Draft Minutes

 

1.    CALL MEETING TO ORDERE. Boissevain called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, December 3, 2009 at 7:05 p.m. at the New Town Hall, Conference Room.

2.  EXECUTIVE SESSION:

 

Present:  E. Boissevain, J. Siner, P. McMorris, W. Wilkinson and Alternate Members A. Brown and A. Gaskins       

 

MOTION by J. Siner, SECOND by W. Wilkinson to go into Executive Session at 7:06 p.m. to discuss pending appeal and discussion on possible consideration and action regarding SUB #06-115 & SPEC #06-116.  MOTION CARRIED UNANIMOUSLY.

 

A.  Possible executive session to discuss pending appeal regarding SUB #06-115 & SPEC #06-116 of Lime Kiln Woods (Amos Lake Development, L.L.C.)

 

B.  Possible discussion on consideration and action regarding pending appeal on SUB #06-115 and SPEC #06-116 (Amos Lake Development, L.L.C.)

 

MOTION by J. Siner, SECOND by W. Wilkinson to come out of Executive Session at 7:33 p.m.  MOTION CARRIED UNANIMOUSLY.

E. Boissevain stated no actions or decisions were made by the Commission while in Executive Session.

 

3.  ELECTION OF OFFICERS:

 

MOTION by E. Boissevain, SECOND by J. Siner to nominate L. Steinbrecher for Chairman.  MOTION CARRIED UNANIMOUSLY.

 

Louis E. Steinbrecher is Chairman

 

MOTION by J. Siner, SECOND by P. McMorris to nominate E. Boissevain for Vice-Chairman.  MOTION CARRIED UNANIMOUSLY.

 

Elaine Boissevain is Vice-Chairman

 

MOTION by E. Boissevain, SECOND by W. Wilkinson to nominate J. Siner for Secretary.  MOTION CARRIED UNANIMOUSLY.

 

Joseph Siner is Secretary.

Nita Kincaid asked if the members of the Commission would introduce themselves to the public as this is a new Commission. 

 

6.  PUBLIC HEARINGS

 

Vice-Chairman Boissevain read the application into the record.

 

A.  RC #09-096 (Regulation Change) Application of V&M Construction, Inc., 22 Beach Street, Westerly, RI  02891 to amend the Town of North Stonington Zoning Regulations to add new zoning district for affordable housing development with related zoning standards.

(PH scheduled to open on 12/03/09; Commission received on 11/05/09 & PH must close on or by 1/06/10)

A. Brown stated for the record that she has known Ann Renehan for many years, but it will not affect her decision on this application to be seated for it.

 

Mr. John Olsen representing the applicant gave a presentation on this proposal and introduced Mr. Allyn Brown of Maple Lane Farms who spoke about the farmer’s market that was a part of this proposal.

 

Mr. Clint Brown, P.E. of DiCesare-Bentley Engineers, Inc. went over the technical aspects of this project along with William Vliet, P.E. who went over the traffic engineering.

 

Mr. Don Aubrey, Consulting Engineer stated that his review of this proposal is very preliminary and submitted a copy for the record.

 

Atty. Ted Ladwig representing the applicant spoke briefly about the proposal.

 

Atty. Carey, Commission Attorney, went over the standards that are to be considered when looking at this type of application.

 

The Commission asked questions pertaining to this application.

 

Nick Mullane, 1st Selectman asked about added water supply and if a traffic light be needed.

 

Vice-Chairman Boissevain asked if there were any questions or comments from the public pertaining to this application.  The following people spoke:

Vice-Chairman Boissevain stated that correspondence has been received pertaining to this application from the Water Authority, Fire Chief and Richard & Ora Blodgett, Jr.

 

Atty. Ladwig submitted a letter into the record to continue and extend the Public Hearing on RC #09-096 & ZC #09-097 to January 14, 2010 if needed.

 

MOTION by J. Siner, SECOND by W. Wilkinson to extend and continue the Public Hearing on RC #09-096 to January 7, 2010.  MOTION CARRIED UNANIMOUSLY.

