Draft Minutes

 

1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, April 9, 2009 at 7:00 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, III, Chairman, Louis E. Steinbrecher (arrived , Vice-Chairman, Vilma Gregoropoulos, Secretary Elaine Boissevain, Joseph Siner and Alternate Members Duncan Schweitzer and Ann Brown    

    

COMMISSIONERS ABSENT:  Joseph Siner and Alternate Member Susan Grufstedt

Madeline Jeffery read a letter into the record pertaining to the Plan of Conservation and Development to include night skies.

5.  COMMISSION REVIEW

 

SP #09-017 (Site-Plan) Application of Raspberry Junction Properties, L.L.C., c/o Patrick Levantino, 2201 West Davis, Conroe, TX  77304 to amend existing Site Plan to add a 4,345 square foot office facility addition at property located at 411A Norwich-Westerly Road, North Stonington, CT  06359 in the C1 Zone.  Tax Map #101, Parcel #0504  (Applicant withdrew application on 4/09/09)

 

Chairman Stewart stated that Peter Gardner, representing the applicant, had called him to set up a meeting with him and Ms. Leeming.  Chairman Stewart stated the Commission Attorney told him that would not be appropriate.

 

6.  PENDING APPLICATIONS:

 

A.  RE-SUB #09-004 (Re-Subdivision) Application of George C. Brown, 709 North Stonington Road, Stonington, CT  06378 to re-subdivide 1-lot on property located at 230/254 Mystic Road, North Stonington, CT  06359  Tax Map #107/114, Parcel #6171/7078  (PH opened on 3/05/09 and continued to and closed on 4/02/09; Received on 2/05/09;  & Commission must act on or by 6/05/09)

 

Secretary Gregoropoulos read the application into the record.

 

Seated:  D. Schweitzer for J. Siner, R. Stewart, L. Steinbrecher, E. Boissevain, V. Gregoropoulos

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to approve RE-SUB #09-004 with the following modifications:

 

1.      Correct the acreage for the proposed new lot on Sheet #1, General Note #12 to 6.44 acres to be consistent with Sheet #2.

2.      Provide slope calculations for driveway and indicate existing and proposed driveway material.

3.      Add symbols for stonewall, wetlands and woods road to the legend.

4.      Replace the words “Conservation Officer” with “Wetlands Enforcement Officer” on Sheet #3 under Maintenance, General Notes 2 & 3, and Construction Sequence.

5.      Add note on plan indicating compliance with Section 6.10 with regard to fire protection and supplemental water system.  Show pond on the plan.

6.      Provide draft deed showing parcel to be subdivided (for exemption under Section 6.6.4 of dedication of open space).

7.      Show the location of all proposed utilities.

8.      Add note to indicate that the dedication of Open Space not required due to exemption in SR 6.6.4

9.      Add general note indicating that if at some point it is determined that the stonewall along the front of the property must be removed; monumentation as required by the regulations will be set in place.

10.  Place the words “NOT A BUILDING LOT FOR AGRICULTURAL PURPOSES ONLY” on the 2.51 acre parcel (21/2.04) on Mystic Road on all three sheets of the Plan.

11.  Fix the Zoning Compliance Chart to include both “Required” and “Provided” dimensions.

12.  Add a note stating that a minimum 17’ unobstructed height for emergency vehicle access to be maintained.

13.  Final approved plans to have all the required signatures and seals of the surveyor, engineer and soil scientist.

MOTION CARRIED UNANIMOUSLY.

 

7.  NEW APPLICATIONS

 

SPEC #09-025 (Special Permit) Application of Stonington Congregation of Jehovah’s Witnesses, c/o Ronald Sherman, 135 Liberty Street, Pawcatuck, CT  06379 to construct a 175 person occupancy House of Worship on property located at 530 Providence-New London Turnpike, North Stonington, CT  06359  Tax Map #112, Parcel #7791 

 

The Commission set the Public Hearing on this application for May 7, 2009.

 

8.   PLANNING ISSUES & DISCUSSION:

 

Zoning Regulation Issues

 

The Commission went over issues which included:  multiple building/single use commercial, parking & loading requirements, large wind, town sewer avoidance policy, impervious surface coverage, loading berths, landscaping, driveways, accessory apartments, accessory structures over 1000 sq. feet and agricultural multiple buildings.

 

9.   SENIOR PLANNER & ZONING OFFICIAL’S REPORT/ISSUES:    

 

ZEO Leeming went over some zoning issues pertaining to the Bellissimo Hotel and Grace Fellowship.

 

10.  NEW BUSINESS:    

 

11.  OLD BUSINESS:     

 

A.  Tom Rogers, Manager of Treasury Services of the Mashantucket Pequot Tribal Nation is requesting the release of the following bonds for the Lake of Isles Golf Course:

 

Stormwater Management                                     $5,850

Erosion & Sedimentation                                     $216,172.00

Surface Water Quality Monitoring                      $11,562

Groundwater Quality Monitoring                            $11,569

 

B.  Eric Herrman requesting the release of the following bond in conjunction with the April 5, 2007 approved SP #07-040 (Site Plan) Application of Perry K. Lorenz, 7 Lorenz Parkway, Ledyard, CT  06339 for modifications to existing site plan (no additions) for property located on Route 2 approximately 1600 ft. north of the intersection with Route 617 and 95 south on-ramp at Exit 92.  Tax Map #122/2741, Lot #54/2529 & 6105On 11/08/07 the E&S Bond was released and the landscaping bond was reduced from $60,000.00 to the maintenance level of $6,000.00 for 1 year.

 

C.  Stephen M. Reck requesting the release of the following bond in conjunction with the December 14, 2006 approved SUB #06-085, SPEC #06-086 & SPEC-APZ #06-088 (Shunock River Estates II) Application of Joseph Mascaro, Raymond Trebisacci, Stephen Reck & Steven Bossie, 53 Oshwigochie Hills Road, Niantic, CT  06357 for a Special Permit Subdivision with proposed Stormwater retention basins in the Aquifer Protection Zone.  The proposal was for a 12-lot subdivision of property using development flexibility under Section 510, located behind 126 Babcock Road, one mile east on Babcock Road from the intersection of Wyassup Road and Babcock Road.  The property is located on the South side of Babcock Road.  Tax Map #110/2742, Lot #31/8197.   

 

1.  $197,490 for the installation of the shared driveway per the approved plans.

 

2.  $73,000 for the installation of the Stormwater management items shown on the approved plans and per the conditions of the Aquifer Protection Special Permit.

 

The Commission directed ZEO Leeming to have the Engineer inspect the sites for compliance.

The Commission went over the correspondence in their packets. 

 

13.  REVIEW MINUTES:     

 

Review minutes of Workshop Meeting & Regular Meeting of 4/02/09.

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to approve the workshop and regular meeting minutes of 4/02/09 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

14.  ADJOURNMENT:

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to adjourn the meeting at 9:35 p.m.  MOTION CARRIED UNANIMOUSLY.
