1.   CALL TO ORDER:

 

Vice-Chair Mark Grigg called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, November 9, 2016 at 7:00 p.m.

 

COMMISSIONERS PRESENT:

 

Mark Grigg, Vice-Chair, Cody Bill, Marvin Chase, Jr., Kevin Geary, Ron Lewis, Robert Miner, Mac Gray and Asa Palmer

 

COMMISSIONERS ABSENTCandy Palmer

 

STAFF PRESENT:

 

Wayne Berardi, Wetlands Enforcement Officer and Administrative Assistant Cheryl Konsavitch

3.   MINUTES:

 

Review minutes of Regular meeting of 09/14/16

 

MOTION by M. Chase, SECOND by K. Geary to approve the draft minutes of 09/14/16 with corrections.  MOTION CARRIED UNANIMOUSLY

 

4.   PUBLIC COMMENT:  None

 

5.   OLD BUSINESS

 

Appeal of Wetlands Agent Decision by Kieran & Jennifer Day, 572 Lantern Hill Rd., Stonington, CT  06378 for application #16-056 of Mark Perkins, 586Z Lantern Hill Rd., N. Stonington, CT for regrading of property for farm use in an R-80 Zone.  Tax Map #113, Parcel #7728-M

 

Kieran Day, Atty. Caleb Hammel and Soil Scientist Martin Brogie were present for this meeting.  Mark Perkins and Atty. Matthew Berger were also in attendance.

 

Atty. Hammel discussed the memo of September 23rd pertaining to a site walk of the property.  The Commission did not hold a public site-walk, but did individual site walks on their own.  Atty. Hammel objected to this stating by not holding a public site-walk, Mr. Day, himself and Mr. Brogie were not able to walk the property.  WEO Berardi stated the purpose of the site-walk was for the Commission to look at the site to determine if the Commission should review the application or defer to WEO Berardi as they had and the purpose of the appeal.

 

Atty. Berger submitted a FOI case and a Supreme Court case pertaining to site-walks.  Atty. Berger stated the Commission doing individual site-walks was not illegal and if a property owner does not want the public on their property it is their choice. 

 

Members of the Commission who did the site-walk discussed their findings stating they had no issues with the site and WEO Berardi stated there is improvement on the site already compared to what it was in the past.

 

Atty. Berger stated the Commission was correct in delegating to their Wetlands Agent.

 

Vice-Chair Grigg read Section 13.1 of the Wetlands Regulations into the record pertaining to Action by Duly Authorized Agent.

 

MOTION BY R. Miner, SECOND by C. Bill to deny the appeal by Kieran & Jennifer Day of the Wetlands Agent Decision.  MOTION CARRIED UNANIMOUSLY
