Draft Minutes

 

1.   CALL TO ORDER:

 

Chairman Brown stated there was no quorum present, so New Business would be conducted with no official actions taken.

 

COMMISSIONERS PRESENT:

George Brown, Chairman, Mark Grigg, Vice-Chair Duane White, Kevin Geary arrived at 7:06 p.m.,  Mac Gray and Robert Miner arrived at 7:25 p.m.

 

COMMISSIONERS ABSENTArt Dobley, Ron Lewis and Marvin Chase, Jr. 

 

STAFF PRESENT:

 

Cheryl Konsavitch, Administrative Assistant and Wayne Berardi, Wetlands Enforcement Officer

 

2.    NEW BUSINESS

 

#11-107 (Garage,Gazebo & Dock) Application of Peter J. Springsteel, 105 Starr Street, Mystic, CT  06355 to construct a detached 18’ x 24’ garage, 12’ dia. gazebo & dock landing in the wetlands buffer on property located at 44P Wyassup Lake Road owned by Kathleen Lathrop Thaxton in an R-80/SUOA.  Tax Map #70, Parcel #3888

 

Mr. Peter Springsteel, Architect was present representing the applicant.

 

Mr. Springsteel went over the proposal for the garage, gazebo and dock landing with the Commission. 

 

The Commission scheduled a site walk of the property for Sunday, November 13, 2011 at 8:30 a.m.

 

The Meeting was called to order at 7:06 pm.

4.   MINUTES:

 

Review minutes of September 14, 2011 meeting.

 

MOTION by G. Brown, SECOND by M. Chase to approve the Draft Minutes of 9/14/11 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

5.   OLD BUSINESS

 

A.  #11-073 (Gravel Operation Closure Plan) Application of Richard E. White, 189 Norwich-Westerly Road, North Stonington, CT  06359 for closure plans in three phases for a gravel operation on property located at 150 Norwich-Westerly Road in an R-40 Aquifer Protection Overlay Zone.  Tax Map #117, Parcel #7908

 

Susan Mattern, Land Surveyor, was present for this application. 

 

Ms. Mattern submitted the bond estimate and went over CME Associates response to Towne Engineer’s August 31st comments and the revised plan with the Commission.

 

The Commission discussed the bond estimate.

 

Nick Mullane, 1st Selectman stated that the Town had additional testing done by GEI due to the concerns of the Conservation Commission and because they had some millings on the site.  Mr. Mullane briefly went over the report and stated that this assessment concludes that the concentrations of groundwater on-site meet the current CT DEEP RSRs for both surface water protection criteria and GWPC (e.g. drinking water quality).  Additionally, the soil samples collected on site met the applicable CT DEEP RSRs.  GEI recommends no additional environmental assessment or remediation regarding the soil and groundwater at the subject property.

 

MOTION by D. White, SECOND by M. Gray to approve application #11-073 with the following stipulations.  MOTION CARRIED UNANIMOUSLY.

 

1.      Application approved per revised site-plan, submitted as Revision 1, dated 10/31/11

2.      Approved as a 5 year application length with Phase 1 approved as a 1 year period, Phase 2 & 3 for remaining time and

3.      $5,000 Surety bond for E&S rolled over at Phase completion to next Phase

 

MOTION CARRIED UNANIMOUSLY.

 

B.  #11-094 (Update Existing Septic & Well) Application of Robert A. Deledda, P.O. Box 243, North Stonington, CT  06359 to update the existing septic system & well on property located at 105 Reutemann Road in an R-80 Zone.  Tax Map #103, Parcel #2703

 

The Application was continued from the 10/12/11 meeting as it had to sit for the 30 day statutory time period.

 

MOTION by D. White, SECOND by K. Geary to approve Application #11-094 as submitted.  MOTION CARRIED UNANIMOUSLY.

 

C.   #11-098 (SFR) Application of Lawrence Umphlett, 246 North Stonington Road, Mystic, CT  06355 to construct a Single Family Residence, septic system, well, driveway & related site improvements on property located at 96 Yawbux Valley Road in an R-80 Zone.  Tax Map #86, Parcel #8795

 

The Application was continued from the 10/12/11 meeting as it had to sit for the 30 day statutory time period.

 

MOTION by D. White, SECOND by K. Geary to approve Application #11-098 as submitted.  MOTION CARRIED UNANIMOUSLY.

 

6.   DISCUSSION:       

 

Proposed Draft Updated Wetlands Regulations

 

Atty. Mike Zizka was present and went over the proposed updated draft regulations with the Commission.

 

Atty. Zizka will correct the typographical errors and submit a clean copy to the Commission for their review.

 

7.  ENFORCEMENT OFFICER’S REPORT

 

294 Cossaduck Hill Road

 

ZEO Berardi stated he received a complaint pertaining to the above mentioned address in which the property owner was creating man made dams.

 

ZEO Berardi inspected the site and found violations on the property.

 

8.  ADJOURNMENT 

 

MOTION by D. White, SECOND by M. Grigg to adjourn the Inland Wetlands Commission Meeting at 8:45 p.m.  MOTION CARRIED UNANIMOUSLY.
