Minutes Approved ~ June 5, 2008
 
1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, May 8, 2008 at 7:00 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, Chairman, Elaine Boissevain, Vice-Chairman, Vilma Gregoropoulos, Secretary, Louis E. Steinbrecher (arrived 7:15 p.m.), Joseph Siner and Alternate Members Susan Grufstedt (arrived 7:01 p.m.) and Ann Brown    

    

COMMISSIONERS ABSENT:  Alternate Member Duncan Schweitzer

3.  PUBLIC COMMENT:   

 
Mac Turner submitted a letter to the Commission stating it would be helpful for the Commission to post a schedule for the remaining moratorium schedule.
 
A.  PUBLIC COMMENT REGARDING PROPOSED REVISIONS TO ZONING REGULATIONS

 
Nita Kincaid discussed the moratorium and would like to see an updated schedule from the Commission and more public involvement.
 
MOTION by V. Gregoropoulos SECOND by J. Siner to go into Executive Session at 7:08 pm. to discuss pending appeal regarding RC #07-060 and ZC #07-061 (Garden Court, L.L.C.)   MOTION CARRIED UNANIMOUSLY.

 

4.  EXECUTIVE SESSION:

 

The Planning & Zoning Commission discussed the pending appeal regarding RC #07-060 and ZC #07-061 (Garden Court, L.L.C.).

 
Present:  R. Stewart, E. Boissevain, V. Gregoropoulos, J. Siner, L. Steinbrecher, S. Grufstedt, A. Brown, Atty. Carey and J. Rabbitt
 
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to come out of Executive Session at 7:55 p.m.  MOTION CARRIED UNANIMOUSLY.

 

The Commission discussed the pending appeal regarding RC #07-060 and ZC #07-061 and no motions were made or actions were taken.     

 
5.  PUBLIC HEARINGSNone 

 
6. OLD BUSINESS

 

SPEC #07-005 (Special Permit) Application of Kidds & Company, L.L.C., 172 Providence-New London Turnpike, North Stonington, CT  06359 for an approved Child Daycare Facility on property located at 172 Providence-New London Turnpike, located about ¼ mile west of Route 2 rotary, North Stonington, CT  06359  Tax Map #121/2741, Lot #25/7483  to discuss landscaping.

 
L. Steinbrecher went over the site plan with the Commission pertaining to the landscaping issues.  Mr. Ponzo showed the Commission a plan with the existing landscaping and L. Steinbrecher stated he had gone out to the site and there are trees all along the fence line with adequate buffering in between for the neighboring property.
 
L. Steinbrecher stated he has talked to the neighbor and he had no problem with the change.  The neighbor is a landscaper himself and he felt the trees if planted would not to well with the mature trees that are already there.
 
Atty. Carey stated that the ZEO can authorize this change if he believes it is minor in nature.
 
MOTION by V. Gregoropoulos, SECOND by E. Boissevain to have L. Steinbrecher act as the Zoning Enforcement Officer on this matter.  MOTION CARRIED UNANIMOUSLY.

 
The applicant will submit a change order pertaining to the landscaping and the ZEO will inspect the site for full compliance.
 
7.  COMMISSION REVIEW:  None 

 
8.  PENDING APPLICATIONS:

 

SUB #07-156 (Babcock Ridge Subdivision) Application of Concord Equity Group, L.L.C., c/o Dana Barnes, 16 William F. Palmer Road, Moodus, CT  06469 for a 9-lot subdivision, property of Heirs of Thurman Main for property located on Babcock Road, North Stonington, CT  06359.  Map #110, Parcel #3901      (PH closed on 3/13/08 (extension granted); Commission received on 10/11/07 & Commission must act on or by 5/17/08)

 

Seated:  L. Steinbrecher, E. Boissevain, V. Gregoropoulos, J. Siner, R. Stewart
 
Mr. Rabbitt went over a revised draft language with the changes with the Commission.
 
V. Gregoropoulos stated item #9 is a big issue and would like item #2 taken off the list.
 
MOTION by E. Boissevain, SECOND by L. Steinbrecher to deny Subdivision Application (SUB #07-156) Concord Equity Group, L.L.C., c/o Dana Barnes, 16 William F. Palmer Road, Moodus, CT  06469 for property owned by Heirs of Thurman P. Maine, c/o Wm. Fribance, 75 Jeremy Hill Road, North Stonington, CT  for non-compliance with the Town’s Subdivision and Zoning Regulations with the 27 items on Mr. Rabbbitt’s  memo of 5/08/08.  (see attached)  MOTION CARRIED.

Opposed:  V. Gregoropoulos

 

MOTION by V. Gregoropoulos, SECOND by J. Siner to strike item #26 from the list of 27 items from Mr. Rabbitt’s memo of 5/08/08.

Zoning Enforcement
 
The Commission discussed zoning issues which included sign violations at McDonald’s and Tinaco and a complaint from a neighbor with possible zoning violations at a property on Cossaduck Hill Road.
 
V. Gregoropoulos stated she talked to the manager at McDonald’s and he took down the illegal banner signs.
 
A. Brown discussed the signage at Tinaco and stated she would contact the general manager of the site to discuss the issues with him.
The ZEO will inspect the Cossaduck Hill property on Monday.
 
 
12.  PLANNING ISSUES & DISCUSSION:     
 

Zoning Regulation Discussion
 
A. Brown stated it would be helpful to get an edited draft of the revisions that are made by the Commission.
 
The Commission went over a list of bucket items that included:  Re-Use of marginal land, Home Occupations, Membership Clubs, Multi-Family, Accessory to Farms, Accessory Apartments or Caretaker, Sr. Housing, Cluster Regulations, Floating Zones, Mixed Use, Shared Driveways, Vineyards and their accessories, Bed & Breakfast & Multiple buildings on a parcel.
 
The Commission went over Section 500.
 
The Commission at their next meeting will review the Highway Commercial, Industrial and CD Zones from 6:30 to 7:00 p.m. and from 7:00 to 8:30 p.m. a visualization presentation by Mr. Rabbitt and then at 8:30 they will review the proposed zoning regulations.
 
The Commission discussed going over the Conservation’s Plan for Conservation and Recreation Lands and Recommendations for Use of Land Areas at their 2nd meeting in June with the Conservation Commission from 7:00 to 8:00 p.m. and then from 8:00 to 10:00 p.m. reviewing the proposed zoning regulations.

14.  REVIEW MINUTES:     

 
Review minutes of Regular Meeting of 5/01/08
 

MOTION by L. Steinbrecher, SECOND by S. Grufstedt to approve the regular meeting minutes of 5/01/08 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

15.  ADJOURNMENT:

 

MOTION by L. Steinbrecher, SECOND by E. Boissevain to adjourn the meeting at 10:40 p.m.  MOTION CARRIED UNANIMOUSLY.
