Minutes Approved ~ April 11, 2012

 

1.   CALL TO ORDER:

 

Chairman George Brown called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, March 14, 2012 at 7:00 p.m.

 

COMMISSIONERS PRESENT:

 

George Brown, Chairman, Mark Grigg, Vice-Chair, Duane White, Kevin Geary arrived at 7:07 p.m., Ron Lewis, Art Dobley, Mac Gray and Robert Miner arrived at 7:30 p.m.

 

COMMISSIONERS ABSENTMarvin Chase, Jr.

2.   ADDTIIONS TO THE AGENDANone    

 

3.   MINUTES:

 

Review minutes of February 8, 2012 meeting.

 

MOTION by D. White, SECOND by R. Lewis to approve the draft minutes of 12/14/11 with the necessary changes.  MOTION CARRIED UNANIMOUSLY.

 

4.  PUBLIC HEARING:

 

RC #12-016 (Regulation Change) The Inland Wetlands and Watercourses Agency of the Town of North Stonington will hold a public hearing to consider the Agency’s proposal (RC #12-016) to adopt a comprehensive revision of the Town of North Stonington Inland Wetlands and Watercourses Regulations.  All portions of the current regulations are subject to revision.

Chairman Brown gave an overview of the revisions to the regulations which he stated have not been updated since 1999.  Chairman Brown stated the revisions were updated to match the current statues and there was also a change in the fee schedule.  Chairman Brown stated the Commission did not make any major changes to the regulations other then to update them.

 

Chairman Brown asked if there were any questions or comments from the public pertaining to this application.  The following people spoke:

Chairman Brown asked if there was anyone from the public speaking in favor of this application.  There were none.

Chairman Brown closed the Public Hearing.

 

5.  PENDING APPLICATIONS:

 

RC #12-016 (Regulation Change) The Inland Wetlands and Watercourses Agency of the Town of North Stonington will hold a public hearing to consider the Agency’s proposal (RC #12-016) to adopt a comprehensive revision of the Town of North Stonington Inland Wetlands and Watercourses Regulations.  All portions of the current regulations are subject to revision.

MOTION by G. Brown, SECOND by M. Gray to approve application RC #12-016 with the effective date of March, 22, 2012.  MOTION CARRIED UNANIMOUSLY.

 

6.   OLD BUSINESS:     

 

A.   #12-012 (Rebuild portions of Murphy Rd.) Application of the Town of North Stonington, 40 Main Street, North Stonington, CT  06359 to rebuild portions of Murphy Road shoulder and 3’ each side of Road with a 45 degree slope, stone base, gravel top. 

 

Mr. Steve Holliday, Highway Foreman was present for this continued application.

 

Mr. Holliday stated that he contacted DEP and told him what they plan to do and they are fine with the process.  Mr. Holliday stated there will be no excavation; they are laying a stone base with a gravel top.

 

The Commission asked questions pertaining to this application.

MOTION by R. Lewis, SECOND by D. White to approve application #12-012 with the following conditions:

 

1.      None of the vegetated area is to be disturbed and or ripped out and the rock rip wrap and the stones are to be placed over the existing vegetation,  soil and slope down to the bottom of the existing lake.

2.      Utilize as many stones along the shore line as possible with the guidance of our Wetlands Agent

3.      And work is to be completed by June 15th, 2012.

 

MOTION CARRIED UNANIMOUSLY.

 

B. #12-010 (Wetlands) Application of Wayne Berardi, 69 Pinewoods Road, North Stonington, CT  06359 to construct a 45’ x 3’ stone retaining wall, remove approximately one 18” in diameter oak stump, construct a 15’ x 15’ stone patio and dry set large stones to support dock on property owned by Bruce Wilkinson and located at 389E Wyassup Road in an R-80/SU Zone.  Tax Map #70, Parcel #1976.

 

Mr. Berardi was not present for this continued application as he was on vacation.

 

Commission members R. Lewis and D. White both did individual site walks of the site and stated there are no impacts to the site and the work is maintenance.  R. Lewis stated the oak stump is a hazard and is not even attached to the ground. 

 

D. White stated WEO Berardi had shown pictures of the dock at last months meeting.  R. Lewis stated the water is 20 feet away from the dock and the dock is on an angle and he wants to re shore up the piers which are rotted out.  The retaining wall needs to be re stabilized.

 

MOTION by D. White, SECOND by K. Geary to approve application #12-010 with the following conditions:

 

1.      The work is to be completed by June 15, 2012 and

2.      Wayne Berardi is to contact the Land Use office when work is started so Kevin Geary can inspect the site.

 

MOTION CARRIED UNANIMOUSLY.

 

7.    NEW BUSINESS

 

A. #12-025 (Addition) Application of the Town of North Stonington, 40 Main Street, North Stonington, CT  06359 to construct an addition for a vehicle wash station with a detention basin located in the wetlands buffer/upland review area on property located at 11 Wyassup Road in an R-80/AP Zone.  Tax Map #109, Parcel #5292

 

Mr. Pat Lafayette, Engineer of Development Solutions was present for this application.

 

Mr. Lafayette stated they are constructing a 40 x 40 addition with bay doors and the wash station will use a high pressure spray.  Water will go through a drench drain and the whole floor will be sloped to the center.  A catch basin, which is a plastic container, will get the major part of the grit and that will overflow into an oil and grease separator.  As the water builds up after each washing it will gradually overflow into a 3000 gallon holding tank. 

 

The Commission will do individual site walks on this property and the applicant will return for the Commission’s April 11th meeting.

 

B.  #12-029 (Single-Family Residence) Application of Lee Winakor, 470 Forsyth Road, Salem, CT  06420 to construct a Single-Family Residence on property located at 217 Ledgen Wood Road, North Stonington, CT  06359 in an R-80 Zone.  Tax Map #45, Parcel #8000

 

Mr. Lee Winakor was present for this application.

 

Mr. Winakor went over his site plan with the Commission.  The Commission discussed positioning the house differently. 

 

The Commission has scheduled a site-walk of the property for March 22nd at 6:00 p.m.

 

8.   DISCUSSION:        

 

A.  Marilyn MacKay to discuss removing large rocks on property located at 92 Wyassup Lake Road.

 

Ms. MacKay came before the Commission to discuss removing large rocks on her property in the lake.  Chairman Brown stated the Inland Wetlands Commission has no authority, since DEP owns the Lake.  Ms. MacKay stated she had contacted DEP and they do not want any machinery in the lake.

 

The Commission discussed drilling the rocks and splitting them.

 

B.  Brian Stafford to discuss a farm pond on property located at 224 Denison Hill Road

 

Mr. Stafford was present and stated he would like to clean out sediment from his existing pond and the spoils will be kept on the property. 

 

Mr. Stafford will submit a sketch of what he proposes to do.

 

C.  Wyassup Lake properties - Maintenance Issues

 

Some residents of Wyassup Lake came before the Commission to discuss what is considered maintenance issues where no permit is needed and what work would constitute a permit.

 

The Commission stated that if they are laying stone and vegetating, repairing stone walls, not rebuilding them, tree cutting no grubbing, raking beach, cleaning up lake bed by hand of garbage and debris  or general maintenance, a permit is not needed.  The Commission asked that anyone proposing to do any work, to please call the Land Use Office just to let them know what maintenance they will be doing so the Commission is aware of it.
