DRAFT MINUTES


 

1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, September 1, 2011 at 7:01 p.m. at the New Town Hall, Conference Room.

4.  PUBLIC HEARINGS:

 

A.  SPEC #11-074 (Special Permit) Application of Richard E. White, 189 Norwich-Westerly Road, North Stonington, CT  06359 for closure plans for a gravel operation in 3 phases on property located at 150 Norwich-Westerly Road in an R-40 Aquifer Protection Overlay Zone.  Tax Map #117, Parcel #7908   (PH opened on 9/01/11; Commission received on 8/11/11 & PH must close on or by 10/05/11)

 

Chairman Steinbrecher read the application into the record.

Atty. Garon Camassar and Susan Mattern, Land Surveyor was present representing the applicant.  Richard White was also present.

Atty. Camassar gave an introduction of this application and a request for waivers.  Atty. Camassar stated that this application results, in part from an Enforcement Action commenced by the Town in Superior Court which resulted in a Stipulation between the parties.  This stipulation required the applicant to make an application to the Planning & Zoning Commission for such permits as would be required.  The applicant failed to apply for such permitting.

 

ZEO Leeming brought a Motion for Contempt and Sanctions to the Superior Court in 2009 for violations.  This motion was further resolved by a Stipulated Order dated August 2010 and in February 2011, an additional Motion for Contempt was filed by the Town which again resulted in a Stipulation of the parties dated April 2011.  The applicant was required to post a bond in the amount of $15,000.00 as security for the performance of certain obligations before October 1, 2011 and also file a complete application for a Special Use Permit and any other applications for land use permits that might be required. 

 

The purpose of this application is to seek approval for a Closure Plan for an existing gravel operation located on the applicant’s premises.

 

Ms. Mattern submitted for the record (Exhibit A) a complete packet that was submitted with the Special Permit and (Exhibit B) a copy of the wetlands application.  Ms. Mattern went over the site plan sheet by sheet and stated this is a 3 phase plan which will be implemented over a period of time of approximately 3 years for each phase, with a final closure of the facility around September, 2020.

 

The Commission asked questions pertaining to this application and ZEO Leeming went over her review.

 

Mr. Don Aubrey, Consulting Engineer for the Commission from Towne Engineer went over his memo pertaining to this application

 

Chairman Steinbrecher asked if there were any questions or comments from the public.  The following people spoke:

The Commission requested an extension of the applicant to continue the Public Hearing.

 

MOTION by E. Boissevain, SECOND by A. Brown to accept the extension request and continue the Public Hearing on SPEC # 11-074 to October 6, 2011.  MOTION CARRIED UNANIMOUSLY.

 

B.  SPEC #11-075 & SPEC-APOA #11-076 (Special Permit & Aquifer Overlay) Application of Wood Pond, L.L.C., P.O. Box 293, North Stonington, CT  06359 for a Medical Clinic in the Aquifer Protection Overlay Area at property located at 183B Providence-New London Turnpike in the OR/APOA Zone.  Tax Map #122, Parcel #9690    (PH scheduled for 9/08/11; Commission received on 8/11/11 & PH must close on or by 10/12/11)

 

C.  SP #11-071 (Site-Plan Modification) Application of the Town of North Stonington, 40 Main Street, North Stonington, CT  06359 for modification to an existing site-plan to remove & replace the tennis & basketball courts & add volley ball & ice ring & update utilities on property located at 32 Rocky Hollow Road in an R60 Zone.  Tax Map #115, Parcel #5607.   (PH scheduled for 9/08/11 & Commission must act on or by 11/11/11)

 

No action was needed on Items B and C.

 

5.  PENDING APPLICATIONS:

6.   NEW APPLICATIONS

 

RC #11-079 (Regulation Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to amend Appendix A (Definitions), Sections 400, 410, 420, 1430 and Section 1418.1(A) Excavation, Exemptions) of the North Stonington Zoning Regulations.  (Commission to receive on 9/01/11 & set for PH on or by 11/04/11)

 

The Commission set the Public Hearing on RC #11-079 for October 13, 2011

 

7.  PLANNING ISSUES & DISCUSSION:

 

Discussion on Plan of Conservation and Development public meeting & Housing Plan RFQ response

 

ZEO Leeming discussed the public meeting for the POCD and stated it need will need to be scheduled for a later date when time permits.

 

ZEO Leeming asked members of the Commission to volunteer to read the Housing Plan RFQ.  Vice-Chair Boissevain volunteered.

 

The Commission also discussed a letter they received from the BOS pertaining to three parcels on Main Street that may be suitable for Affordable Housing.  The Commission consensus was to send a letter to the Selectmen stating that they would like to see these parcels reserved for future municipal use.

 

8.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:

ZEO Leeming went over her activity report for the month of August

 

Chairman Steinbrecher gave a recap of the meeting held between Nicholas Mullane, Lou Steinbrecher and ZEO Leeming on personnel matters.

 

 

9.    NEW BUSINESS

 

Chairman Steinbrecher gave a recap of the meeting held between Nicholas Mullane, Lou Steinbrecher and ZEO Leeming on personnel matters.

 

ZEO Leeming also discussed with the Commission an APA Planning Conference she would like to attend.  The consensus of the Commission was to have her attend.
