1.    CALL MEETING TO ORDERChairman Steinbrecher called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, June 3, 2010 at 7:05 p.m. at the New Town Hall, Conference Room.

Secretary Siner read the application into the record.

 

A.  SPEC #10-050 (Excavation) Application of Ledyard Lewis, 273 Boombridge Road, North Stonington, CT  06359 to excavate & re-grade existing agricultural land in order to expand and increase productivity of cropland & to create manageable farming areas at property located on Anthony Road, property of Ledyard E. & Harry B. Lewis.  Tax Map #124, Parcel #5167.  (PH opened on 6/03/10; Commission received on 5/06/10 & PH must close on or by 7/07/10)

Mr. Anthony Nenna, of On-Site Engineering, representing the applicant went over the application.

 

Mr. Nenna stated the proposed development consists of re-grading approximately 27 acres of existing crop fields and wooded area to support farming activities.  Mr. Nenna stated that approximately 11.2 acres will be cleared, with the remaining 15.8 acres being existing crop fields and proposed slope grading areas.  Mr. Nenna stated the construction activities will be done in 6 phases over a three year period and went over what each phase will consist of.

 

Mr. Nenna stated the truck route is along the existing farm road onto Boombridge Road which has less residential homes and a wider road then Anthony Road.

 

Mr. Nenna stated there will be approximately 30 to 35 truckloads (18 yards) a day, 10 months out of the year.  The Hours of Operation will be between 8:00 a.m. to 5:00 p.m., Monday thru Friday for processing and no processing done on Saturday.  Mr. Nenna stated no topsoil will be removed from the site and the parking and storing of the equipment will travel with each phase.

 

Mr. Nenna went over the changes to the revised plans per Towne Engineering’s comments.

 

The Commission asked questions and Mr. Aubrey, Consulting Engineer for the Commission explained the project from his point of view.

 

Chairman Steinbrecher asked if there were any questions or comments from the public pertaining to this application.  There were none.

 

Chairman Steinbrecher asked if there was anyone from the public speaking in favor of this application.  The following people spoke:

Chairman Steinbrecher asked if there was anyone from the public speaking against this application.  There were none.

 

MOTION by J. Siner, SECOND by E. Boissevain to continue the Public Hearing on SPEC #10-050 to 6/10/10.  MOTION CARRIED UNANIMOUSLY.

 

Secretary Siner stated no action was needed on Items B and C.

 

B.  SUB #10-025 (Subdivision) Application of James Johnson, P.O. Box 353, Ledyard, CT  06339 for a 1-lot subdivision on property located at 296 Cossaduck Hill Road, North Stonington, CT  06359.  Tax Map #57, Parcel #4441 (NO ACTION NEEDED; PH opened on 5/13/10 & continued to 6/10/10; Commission received on 3/11/10; & PH must close on or by 6/16/10) 

 

C.  RC #10-059 (Regulation Change) Application of Milltown Commons, L.L.C., P.O. Box 183, North Stonington, CT  06359 to amend Section 1200 (Floating Zones/NEV-SDD) of the Town of North Stonington Zoning Regulations.  (NO ACTION NEEDED; PH scheduled to open on 6/10/10; Commission received on 6/03/10; & PH must close on or by 7/14/10) 

 

 

 

 

 

6.  COMMISSION REVIEW:          

 

Secretary Siner read the application into the record.

 

IBL #10-035 (Interior Building Lot) Application of David Ostigny, 1684 Nagel Road, Cincinnati, OH  45255-2546 to create an interior building lot on property located at 481 Pendleton Hill Road, North Stonington, CT  06359.  Tax Map #89, Parcel #4694  (Commission review set for 6/03/10; Received on 5/06/10 & must act on or by 7/09/10)

 

Seated:  L. Steinbrecher, E. Boissevain, J. Siner, P. McMorris, W. Wilkinson

 

Mr. Rob Hellstrom, Robin Holowaty, Land Surveyors and Atty. John Casey were present representing the applicant.

 

Mr. Hellstrom went over the site plan and Atty. Casey went over the lot history of the property.

 

ZEO Leeming went over her review of this application and stated the application before you is to change the status of an existing lot from “not an approved building lot” to an approved interior building lot with a complicated history behind the parcel.

 

Mrs. Julie Miller, an abutting property owner commented on this application.

 

Atty. Casey submitted a waiver request of Section 1704.2 of the Zoning Regulations to allow a plan of 1”=50’ scale rather than 1”=40’ scale.

 

MOITON by E. Boissevain, SECOND by J. Siner to approve the waiver request on behalf of David Ostigny to waive the requirement in Section 1704.2 of the Zoning Regulations to allow a plan of 1”=50’ scale rather than 1”=40’ scale for the plan of his property at 481 Pendleton Hill.  MOTION CARRIED UNANIMOUSLY.

 

MOTION by E. Boissevain, SECOND by J. Siner to approve IBL #10-035 application of David Ostigny, 1684 Nagel Road, Cincinnati, OH  45255-2546 to create an interior building lot on property located at 481 Pendleton Hill Road, North Stonington, CT  06359.  Tax Map #89, Parcel #4694 was approved with the following modifications and corrections:

 

1.  Replace the words “Lot 1” with “Parcel A” in Note #3 on Site Plan under Map Standard Notes.

 

2.  Provide draft deed accurately describing Parcel A to be filed in the Land Records.

 

3.  Identify any easements and/or deed restrictions affecting the property.

 

4.  Show all the existing structures and the location of existing stone walls.

 

5.  Final approved plans to have all the required signatures and seals of the surveyor and soil scientist.

 

6.  Add signature block for Commission Approval.

 

MOTION CARRIED UNANIMOUSLY.

 

7.  PENDING APPLICATIONS

8.  NEW APPLICATIONS

 

RC #10-066 (Regulation Change) Application of R.E.P., L.L.C., 89 Plaza Court, Groton, CT  06340 to add new Section 1456-Solar Energy Systems to the Town of North Stonington Zoning Regulations.  (Commission to receive on 6/03/10 & set for PH on or by 8/06/10)

 

The Commission set the Public Hearing on RC #10-066 for 8/05/10.    

 

9.  PLANNING ISSUES & DISCUSSION:

 

Zoning Issues to include but not limited to Tinaco, land under lake and signage

 

ZEO Leeming stated that Tinaco is in violation of their Special Permit and an abutting property owner has retained an attorney on this matter.  The trucks do not use the Cab Aire and are idling and the truck plaza does not have dedicated staff to monitor the parking lot.  The Commission will have Tinaco come before them at their August 5, 2010 meeting.

 

ZEO Leeming also discussed with the Commission the possibility of property owners buying land under the lakes in order to make their seasonal properties year round by adding additional acreage to conform to the 2 acre zoning.  The Commission suggested adding language to the regulations which would prevent this from happening.

 

ZEO Leeming discussed with the Commission Temporary Signage and how many times a year it should be allowed and the need to review their current signage regulations.  ZEO Leeming will check on regulations for digital signs.

 

10.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:    

 

ZEO Activity Report/May

 

ZEO Leeming went over her activity report for May and stated to the Commission that she would like to be able to retain another Land Use Attorney to use who would be able to respond in a timely manner.

14.  REVIEW MINUTES:     

 

Review minutes of Regular Meeting of May 13, 2010

 

MOTION by E. Boissevain, SECOND by W. Wilkinson to approve the regular meeting minutes of 5/13/10 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

MOTION by J. Siner, SECOND by E. Boissevain to adjourn the meeting at 10:40 p.m.  MOTION CARRIED UNANIMOUSLY.
