1. CALL MEETING TO ORDER: Chairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, January 7, 2010 at 7:08 p.m. at the New Town Hall, Conference Room.
COMMISSIONERS PRESENT: Louis E. Steinbrecher Chairman, Elaine Boissevain Vice-Chairman, Joseph Siner Secretary, Peter McMorris, Wayne Wilkinson and Alternate Members Ann Brown and Andrew Gaskins
COMMISSIONERS ABSENT: Alternate Member Susan Grufstedt
STAFF PRESENT: Sr. Planner & Zoning Official Juliet Leeming, Administrative Assistant Cheryl Konsavitch, Consulting Engineer Don Aubrey and Commission Attorney Michael Carey

3. PUBLIC COMMENT: None
4. PUBLIC HEARINGS:
A. RC #09-096 (Regulation Change) Application of V&M Construction, Inc., 22 Beach Street, Westerly, RI 02891 to amend the Town of North Stonington Zoning Regulations to add new zoning district for affordable housing development with related zoning standards.
(PH opened on 12/03/09 & continued & extended to 1/07/10; Commission received on 11/05/09 & PH must close on or by 1/14/10)
Secretary Siner read the application into the record.
Chairman Steinbrecher recused himself.

Mr. Donald Aubrey, Consulting Engineer for the Commission went over his report.
Mr. Clint Brown, Engineer for the applicant also went over some issues on the site.
ZEO Leeming went over the proposed zone/text changes that were submitted.
Atty. Carey, Commission Attorney spoke on the zone/text change and the conditioning of the permit.
Atty. Ladwig, Attorney for the applicant spoke on the application process for the proposed Zone/Text Amendment.
Mr. William Vliet, Engineer for the applicant went over traffic studies done on Route 2.
Chairman Boissevain asked if there were any questions or comments from the public pertaining to this application. The following people spoke:
Nicholas Mullane, 1st Selectman submitted for the record (Exhibit A) Maps of the site pertaining to well field, indirect recharge, groundwater mapping, aquifer protection area and an overall site plan.
Curtis Moussie spoke on traffic and drainage
Robert Kneed, 447 Norwich-Westerly Rd. spoke on traffic issues and location of the proposal
Ann Renehan – spoke on the location of the proposal stating the location is in the POCD and the recommendation of the Affordable Housing Committee.
Gabe Guay, 451 Norwich-Westerly Rd. stated that more information is needed before this proposal is approved.
ZEO Leeming went over the 830-g requirements.
Shawn Murphy, Selectman stated that the location of this project was not endorsed by the Affordable Housing Ad-Hoc Committee nor did the Selectmen. Mr. Murphy also commented on the proposed Farmer’s Market being considered with this proposal.
Marie Moussie spoke on density issues
Mr. Aubrey asked a question pertaining to additional testing for the site.
MOTION by A. Brown, SECOND by J. Siner to continue the Public Hearing on RC # 09-096 to January 14, 2010. MOTION CARRIED UNANIMOUSLY.
B. ZC #09-097 (Zone Change) Application of V&M Construction, Inc., 22 Beach Street, Westerly, RI 02891 to amend the Town of North Stonington Zoning Map to add new Affordable Housing Development Overlay Zone. The proposed zone consists of 7.24 acres with 600 feet of frontage on Route 2 & borders on the Commercial One (C1) Zone to the South & the R40 Residential Zone to the West & North & identified as Map/Parcel #10l/3214/4126/5046/6957

MOTION by A. Brown, SECOND by J. Siner to incorporate all the testimony from RC #09-096 into the Public Hearing for ZC #09-097 and continue it to January 14, 2010. MOTION CARRIED UNANIMOUSLY.
Chairman Steinbrecher returned to the meeting at 9:14 p.m.
Commission took a recess from 9:15 p.m. to 9:24 p.m.
C. SPEC #09-104 (Special Permit) Application of Grace Fellowship Evangelical Free Church, c/o Pastor Bob Petreil, 102 Providence-New London Turnpike, North Stonington, CT 06359 to construct a 622 square foot addition to existing church for a nursery, construction of a rain garden for stormwater management & installation of parking lot lights. Tax Map #121, Parcel #4582
(NO ACTION NEEDED; PH scheduled to open on 1/14/10; Commission received on 12/03/09 & PH must close on or by 2/17/10)
5. COMMISSION REVIEW: None
6. PENDING APPLICATIONS:

7. NEW APPLICATIONS: None
8. PLANNING ISSUES & DISCUSSION:
A. Home Occupation Class I revisions
A. Brown briefly went over the revisions with the Commission. The Commission will look over the proposed revisions and discuss at their January 14, 2010 meeting.
B. Discrepancies in Zoning Regulations
ZEO Leeming went over discrepancies in the zoning regulations pertaining to noise, lighting, signage, storage containers, Certificate of Zoning Compliance, Change of Use, trailers, home occupation, excavation, building height, Section 1305 and farm ponds.
ZEO Leeming will make a draft of the regulations that need attention for the Commission to review and the Commission can address them at their January 14, 2010 meeeting.
9. UPCOMING WORKSHOPS:
A. Workshop to be held on 1/14/10 at 6:00 p.m. in the New Town Hall Conference Room with the OS/CE Subcommittee to update the Commissioners on the newly developed monitoring system for Open Space & Conservation Easements under the Town’s ownership.
B. Workshop to be held on 2/04/10 at 6:00 p.m. with the Planning & Zoning Commission and the public to discuss the proposed draft agricultural regulations.
The Commission will move Item B to their Regular Meeting agenda on February 4, 2010.
10. SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:
ZEO Activity Report/December
ZEO went over her activity report for the month of December.
11. NEW BUSINESS:
A. Brown informed the Commission of an upcoming seminar in February pertaining to low impact development and stated she would get more information on it if anyone was interested in attending.
12. OLD BUSINESS: None
13. CORRESPONDENCE:
The Commission went over the correspondence in their packets.
14. REVIEW MINUTES:
Review minutes of Regular Meeting of 12/10/09.
MOTION by E. Boissevain, SECOND by J. Siner to approve the regular meeting minutes of 12/10/09 with the necessary corrections. MOTION CARRIED UNANIMOUSLY.
15. ADJOURNMENT:
MOTION by J. Siner, SECOND by E. Boissevain to adjourn the meeting at 10:23 p.m. MOTION CARRIED UNANIMOUSLY.
