Draft Minutes

 

1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, May 7, 2009 at 7:00 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, III, Chairman, Vilma Gregoropoulos, Secretary, Elaine Boissevain, Joe Siner and Alternate Member Duncan Schweitzer     

    

COMMISSIONERS ABSENT:  Louis E. Steinbrecher, Vice-Chairman and Alternate Members Member Susan Grufstedt and Ann Brown

 

 STAFF PRESENTSr. Planner/ZEO Juliet Leeming and Administrative Assistant Cheryl Konsavitch and Commission Attorney Michael Carey (left at 7:21 p.m.)

4.  EXECUTIVE SESSION:

 

1.  Possible executive session to discuss pending appeal regarding ZBA application #08-002 (Raspberry Junction Properties, L.L.C.)

 

2.  Possible discussion on consideration and action regarding pending appeal on ZBA application #08-002 (Raspberry Junction Properties, L.L.C.)

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to go into Executive Session at 7:05 p.m.  MOTION CARRIED UNANIMOUSLY.

 

The Planning & Zoning Commission discussed the pending appeal regarding ZBA application #08-002 (Raspberry Junction Properties, L.L.C.)

 

MOTION by V. Gregoropoulos, SECOND by J. Siner to come out of Executive Session at 7:20 p.m.  MOTION CARRIED UNANIMOUSLY.

 

The Commission discussed the pending appeal regarding ZBA application #08-002 and no motions were made or actions were taken.     

 

5.  PUBLIC HEARINGS

 

SPEC #09-025 (Special Permit) Application of Stonington Congregation of Jehovah’s Witnesses, c/o Ronald Sherman, 135 Liberty Street, Pawcatuck, CT  06379 to construct a 175 person occupancy House of Worship on property located at 530 Providence-New London Turnpike, North Stonington, CT  06359  Tax Map #112, Parcel #7791  (PH scheduled to open on 5/07/09; Received on 4/09/09 & PH  to close on or by 6/10/09)

 

Secretary Gregoropoulos read the application into the record.

ZEO Leeming stated the applicant has some issues they need to address with their site-plan and would like to continue this hearing to the June 4, 2009 meeting.

B.  Commission discussion on Plan of Conservation & Development revisions

 

The Commission a reviewed the revisions made from their last meeting on the Plan and agreed to move it forward.

A.  Zoning Regulation Issues

 

ZEO Leeming went over zoning regulation issues and suggested changes to Sections 206, 1608, 1708.2, Section 211, Sections 400 to 1000, Section 1300 and Sections 1500, 1600 and 1700.

 

10.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:    

 

ZEO Activity Report/April

 

ZEO Leeming went over her activity report for the month of April with the Commission.

 

11.  NEW BUSINESS:    

 

12.  OLD BUSINESS:     

 

A.  Tom Rogers, Manager of Treasury Services of the Mashantucket Pequot Tribal Nation is requesting the release of the following bonds for the Lake of Isles Golf Course:

 

Stormwater Management                                     $5,850

Erosion & Sedimentation                                     $216,172.00

Surface Water Quality Monitoring                      $11,562

Groundwater Quality Monitoring                            $11,569

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to approve the request to release the bonds for Lake of Isles Golf Course.  MOTION CARRIED UNANIMOUSLY.

 

B.  Eric Herrman requesting the release of the following bond in conjunction with the April 5, 2007 approved SP #07-040 (Site Plan) Application of Perry K. Lorenz, 7 Lorenz Parkway, Ledyard, CT  06339 for modifications to existing site plan (no additions) for property located on Route 2 approximately 1600 ft. north of the intersection with Route 617 and 95 south on-ramp at Exit 92.  Tax Map #122/2741, Lot #54/2529 & 6105On 11/08/07 the E&S Bond was released and the landscaping bond was reduced from $60,000.00 to the maintenance level of $6,000.00 for 1 year.

V. Gregoropoulos recused herself

 

MOTION by E. Boissevain, SECOND by J. Siner to approve the request to release the bond for A&Z of $6,000.00.  MOTION CARRIED UNANIMOUSLY.

 

C.  Stephen M. Reck requesting the release of the following bond in conjunction with the December 14, 2006 approved SUB #06-085, SPEC #06-086 & SPEC-APZ #06-088 (Shunock River Estates II) Application of Joseph Mascaro, Raymond Trebisacci, Stephen Reck & Steven Bossie, 53 Oshwigochie Hills Road, Niantic, CT  06357 for a Special Permit Subdivision with proposed Stormwater retention basins in the Aquifer Protection Zone.  The proposal was for a 12-lot subdivision of property using development flexibility under Section 510, located behind 126 Babcock Road, one mile east on Babcock Road from the intersection of Wyassup Road and Babcock Road.  The property is located on the South side of Babcock Road.  Tax Map #110/2742, Lot #31/8197.   

 

1.  $197,490 for the installation of the shared driveway per the approved plans.

 

2.  $73,000 for the installation of the Stormwater management items shown on the approved plans and per the conditions of the Aquifer Protection Special Permit.

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to reduce the amount of the bonding for Shunock River Estates, II  from $197,420.00 to $25,000.00 for the Driveway Construction Bond and from $73,000.00 to $40,000.00 for the Stormwater Management Bond per the Commission’s consulting Engineer’s recommendation.  MOTION CARRIED UNANIMOUSLY.

 

13.  CORRESPONDENCE   

 

The Commission went over the correspondence in their packets. 

 

14.  REVIEW MINUTES:     

 

Review minutes of Regular Meeting of 4/09/09.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to approve the regular meeting minutes of 4/09/09 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

15.  ADJOURNMENT:

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to adjourn the meeting at 10:10 p.m.  MOTION CARRIED UNANIMOUSLY.
