7.   DISCUSSION

A.  Lee Winakor of 217 Ledgen Wood Road came before the Commission to discuss a restoration plan.  Mr. Winakor was asked by the Commission to restore an area he had cleared without the proper permits.

Mr. Ian Cole, Registered Soil Scientist was present representing Mr. Winakor and stated that he has visited the site and the applicant had exceeded the approved clearing limits within the 100 foot upland review area for the construction of a single-family residence.  The extended building envelope that was not permitted includes portions of a terraced lawn, associated stone retaining walls and a beach area along the shoreline of Billings Lake. Mr. Cole stated that in reviewing the activities that have occurred it is his opinion that the site is stabilized and does not pose a significant or adverse impact to the wetland resources.  Mr. Cole also stated that in his professional opinion that the applicant’s non-permitted activities have not reduced the natural capacity of the wetland.  The site grading was appropriately constructed, stabilized and does not pose a significant impact or long term hazard to the wetland resources.

The Commission requested that Mr. Winakor put in an after the fact application and a mitigation plan on how to address the impact created even if it’s just natural vegetation and gave him 60 days to do so.

B.  Mac Gray came before the Commission about a pond silting in on his property.  Mr. Gray stated that silt is coming from run off from abutting property owner’s driveways.  Mr. Gray stated he no longer owns the pond as he sold property to the State.  The Commission discussed and requested Mr. Gray contact Darcy Winther of DEEP for direction.

C.  Jonathan Edwards came before the Commission to discuss the repair process for a septic system for the Jonathan Edwards Winery.

The Commission consensus was to have WEO Berardi sign off on the application as it is a repair.

8.  ENFORCEMENT OFFICER’S REPORT

WEO Berardi stated he has a permit for 586Z Lantern Hill Road for site restoration of a formal gravel pit, including site grading, the removal of existing brush and the establishment of a permanent vegetative cover.  Mr. Perkins would like to clean up and re-grade and use the pasture for cattle.

The Commission stated the wetlands need to be flagged by a soil scientist if work is being done in the wetlands.  The Commission would like to seek the opinion of an attorney before they proceed on whether to have the WEO sign off or to have the application come before the Commission.
