that if the time frame of 9 years is reduced, he would like his applicant to be allowed to do some processing of the material on-site.

 

ZEO Leeming reminded the Commission and applicant that this application is before the Commission because of an enforcement proceeding which is to try to close an enforcement issue that has gone on since 1988.  ZEO Leeming stated the applicant is not applying for an excavation permit, and that this is a closure plan.  ZEO Leeming stated the applicant chose to utilize a use that was not permitted and finances are not to be considered and this is a restoration plan.

 

Mr. Bill Ricker, Dick Blodgett and Bob Fleury of the Conservation Commission voiced their concerns and would like to be assured the ground water is protected.

 

MOTION by E. Boissevain, SECOND J. Siner by to accept the extension letter allowing the maximum extension time permitted by statue and to continue SPEC #11-074 to October 13, 2011.  MOTION CARRIED UNANIMOUSLY

 

B.  SPEC #11-075 & SPEC-APOA #11-076 (Special Permit & Aquifer Overlay) Application of Wood Pond, L.L.C., P.O. Box 293, North Stonington, CT  06359 for a Medical Clinic in the Aquifer Protection Overlay Area at property located at 183B Providence-New London Turnpike in the OR/APOA Zone.  Tax Map #122, Parcel #9690    (NO ACTION NEEDED; PH opened on 9/08/11 and continued to 10/13/11; Commission received on 8/11/11 & PH must close on or by 11/16/11-35 day extension granted from 10/13/11)

 

C.  RC #11-079 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to amend Appendix A (Definitions), Sections 400, 410, 420, 1430 and Section 1418.1(A) Excavation, Exemptions) of the North Stonington Zoning Regulations.  (NO ACTION NEEDED; PH scheduled to open on 10/13/11; Commission received on 9/01/11 & PH must close on or by 11/16/11)

 

Secretary Siner stated there was no action needed on items B or C.

8.  PLANNING ISSUES & DISCUSSION:

 

North Stonington Affordable Housing Plan

 

ZEO Leeming stated she would like questions ahead of time for the RFQ applicant’s.

 

9.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:   

  

   ZEO Leeming discussed with the Commission residence’s that have accessory apartments but are

   not owner occupied.  She will get a list from the Assessor’s Office when re-valuation of the Town

   is complete.  Also discussed was RV’s on seasonal lots and day camps with accessory structures.

 

   ZEO Leeming went over her activity with the Commission for the month of September.

12.  REVIEW MINUTES:     

 

Review minutes of Regular Meeting of 9/08/11

 

MOTION by E. Boissevain, SECOND by W. Wilkinson to approve the regular meeting minutes of 9/08/11 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

13.  ADJOURNMENT:

 

MOTION by J. Siner, SECOND by E. Boissevain to adjourn the meeting at 9:15 p.m.  MOTION CARRIED UNANIMOUSLY.