 

B.  ZC #09-097 (Zone Change) Application of V&M Construction, Inc., 22 Beach Street, Westerly, RI  02891 to amend the Town of North Stonington Zoning Map to add new Affordable Housing Development Overlay Zone.  The proposed zone consists of 7.29 acres with 600 feet of frontage on Route 2 & borders on the Commercial One (C1) Zone to the South & the R40 Residential Zone to the West & North & identified as Map/Parcel #10l/3214/4126/5046/6957

(PH scheduled to open on 12/03/09; Commission received on 11/05/09 & PH must close on or by 1/06/10)

 

Secretary Siner read the application into the record.

Vice-Chairman Boissevain stated that all correspondence and testimony from RC #09-096 be incorporated into the Public Hearing for ZC #09-097.

 

MOTION by J. Siner, SECOND by W. Wilkinson to extend and continue the Public Hearing on ZC #09-097 to January 7, 2010.  MOTION CARRIED UNANIMOUSLY.

 

C.  RC #09-099 (Regulation Change) Application of  the North Stonington Planning & Zoning Commission, 40 Main Street, North Stonington, CT  06359 to amend Section 1577 of the Town of North Stonington Zoning Regulations pertaining to Wind Energy Systems, Small Scale, Sections 1577.3 & Section 1577.4.  (NO ACTION NEEDED; PH scheduled to open on 12/10/09; Commission received on 11/12/09 & PH must close on or by 1/13/10)

8.  PENDING APPLICATIONS

The Public Hearing on both RC #09-096 and ZC #09-097 has been continued to January 7, 2010.

 

9.  NEW APPLICATIONS

 

SPEC #09-104 (Special Permit) Application of Grace Fellowship Evangelical Free Church, c/o Pastor Bob Petreil, 102 Providence-New London Turnpike, North Stonington, CT  06359 to construct a 622 s.f. addition to existing church for a nursery, construction of a rain garden for stormwater management & installation of parking lot lights.  Tax Map #121, Parcel #4582

(Commission to receive on 12/03/09 & set for PH on or by 2/05/10)

 

The Commission set the public hearing for SPEC #09-104 for January 14, 2010

 

10.   PLANNING ISSUES & DISCUSSION:

 

A.  Home Occupation Class I revisions

 

The Commission discussed the Class I Home Occupation regulation and will continue discussion on it at their December 10, 2009 meeting.

 

B.  Accessory Apartments

 

ZEO Leeming discussed with the Commission making all accessory apartments affordable.  The Commission stated they will re-visit this regulation when the Affordable Housing Committee is formed.

 

C.  Section 1700-Site Plan Requirements

 

ZEO Leeming went over the language for the fee schedule and where the wording needs to be changed in regard to the wording regarding the material submissions regarding the timing of the Public Hearing.

 

D.  Schedule of Meetings for 2010

 

The consensus of the Commission was to have only 1 meeting in July.

 

E.  Workshop to be held on 1/07/10 at 6:00 in the New Town Hall, Conference Room to discuss recommendations by the Conservation Commission from the Plan for Conservation & Recreation Land and recommendations for Use of Land Areas followed by another workshop at 6:30 p.m. with Mac Turner to discuss Route 2 traffic study.

 

F.  Workshop to be held on 1/14/10 at 6:00 p.m. in the New Town Hall Conference Room with the OS/CE Subcommittee to update the Commissioners on the newly developed monitoring system for Open Space & Conservation Easements under the Town’s ownership. 

 

G.  Workshop to be held on 2/04/10 at 6:00 p.m. with the Planning & Zoning Commission and the public to discuss the proposed draft agricultural regulations.

15.  REVIEW MINUTES:     

 

Review minutes of Workshop & Regular Meeting of 11/05/09.

 

MOTION by J. Siner, SECOND by E. Boissevain to approve the workshop and regular meeting minutes of 11/05/09 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

 

16.  ADJOURNMENT:

 

MOTION by J. Siner, SECOND by P. McMorris to adjourn the meeting at 10:58 p.m.  MOTION CARRIED UNANIMOUSLY.
