1.    CALL MEETING TO ORDERVice-Chairwoman Boissevain called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, March 4, 2010 at 7:05 p.m. at the North Stonington Elementary School, Multi-Purpose Room.

4.  WORKSHOP:

 

The Commission and the public to continue discussion on proposed draft agricultural regulations.

 

ZEO Leeming went over some of the items in the proposed regulations which included discussion on animal density and ag-tivities. 

 

The Commission and the public will continue discussion on the proposed draft agricultural regulation at the Commission’s March 11, 2010 meeting at the same location.

 

MOTION by E. Boissevain, SECOND by P. McMorris to amend the agenda to hear Item B first under Public Hearings the Item A.  MOTION CARRIED UNANIMOUSLY.

B.  SPEC #10-007 (Special Permit) Application of Kidd’s & Company, c/o Allen M. & Christine A. Hare, 172 Providence-New London Turnpike, North Stonington, CT  06359 to construct a 1,660 sq. ft. addition to existing daycare.  Tax Map #121, Parcel #7485

(PH scheduled to open on 3/04/10; Commission received on 2/04/10 & PH must close on or by 4/07/10)

Brian Long of CLA Engineering represented the applicant.  Mr. Dick Ponzo and Christine & Allen Hare were also present.

 

Mr. Long stated the applicant is proposing a 1,660 addition to the existing daycare.  The day care now has 64 pupils and with the addition, they will be adding another 16 students.  There will be a limited amount of clearing for the new play area.

Mikel Terluk asked questions pertaining to the play area and it’s location in proximity to her residence.

 

Anne Nalwalk representing Avalonia stated they are approximately 500 feet from the property and have no issues, but asked about landscaping for the abutting property owners.

 

Mr. Long and the Commission discussed moving the play area closer to the building and had no issues in doing this.

 

ZEO Leeming went over her review of the application.

A.  RC #10-004 (Regulation Change) Application of the North Stonington Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to amend Section 1703.1B (Site Plan Requirements and Sections 1533, 1533.1 & 1533.2 (Home Occupations) of the Town of North Stonington Zoning Regulations.  (PH scheduled to open on 3/04/10; Commission received on 2/04/10 & PH must close on or by 4/07/10)

The Commission discussed the Class I and Class II as both being a Special Permit.

MOTION by J. Siner, SECOND by E. Boissevain to approve Special Permit #10-007 with the following modifications and Findings.

 

1.  Show on the site-plan where the applicant has agreed to move the play area from the rear of the south side to the easterly side of the building away from abutting property and

 

2.  Note the lighting change on the site-plan.

 

FINDINGS

 

In reviewing the application and site plan for this Special Permit, it is determined that there will be no deleterious impacts from the proposed use and/or structures on the site and the surrounding area.  The Commission has considered the criteria set forth in Section 1602 in reviewing the application, and makes the following findings.

 

1.  The site is currently adequately served by an appropriately designed and sufficient water supply, and sanitary facilities.  The proposed addition and/or work to the site will be further reviewed by the Town Sanitarian.

 

2.  The proposed additional structure will be arranged, constructed, and operated in a manner that protects the health, safety and welfare of the citizens of North Stonington.  The proposed addition will be further reviewed by the Town Building Official.

 

3.  Transportation services are adequate and no traffic congestion or undue traffic generation will result that would cause a deleterious effect on the local welfare or the safety of the motoring public.  The proposed addition will not alter the existing traffic flows/patterns on the site or to and from the site.

 

4.  The use and/or structure is in harmony with the appropriate and orderly development of the zoning district in which it is proposed to be situated, and it will not be noxious, offensive, or detrimental to the area by reason of odors, fumes, dust, noise, vibrations, appearance, or other similar reasons.

 

5.  The small addition proposed to the daycare center will not likely have any adverse effect on the character of the district, property values, historic features, or prosperity of the immediate neighborhood.

 

6.  The proposed addition is consistent with the architectural style of the existing building.   Therefore the character of the immediate neighborhood in terms of scale, density, intensity of use and architectural character will be preserved.

 

7.  No significant impact on environmental resources will result from the proposed addition.

 

8.  The proposed use is permitted in the OR zone and is consistent with future development as identified and envisioned in these regulations and the North Stonington Plan of Conservation and Development.

 

In granting this Special Permit, the Commission has determined that the application is in conformance with the applicable provisions of the Zoning Regulations, that the applicant has demonstrated that the application as proposed satisfies the applicable Special Permit criteria in Section 1602 of the Zoning Regulations, and that the application is in harmony with the purposes and intent of these regulations.

 

MOTION CARRIED UNANIMOUSLY.

Zoning Issues including but not limited to Storage Containers & possible LED Signage at school

 

ZEO Leeming discussed with the Commission Farm Ponds and if our regulations should mirror the wetlands regulation, Change of Use regulations, Interior Building Lots and Storage Containers.

ZEO Activity Report/February

 

ZEO Leeming went over her activity report and discussed the auction house, a rooster problem, outdoor sports regulations, TDR’s and Milltown.
