Draft Minutes

 

1.    CALL MEETING TO ORDERVice-Chairwoman Boissevain called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, August 5, 2010 at 7:00 p.m. at the New Town Hall, Conference Room.

5.  PLANNING ISSUES & DISCUSSION:

 

A.  James Murray/Home Occupation

 

Mr. Murray was present.  ZEO Leeming went over the history of Mr. Murray’s Home Occupation Special Permit and would like to start a new base line for Mr. Murray’s progress on his property.  ZEO Leeming gave a power point presentation of equipment on Mr. Murray’s property.

 

The Commission discussed and asked questions about the right-of-way, unregistered vehicles, scrap metal, the van bodies that hold material and truck traffic.  The Commission would like to see a list of recommendations and a plot plan identifying where equipment and materials are being stored on the property and where they should be, along with a list of vehicles and they would also like to acknowledge that this activity has been going on for decades.

 

The Commission asked Mr. Murray for a reasonable time frame to clean up the site and Mr. Murray responded that he would need one year.

 

ZEO Leeming stated that she will inspect the property every three months and have a plot plan of the property for the Commission’s August 12th meeting.

 

B.  Tinaco Plaza/Special Permit

 

Mr. Claudio Marasco of Tinaco and abutting property owner R.J.  Manfredi along with his attorney Salvatore Ritacco were present.

 

ZEO Leeming stated that there are issues at the truck plaza concerning trespassing, idling trucks, the gate system which should be in place and is not working and problems with the Cab Aire units.  ZEO Leeming stated a change order was issued to have someone monitor the lot regularly, but is not happening consistently.

 

Atty. Ritacco went over the history of problems that are occurring at the truck plaza concerning Mr. Manfredi and which he submitted for the record.  Some of those issues included idling trucks, trespassing and litter.  Atty. Ritacco stated that the trucks are idling for more then the state and federally mandated 3 minute anti-idling law.

 

Mr. Marasco went over information he obtained concerning sound barriers and how they work and why this would not work for Mr. Manfredi’s property.  Mr. Marasco also pointed out that Mr. Manfredi’s property is located in a Highway Commercial Zone.

 

Atty. Carey went over the Special Permit condition referring to Cab Aire.  The Commission asked for a solution from Mr. Marasco.  Mr. Marasco stated they will re-train the security guards they hire and make sure the trucks comply.

 

The Commission stated that consistency is key and would like to see a permanent solution to these problems.  ZEO Leeming will keep the Commission informed on the progress and any issues pertaining to the truck plaza.

 

The Town Hall lost power in part of the building for the remainder of the Planning & Zoning Meeting.

 

6.  PUBLIC HEARINGS:      

 

Secretary Siner read the application into the record.

 

RC #10-066 (Regulation Change) Application of R.E.P., L.L.C., 89 Plaza Court, Groton, CT  06340 to add new Section 1456-Solar Energy Systems to the Town of North Stonington Zoning Regulations.  (PH opened on 8/05/10 & continued to 8/12/10; Commission received on 6/03/10 & PH must close on or by 9/08/10)

 

Seated:  E. Boissevain, J. Siner, P. McMorris, W. Wilkinson, A. Brown

 

Tod Evers and Dan Schafer were present for this application.  Mr. Evers went over the regulation change and acknowledged the comments pertaining to this regulation change submitted by Atty. Carey. 

 

The Commission asked questions pertaining to this regulation change.

 

Vice-Chairwoman Boissevain asked if there were any questions or comments from the public pertaining to this application.  The following person spoke:

MOTION by J. Siner, SECOND by P. McMorris to continue the Public Hearing on RC #10-066 to August 12, 2010.  MOTION CARRIED UNANIMOUSLY.

8.  PENDING APPLICATIONS

 

Secretary Siner read the application into the record.

 

A.  RC #10-059 (Regulation Change) Application of Milltown Commons, L.L.C., P.O. Box 183, North Stonington, CT  06359 to amend Section 1200 (Floating Zones/NEV-SDD) of the Town of North Stonington Zoning Regulations.  (PH opened on 6/10/10 & continued to & closed on 7/01/10; Commission received on 6/03/10; & must act on or by 9/03/10) 

 

MOTION by A. Brown, SECOND by W. Wilkinson to table deliberations on this regulation change to August 12, 2010.  MOTION CARRIED UNANIMOUSLY.

9.  NEW APPLICATIONS:

 

ZC #10-095 (Zone Change) Application of the Town of North Stonington, Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to identify the new “Level A” Aquifer Protection Area boundaries of existing zoning map to include all or some of the following parcels:  Tax Map #1330, Parcels #0493, #3956, #9200, #9641, #0777, #5841  (Commission received on 8/05/10 & set for PH on 9/09/10)

 

The Commission set the Public Hearing on ZC #10-095 for September 9, 2010.

 

10.  PLANNING ISSUES & DISCUSSION:

 

Zoning Issues including but not limited to (Lake View North) non-disturbance area & Portable Storage Units

 

ZEO Leeming stated that she had inspected 55 Billings Road and the non-disturbance area and stated that trees had been cut in that area, but the stones were not disturbed.

Review minutes of Regular Meeting of July 1, 2010

 

MOTION by P. McMorris, SECOND by W. Wilkinson to approve the regular meeting minutes of 7/01/10 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

E. Boissevain abstained.

 

15.  ADJOURNMENT:

 

MOTION by P. McMorris, SECOND by W. Wilkinson to adjourn the meeting at 11:05 p.m.  MOTION CARRIED UNANIMOUSLY.
