1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, February 14, 2008 at 7:01 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, Chairman, Elaine Boissevain, Vice-Chairman, Vilma Gregoropoulos, Secretary, Louis Steinbrecher, Joseph Siner and Alternate Members Susan Grufstedt and Ann Brown     

    

COMMISSIONERS ABSENT:  Duncan Schweitzer

A.  SPEC #07-178 (Special Permit) Application of Stano Trombino, 26 Main Street, Ashaway, RI  02804 for Special Permit for a combined retail store and restaurant on property located at 323 Clarks Falls Road, North Stonington, CT  06359.  Tax Map #112, Parcel #261 (PH opened on 1/03/08 & continued to 2/07/08 & 2/14/08; Received on 12/06/07 & PH must close on or by 3/06/08)

 
Present:  R. Stewart, E. Boissevain, V. Gregoropoulos, L. Steinbrecher, J. Siner and Alternate Members S.Grufstedt and A. Brown     

 
Mr. Tony Nenna of On-Site Engineering and Mr. Stano Trombino were present for this application.
Mr. Nenna went over revised plans with proposed and existing elevations and signage.
 
The Commission asked questions pertaining to the revised plans and signage.
 
Mr. Trombino discussed the signage.
 
Chairman Stewart asked if there were any questions or comments from the public pertaining to this application.  The following people spoke:
 
Anne Nalwalk
Ann Renehan representing Clarks Falls Environmental Trust and submitted a groundwater protection map.
 
Mr. Nenna rebutted.
 
Mr. Rabbitt went over his memo and draft motion pertaining to this application.
 
MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to close the Public Hearing on SPEC #07-178.  MOTION CARRIED UNANIMOUSLY.

 

B.  SPEC #07-149 (Duplex Residence) Application of Gary J. Winalski, 9 Heritage Drive, Stonington, CT  06378 for a Special Permit to construct a Duplex Residence on property located at 152 Wyassup Road, property of Henry Han, North Stonington, CT  06359.  Map #95, Parcel #6223.          (NO ACTION NEEDED; PH opened on 12/06/07 & continued to 1/03/08, 2/07/08 & 3/06/08 (extension granted); Commission received on 10/04/07 & PH must close on or by 3/13/08)

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to approve the application by Stano Trombino SPEC #07-178 (Special Permit) for a combined retail store and restaurant on property located at 323 Clarks Falls Road, North Stonington, CT  06359.  Tax Map #112, Parcel #261 with the following conditions:

 

1.  The applicant shall provide architectural drawings for proposed dumpster enclosure on the site plan.  The details shall be reviewed and approved by the Commission Staff prior to the filing of the Special Permit.  The architecture of the enclosure shall be similar to and/or compliment the design of the main structure. 

 

2.  The sign detail shall be modified to meet the regulations.  The details shall be reviewed and approved by the Town Planner prior to the filing of the Special Permit.  The architecture of the sign shall be similar to and/or compliment the design of the main structure.

 

3.  Full architectural renderings (24”x 36” – mylar) shall be filed as part of the Special Permit and plan set.

 

4.  A note shall be added to the plans stating that:  no outside retail storage, display, and/or sales is permitted.  This note shall be placed on the site plan and the architectural renderings.

 

5.  That the applicant submit:  (1) a $45,000 surety (irrevocable letter of credit) shall be posted with the Town of North Stonington prior to any construction, grading and/or excavation activity at the site for soil and erosion control and zoning compliance measures proposed improvements and (2) a cash surety in the amount of $1,000 to act as a deposit to cover the costs associated with inspection of the proposed improvements (i.e. construction including but not limited to driveway entrances, site work, landscaping, drainage improvements, Erosion & Sediment (E&S) controls and site restoration, surety review) and the costs associated with the final review of the items contained within this motion.  (3) a $5,000 cash surety to cover E&S measures held as an emergency contingency fund.  If the amount to review and inspect exceeds the initial deposit of $1,000, inspection and review fees may be deducted from the $45,000 surety posted for the proposed improvements and/or $5,000 cash surety posted for E&S.  Final surety type shall be approved by the Commission’s legal counsel.  The applicant shall be responsible for the actual costs associated with construction supervision and inspection to ensure conformance with the approved site plan.  All costs shall be paid prior to the issuance of a certificate of zoning compliance.

 

6.  A preconstruction meeting should be held with town staff (Planner, Engineer, ZEO, Building Official) prior to any construction, grading and/or excavation activity at the site.

 

7.  Final as-built should be submitted to the Town to determine compliance with the approved plans.  As-built shall include final grades, curbing, landscaping, buildings, signage, utilities (depth, size, location, type) and drainage.  As-built may include additional information deemed necessary by town staff to determine compliance with approvals.

 

8.  That all costs associated with the review and processing of the application are paid in full by the applicant prior to the signing of mylars and filing of a special permit.

 

9.  The applicant shall submit a revised architectural rendering that details the addition of a new roof over the existing flat roof section south side.  The roof shall be designed as an architectural element to connect the existing pitched roof to the new addition.

 

10.  No tractor trucks on site

 

11.  Two additional sign areas.  2’ x 10’ shall be added to the façade.

A.  Moratorium Outline

 
The Commission will change Item A to Zoning Regulation Discussion on future agendas.
 
Mr. Rabbitt went over some of the comments received from Commission members and Atty. Carey discussed meeting protocol and requirements concerning e-mailing.
 
Chairman Stewart asked if there was anyone from the public who would like to comment on the zoning regulations.  The following people spoke:

Item B after Item D.  MOTION CARRIED UNANIMOUSLY.

 

B.  ZEO/Planner position applications

 
The Commission will review the applications they have and discuss at their 2/14/08 meeting.
 
C.  2008-2009 Budget

 
The Commission looked over the proposed 2008-2009 budget and reduced certain line items. 
 
D.  Kidd’s & Company conditional Zoning Compliance

 
L. Steinbrecher discussed the issues for the conditional zoning compliance with the Commission.  The Commission discussed to accept the change orders 3 & 4 and discussed conditions for the Conditional Zoning Compliance which included striping the gravel parking spaces, signage, general clean up of the site and items that needed to be completed for a full certification of zoning compliance such as landscaping, paving and fencing.
 
Amended MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to amend the agenda to move Item D under Planning Issues & Discussion to after review of minutes.  MOTION CARRIED UNANIMOSLY.

The Commission went over the correspondence in their packets. 
 
14.  REVIEW MINUTES:     

 
Review minutes of Regular Meeting of 2/07/08
 

MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to approve the minutes of the Regular Meeting minutes of 2/07/08 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

Amended MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to go into Executive Session to discuss ZEO/Planner applications.  MOTION CARRIED UNANIMOUSLY.
