Draft Minutes

 

1.   CALL TO ORDER:

 

Chairman Duane White called the Regular Meeting of the Inland Wetlands Commission to order on Monday, November 9, 2015 at 7:00 p.m.

 

COMMISSIONERS PRESENT:

 

Duane White, Chairman, Mark Grigg, Vice-Chair, Kevin Geary, Ron Lewis, Art Dobley, Candy Palmer and Cody Bill

 

COMMISSIONERS ABSENTArt Dobley and Robert Miner 

 

STAFF PRESENT:

 

Wayne Berardi, Wetlands Enforcement Officer and Cheryl Konsavitch, Administrative Assistant

 

2.   ADDITIONS TO THE AGENDA:     

 

Commission to go to New Business Item B before Item A after finishing Old Business and then back to regular agenda format

 

3.   MINUTES:

 

Review minutes of Regular meeting held 10/14/15

 

MOTION by C. Palmer, SECOND by M. Grigg to approve the draft minutes of 10/14/15 as written.  MOTION CARRIED UNANIMOUSLY.

 

4.   PUBLIC COMMENT:  None

 

 

 

 

5.   OLD BUSINESS:

     

#15-063 Application of Robert Utter & Constance Kilgore, 365 Grindstone Hill Rd., N. Stonington, CT  06359 to construct a 20 x 25 2 story barn with wood storage below & workshop & storage above – solar powered on property located at 365 Grindstone Hill Rd. in an R-80 Zone.  Tax Map #81, Parcel #4393

 

Mr. Robert Utter was present for this application. The Commission did individual site-walks of the property and had no issues.

 

MOTION by M. Grigg, SECOND by C. Palmer to approve application #15-063 with the following stipulation:  Erosion & Sediment control measurements to be inspected by Staff prior to the start of construction.  MOTION CARRIED UNANIMOUSLY

 

6.   NEW BUSINESS

 

B.  #15-082 Application of Steven Bossie, 161 Babcock Rd., North Stonington, CT  06359 for follow-up on completion of farm pond clean-up & wetland creation according to plans & agreement by Army Corp at property located at 161 Babcock Rd. in an R-80 Zone.  Tax Map #110, Parcel #3030

 

Mr. Steven Bossie was present for this application.  The Commission discussed and C. Palmer asked why this application is before the Commission if it is under the jurisdiction of the Army Corp.  R. Lewis stated the Commission can accept the application and say it is under the jurisdiction of the Army Corp. 

 

The Commission discussed changing their procedure for farm ponds stating that all farm ponds would require an application.

 

C. Palmer stated that she agrees with the policy of having to get a permit for a farm pond but does not agree with this permit as it is a knee jerk reaction from a ticked off neighbor. 

 

The Commission was in concurrence that the Army Corp has jurisdiction and they are just putting it on paper.

 

MOTION by M. Grigg, SECOND by R. Lewis to defer this application to the Wetlands Enforcement Officer to sign off on this permit as an administrative action according to the plans and agreement by the Army Corp.  MOTION CARRIED UNANIMOUSLY

 

 

A. #15-075/076 Application of Walter Schwer, 12 Plateau Rd., Westerly, RI  02891 to construct a Single-Family Residence & a detached accessory apartment on property located at 108 Sleepy Hollow Rd., in an R-80 Zone.  Tax Map # 88, Parcel #3267

 

Mr. Walter Schwer and his daughter were present for this application.

 

WEO Berardi gave the history on this application and stated the site-plan is incomplete.  Mr. Schwer went over his application and after much discussion agreed to submit a completed site-plan.

 

The Commission has scheduled a site-walk on this property for Saturday, November 28th at 10:00 a.m.

 

7.   DISCUSSION:

 

Lee Winakor, 217 Ledgen Wood Rd.to discuss creating a beach on his property without the proper permits and has also exceeded the limits of clearing as shown on his site plan for his single-family residence permit #12-029. 

 

Mr. Lee Winakor was present. 

 

Mr. Winakor went over the limits of clearing and showed pictures on what he had done on his Ipad which he will submit for the file.  The Commission consensus was for Mr. Winakor to submit an application with a restoration plan.

MOTION by C. Palmer, SECOND by M. Grigg to accept the 2016 Schedule of Meeting for the Inland Wetlands Commission.  MOTION CARRIED UNANIMOUSLY

 

10.   ADJOURNMENT 

 

MOTION by D. White, SECOND C. Palmer by to adjourn the Inland Wetlands Commission Meeting at 7:53 p.m.  MOTION CARRIED UNANIMOUSLY.
