1. CALL MEETING TO ORDER: Chairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, May 1, 2008 at 7:01 p.m. at the New Town Hall, Conference Room.
COMMISSIONERS PRESENT: G. Russell Stewart, Chairman, Elaine Boissevain, Vice-Chairman, Vilma Gregoropoulos, Secretary, Louis E. Steinbrecher (arrived 7:05 p.m.), Joseph Siner (arrived 7:20 p.m.) and Alternate Member Susan Grufstedt (arrived 7:05 p.m.)
COMMISSIONERS ABSENT: Alternate Members Ann Brown and Duncan Schweitzer
STAFF PRESENT: Administrative Assistant Cheryl Konsavitch, P&Z Attorney Michael Carey and Contracted SCCOG Planner, Jamie Rabbitt
2. ADDITIONS TO THE AGENDA:
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to delete Items 3 and 4 from Executive Session and put them on next week’s agenda. MOTION CARRIED UNANIMOUSLY.
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to add item Zoning Enforcement under New Business. MOTION CARRIED UNANIMOUSLY.
3. PUBLIC COMMENT:
Ann Renehan addressed sign violations.
Bill Ricker asked if the Commission would be discussing affordable housing before it goes into the zoning regulations.
A. PUBLIC COMMENT REGARDING PROPOSED REVISIONS TO ZONING REGULATIONS:
Sandra Schroeder talked to the Commission about Home Occupations in residential areas.
Nita Kincaid discussed the moratorium and would like to see an updated schedule from the Commission.
Bill Ricker asked about proposed revisions to the regulations.
Jay Peterson asked about floating zones
Andrew Long asked who votes on the proposed regulations and a question on floating zones.
Anne Nalwalk stated the public needs to be educated on the issues so they can understand them.
Ann Renehan discussed floating zones and the zoning regulations.
MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to go into Executive Session at 7:30 pm. to discuss pending litigation pertaining to ZBA application #08-002 (Raspberry Junction Properties, L.L.C.) MOTION CARRIED UNANIMOUSLY.
4. EXECUTIVE SESSION:
The Planning & Zoning Commission to discuss pending litigation regarding on ZBA application #08-002 (Raspberry Junction Properties, L.L.C.)
Present: R. Stewart, E. Boissevain, V. Gregoropoulos, J. Siner, L. Steinbrecher, S. Grufstedt, Atty. Carey and J. Rabbitt
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to come out of Executive Session at 7:45 p.m. MOTION CARRIED UNANIMOUSLY.
The Commission discussed the pending appeal regarding ZBA application #08-002 and no motions were made or actions were taken.
5. PUBLIC HEARINGS: None
6. OLD BUSINESS:
SPEC #07-005 (Special Permit) Application of Kidds & Company, L.L.C., 172 Providence-New London Turnpike, North Stonington, CT 06359 for an approved Child Daycare Facility on property located at 172 Providence-New London Turnpike, located about ¼ mile west of Route 2 rotary, North Stonington, CT 06359 Tax Map #121/2741, Lot #25/7483 to discuss landscaping.
The Commission discussed the landscaping issues and Atty. Carey stated the conditional CO the Commission granted to the applicant cannot exceed 180 days.
L. Steinbrecher as acting ZEO on this applicantion will look at the site and determine if the landscaping issues are minor in nature and determine whether or not the Commission can issue a full zoning compliance.
7. COMMISSION REVIEW: None
8. PENDING APPLICATIONS:
SUB #07-156 (Babcock Ridge Subdivision) Application of Concord Equity Group, L.L.C., c/o Dana Barnes, 16 William F. Palmer Road, Moodus, CT 06469 for a 9-lot subdivision, property of Heirs of Thurman Main for property located on Babcock Road, North Stonington, CT 06359. Map #110, Parcel #3901 (PH closed on 3/13/08 (extension granted); Commission received on 10/11/07 &
Commission must act on or by 5/17/08)

Mr. Rabbitt went over a draft motion with the Commission.
V. Gregoropoulos would like items #22 and #36 taken off the list which the Commission discussed.
The Commission will act on this application at their next meeting.

10. SENIOR PLANNING & ZONING OFFICIAL’S REPORT/ISSUES: None
11. NEW BUSINESS:
Zoning Enforcement
Sandra Schroeder came before the Commission to discuss an ongoing zoning issue she has at 294B Cossaduck Hill Road which has a home occupation on the property that pre-dates zoning.
Ms. Schroeder was directed by the Commission to put in a formal complaint. Atty. Carey stated that the Building Official may be able to look into this.
The Commission asked that this item be put on next week’s agenda under Old Business.
12. PLANNING ISSUES & DISCUSSION:
Zoning Regulation Discussion
The Commission went over Section 400 with Mr. Rabbitt and discussed a schedule update for the public.
The Commission also discussed meeting with the Affordable Housing Sub-Committee and would like to set up a meeting with them so they can present their findings.
The Commission will review and discuss Sections 500 to 900 at their next meeting.
13. CORRESPONDENCE:
The Commission went over the correspondence in their packets.
14. REVIEW MINUTES:
Review minutes of Regular Meeting of 5/01/08
MOTION by E. Boissevain, SECOND by V. Gregoropoulos to approve the regular meeting minutes of 5/01/08 with the necessary corrections. MOTION CARRIED UNANIMOUSLY.
15. ADJOURNMENT:
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to adjourn the meeting at 10:30 p.m. MOTION CARRIED UNANIMOUSLY.
