Draft Minutes

 

1.   CALL TO ORDER:

Chairman Duane White called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, September 9, 2009 at 7:00 p.m.

 

COMMISSIONERS PRESENT:

Duane White, Chairman, Mark Grigg, Vice-Chairman (arrived at 7:05 p.m.), Ron Lewis, Kevin Geary, George Brown and Mac Gray

 

COMMISSIONERS ABSENT:  D’Arcy Cleveland, Arthur Dobley and Robert Miner

 

STAFF PRESENT:

Cheryl Konsavitch, Administrative Assistant and Wayne Berardi, Wetlands Enforcement Officer

 

2.   ADDTIIONS TO THE AGENDA:    

 

MOTION by G. Brown, SECOND by R. Lewis to amend the agenda to go to Workshop after Minutes then back to regular agenda format.  MOTION CARRIED UNANIMOUSLY.

 

3.   MINUTES:

 

Review minutes of August 12, 2009 meeting.

 

MOTION by G. Brown, SECOND by R. Lewis to approve the Draft Minutes of  8/12/09 with the necessary corrections to reflect  the complaint and discussion of a possible wetlands violation at 421 Wyassup Road.  MOTION CARRIED UNANIMOUSLY.

 

7.   WORKSHOP:   

 

Gayle Gulaya, 241 Clarks Falls Road to discuss drainage issues on her property

 

The Commission asked Mr. Randy Winslow and James Crider to come before the Commission to continue the discussion on drainage issues.  Ms. Gayle Gulaya believes the issues were caused by a work that Mr. Crider did on his property at 237 Clarks Falls Road.

 

Mr. Crider had received a Notice of Violation from the Wetlands Enforcement Officer in 2001.  When Mr. Crider came before the Commission on 8/08/01 he stated that he was repairing drainage and did not know a permit was required.  The Commission at that time had given him permission to repair the drainage and told them in the future to notify the Commission if they were to do any future work.

 

4.   PUBLIC HEARINGSNone 

 

5.   OLD BUSINESS:    

 

A.  #09-059 (Single-Family Residence) Application of Scot E. Deledda, P.O. Box 23, North Stonington, CT  06359 to construct a single-family residence on property located at 20 Billings Road, North Stonington, CT  06359.  Tax Map #45, Parcel #3970

 

MOTION by G. Brown, SECOND by M. Grigg to approve application #09-059 as submitted and to use proper Erosion & Sediment Control.  MOTION CARRIED UNANIMOUSLY.

 

B.   #09-062 (Single-Family Residence) Application of Robert Demara, 490A Providence-New London Turnpike, North Stonington, CT  06359 to construct a single-family residence on property located at 130 Hangman Hill Road, North Stonington, CT  06359.  Tax Map #96, Parcel #9573.

 

MOTION by K. Geary, SECOND by G. Brown to approve application #09-062 as submitted.  MOTION CARRIED UNANIMOUSLY.

 

C      #09-065 (Accessory Structure) Application of Russ Stewart, 9 Billings Road, North Stonington, CT  06359 to install a 22’ x 21’ mini barn on property located at 9 Billings Road, North Stonington, CT  06359.  Tax Map #35, Parcel #5813.

 

The applicant was not present.  The Commission had questions as to why the structure needs to be in the buffer.  The Commission was to do individual site walks on this property for the September meeting but no Commission members looked at the site.  The members will look at the site individually for the October meeting.  The applicant will return for the October 14, 2009 meeting.

 

D.     #09-066 (Construction of a Driveway) Application of James Johnson, P.O. Box 353, Ledyard, CT  06339 for the construction of a driveway, which a portion lies within delineated wetlands & 100’ upland review area.  Placement of 24 LF 15” cpp.  Area of wetlands to be disturbed is 3,039 square fee on property located at 296 Cossaduck Hill Road, North Stonington, CT  06359.  Tax Map #57, Parcel #4441

 

Susan Camp, Professional Engineer and the applicants James and Robin Johnson were present for this application.

 

Ms. Camp went over the site-plan with the Commission and read a letter from Mark Sullivan, Soil Scientist into the record.  The Commission will do individual site walks on the property.

 

Mr. & Mrs. Johnson gave verbal permission to the Wetlands Commission for them to go on their property for the site walks.

 

The applicant will return for the October 14, 2009 meeting.

 

6.   NEW BUSINESSNone      

 

8.   DISCUSSION:    

 

A.  Complaint/response regarding 39 Ledgenwood Road/Kurimai

 

The Commission will do individual site walks to determine if this is a maintenance issue or a violation.

 

B.  The Commission discussed a wetlands issue at 31 Yawbux Valley Road on the Caswell property.  Chairman White stated to the Commission they he had looked at the site and asked Mr. Caswell to use property Erosion & Control measures.  Chairman White stated he will follow up with site inspections.

 

C.  Chairman White discussed 31G Clarks Falls Road and stated no work has been done with the drainage issue caused by site improvements on their property.  The Commission asked that a letter be sent to the property owners and have them come before the Commission at their October 14 wetlands meeting.

10.  CORRESPONDENCE:

 

Letter from K. Comstock pertaining to Pinewoods Road

 

The Commission reviewed a letter that was sent to the Selectman pertaining to the paving of Pinewoods Road.

 

Mr. Charlie Smith also discussed Pinewoods Road with the Commission and stated that they were not informed of anything being done to the road.  The Commission asked that a letter be sent to the Selectmen to come before the Commission to discuss Pinewoods and other town roads being worked on.

 

11.  ADJOURNMENT 

 

MOTION by K. Geary, SECOND by G. Brown to adjourn the Inland Wetlands Commission Meeting at 8:20 p.m.  MOTION CARRIED UNANIMOUSLY.
