1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, August 11, 2011 at 7:06 p.m. at the New Town Hall, Conference Room.

3.  PUBLIC COMMENT

 

Nicholas Mullane, 1st Selectman stated to the Commission that there is a highly invasive species called Tree of Heaven on the Hewitt property.  The Hewitt Committee has researched this species and how to get rid of it.  The Selectmen would like to get rid of this.  The consensus of the Commission was to cut it down.

 

Madeline Jeffery wanted to thank the Selectmen for bringing the above mentioned item to the Commission’s attention.

 

Secretary Siner read the application into the record.

 

 

 

 

4.  COMMISSION REVIEW

 

SP #11-071 (Site-Plan Modification) Application of the Town of North Stonington, 40 Main Street, North Stonington, CT  06359 for modification to an existing site-plan to remove & replace the tennis & basketball courts & add volley ball & ice ring & update utilities on property located at 32 Rocky Hollow Road in an R60 Zone.  Tax Map #115, Parcel #5607.   (Commission to receive on 8/11/11 & must act on or by 10/14/11)

 

ZEO Leeming discussed this application with the Commission and it was decided that a Special Permit was now needed because this type of use is by now by Special Permit in the Regulations.

 

The applicant withdrew the application.

 

The Commission decided to use this time as a workshop session to allow Nicholas Mullane, 1st Selectman and Pat Lafayette, Town Engineer to go over the proposal.

 

Mr. Mullane and Mr. Lafayette went over the site plan for the recreation area.  The application that was proposed included a proposal to remove and replace the tennis and basketball courts and to add a volleyball court, which will be sand and an ice rink.

 

The Plan also proposes to replace all the existing electrical wiring and conduits as well as adding new drainage systems and regrading of the site along with 5 new parking spaces.  New lights are proposed and some existing lights will be replaced or relocated with most of the proposed light poles being greater than the 20 feet.

 

The applicant will re-submit this application as a Special Permit.

 

MOTION by E. Boissevain, SECOND by A. Brown to amend the agenda to go to Item B under New Business and then back to the regular agenda format.  MOTION CARRIED UNANIMOUSLY.

 

Secretary Siner read the resolution into the record.

 

8.    NEW BUSINESS

 

Resolution of the Planning & Zoning Commission:  RESOLVED that the Planning & Zoning Commission of the Town of North Stonington approves the following project pursuant to the provisions of Section 8-24 of the General Statutes of Connecticut:

 

Replacement of the Old Town Hall Bridge with a single span structure and repairs to the Village Green Bridge, including related work, improvements and appurtenances;

 

Provided that, this resolution is for approval of conceptual plans only.  The project is subject to and shall comply with all applicable zoning, site plan, Inland Wetland and other laws, regulations and permit approvals, and this resolution shall not be a determination that any project is in compliance with any such applicable laws, regulations or permit approvals.

 

Nicholas Mullane, 1st Selectman went over the resolution and gave the Commission an update on the bridge.

 

MOTION by A. Brown, SECOND by W. Wilkinson to approve the project pursuant to the provisions of Section 8-24 of the General Statutes of Connecticut.  MOTION CARRIED UNANIMOUSLY.

 

5.   NEW APPLICATIONS

 

A.  SPEC #11-074 (Special Permit) Application of Richard E. White, 189 Norwich-Westerly Road, North Stonington, CT  06359 for closure plans for a gravel operation in 3 phases on property located at 150 Norwich-Westerly Road in an R-40 Aquifer Protection Overlay Zone.  Tax Map #117, Parcel #7908   (Commission to receive on 8/11/11 & set for PH on or by 10/14/11)

 

The Public Hearing on SPEC #11-074 is scheduled for 9/01/11.

 

B.  SPEC #11-075 & SPEC-APOA #11-076 (Special Permit & Aquifer Overlay) Application of Wood Pond, L.L.C., P.O. Box 293, North Stonington, CT  06359 for a Medical Clinic in the Aquifer Protection Overlay Area at property located at 183B Providence-New London Turnpike in the OR/APOA Zone.  Tax Map #122, Parcel #9690    (Commission to receive on 8/11/11 & set for PH on or by 10/14/

 

The Public Hearing on SPEC #11-075 & SPEC-APOA #11-076 is scheduled for 9/08/11.

 

6.  PLANNING ISSUES & DISCUSSION:

 

Discussion on Duplex regulation & clarification of RV parking on seasonal parcels.

 

ZEO Leeming went over her memo regarding Duplex Residences and stated that the proposed changes to the definition of a duplex include language that would effectively allow for both the vertical and horizontal division of a building.  The regulation change also proposes to eliminate the current Special Permit requirement for Duplex residences.

 

ZEO Leeming will submit an application for a Regulation Change regarding duplex residences.

 

ZEO Leeming also discussed with the Commission RV parking on seasonal parcels and what are day camps and what can these lots be used for.  Also discussed was the excavation regulations and the Change of Use which needs to have specific requirements.

 

7.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:

ZEO Leeming went over her activity report for the month of July.

 

Secretary Siner read the bond request release into the record.

 

8.    NEW BUSINESS

 

A.  Bruce Tiven, 222 Post Road, Unit B, Westerly, RI  02891 requesting the release of the remaining bond in conjunction with the 11/05/09 approved SPEC #09-091 of the Stonington Congregation of Jehovah’s Witnesses, 530 Providence-New London Turnpike, North Stonington, CT  06359.  Tax Map #112, Parcel #7791

 

Chairman Steinbrecher read Don Aubrey’s letter from Towne Engineering into the record pertaining to the bond release.

 

MOTION by J. Siner, SECOND by W. Wilkinson to approve the request to release the bond in conjunction with SPEC #09-091.  MOTION CARRIED UNIMOUSLY.

Review minutes of Regular Meeting of 7/14/11

 

MOTION by E. Boissevain, SECOND by A. Brown to approve the regular meeting minutes of 7/14/11 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.
