1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, April 2, 2009 at 7:04 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, III, Chairman, Louis E. Steinbrecher, Vice-Chairman, Vilma Gregoropoulos, Secretary Elaine Boissevain, Joseph Siner and Alternate Members Duncan Schweitzer and Ann Brown    

    

COMMISSIONERS ABSENT:  Alternate Member Susan Grufstedt

Ms. Susan Camp, Licensed Surveyor, representing the applicant went over the site plan with the Commission and submitted for the record the following items, which some items may have already been part of the file.

Ms. Camp read the waiver request into the record to Section 7.1.1 pertaining to monumentation and also requested a waiver to Section 5.2.1 Location Map.

 

Ms. Camp read the letter from Dr. Bellantoni into the record pertaining to archaeological sensitivity on the site.

 

The Commission asked general questions pertaining to this application.

 

ZEO Leeming went over her memo pertaining to this application.

 

Chairman Stewart asked if there was anyone from the public speaking in favor of this application.  There were none.

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to close the Public Hearing on RE-SUB #09-004.  MOTION CARRIED UNANIMOUSLY.

 

B.  SPEC #09-018 (Special Permit) Application of George C. Brown, 709 North Stonington Road, Stonington, CT  06378 to create an interior building lot in conjunction with re-subdivision application #09-004 on property located at 230/254 Mystic Road, North Stonington, CT  06359 Tax Map #107/114, Parcel #6171/7078  (PH scheduled to open  on 4/02/09; Received on 3/05/09 & PH must close on or by 5/06/09)

Ms. Susan Camp, Licensed Surveyor, representing the applicant, respectfully requested that the testimony oral and written that was submitted for RE-SUB #09-004 be applicable to this Public Hearing.

Mr. Peter Gardner stated to the Commission that they should get rid of the regulation regarding an Interior Lot be by Special Permit.

 

ZEO Leeming stating that is an item the Commission will be reviewing.

 

MOTION by V. Gregoropoulos, SECOND by D. Schweitzer to close the Public Hearing on SPEC #09-018.  MOTION CARRIED UNANIMOUSLY.

 

J. Siner and A. Brown returned at 7:50 p.m.

 

5.  COMMISSION REVIEW

 

SP #09-017 (Site-Plan) Application of Raspberry Junction Properties, L.L.C., c/o Patrick Levantino, 2201 West Davis, Conroe, TX  77304 to amend existing Site Plan to add a 4,345 square foot office facility addition at property located at 411A Norwich-Westerly Road, North Stonington, CT  06359 in the C1 Zone.  Tax Map #101, Parcel #0504  (Commission review set for 4/02/09; Commission received on 3/05/09 and must act on or by 5/08/09)

 

Secretary Gregoropoulos read the application into the record.

Secretary Gregoropoulos read staff’s recommendation to table or deny the application because of incompleteness.

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to table SP #09-017 until the April 9, 2009 meeting.  MOTION CARRIED UNANIMOUSLY.

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to waive Section 5.2.1- Location Map scale not smaller than one (1) inch equals 1,000 feet to allow the applicant to show the location map at 2000 feet.  MOTION CARRIED UNANIMOUSLY.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to waive Section 7.1.1 Monuments because the front lot corner will fall on the State of Connecticut Department of Transportation Right of Way line, which is the face of a stonewall.  MOTION CARRIED UNANIMOUSLY.

 

The Commission deliberated on this application and tabled it until their April 9, 2009 meeting so that ZEO Leeming can have a written motion for the Commission.

Secretary Gregoropoulos read the findings into the record pertaining to Section 1602 of the Zoning Regulations and the Commission finds they meet the criteria for the Special Permit.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to approve SPEC #09-018.  MOTION CARRIED UNANIMOUSLY.

8.   PLANNING ISSUES & DISCUSSION:

 

A.  Discussion of Plan of Conservation and Development

 

The Commission went over the Plan review and update edits with ZEO Leeming.

 

B.  Zoning Regulation Issues

 

The Commission went over the issues which included:  multiple building/single use commercial, parking requirements, interior building lot, driveway grade and attached/detached affordable apartments.

 

The Commission also prioritized the bucket list and will start with parking, apartments over Holly Green and conservation subdivisions.

 

9.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:    

 

ZEO Activity Report/ March

 

ZEO Leeming went over her report for the month of March.

 

10.  NEW BUSINESS:    

 

A.  Tom Rogers, Manager of Treasury Services of the Mashantucket Pequot Tribal Nation is requesting the release of the following bonds for the Lake of Isles Golf Course:

 

Stormwater Management                                     $5,850

Erosion & Sedimentation                                     $216,172.00

Surface Water Quality Monitoring                      $11,562

Groundwater Quality Monitoring                            $11,569

 

B.  Eric Herrman requesting the release of the following bond in conjunction with the April 5, 2007 approved SP #07-040 (Site Plan) Application of Perry K. Lorenz, 7 Lorenz Parkway, Ledyard, CT  06339 for modifications to existing site plan (no additions) for property located on Route 2 approximately 1600 ft. north of the intersection with Route 617 and 95 south on-ramp at Exit 92.  Tax Map #122/2741, Lot #54/2529 & 6105On 11/08/07 the E&S Bond was released and the landscaping bond was reduced from $60,000.00 to the maintenance level of $6,000.00 for 1 year.

 

C.  Stephen M. Reck requesting the release of the following bond in conjunction with the December 14, 2006 approved SUB #06-085, SPEC #06-086 & SPEC-APZ #06-088 (Shunock River Estates II) Application of Joseph Mascaro, Raymond Trebisacci, Stephen Reck & Steven Bossie, 53 Oshwigochie Hills Road, Niantic, CT  06357 for a Special Permit Subdivision with proposed Stormwater retention basins in the Aquifer Protection Zone.  The proposal was for a 12-lot subdivision of property using development flexibility under Section 510, located behind 126 Babcock Road, one mile east on Babcock Road from the intersection of Wyassup Road and Babcock Road.  The property is located on the South side of Babcock Road.  Tax Map #110/2742, Lot #31/8197.   

 

1.  $197,490 for the installation of the shared driveway per the approved plans.

 

2.  $73,000 for the installation of the Stormwater management items shown on the approved plans and per the conditions of the Aquifer Protection Special Permit.

 

The Commission directed ZEO Leeming to have the Engineer inspect the sites for compliance.

The Commission went over the correspondence in their packets. 

 

13.  REVIEW MINUTES:     

 

Review minutes of Workshop Meeting & Regular Meeting of 4/02/09.

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to approve the workshop and regular meeting minutes of 4/02/09 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

14.  ADJOURNMENT:

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to adjourn the meeting at 10:05 p.m.  MOTION CARRIED UNANIMOUSLY.
