1. CALL TO ORDER:
Chairman Duane White called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, August 12, 2009 at 7:00 p.m.
COMMISSIONERS PRESENT:
Duane White, Chairman, Mark Grigg, Vice-Chairman (arrived at 7:05 p.m.), Ron Lewis, Kevin Geary, George Brown, Mac Gray and Robert Miner (arrived at 8:38 p.m.)
COMMISSIONERS ABSENT: D’Arcy Cleveland and Arthur Dobley

2. ADDTIIONS TO THE AGENDA:
MOTION by G. Brown, SECOND by R. Lewis to amend Item C under New Applications to add underground utilities to the application. MOTION CARRIED UNANIMOUSLY.
3. MINUTES:
Review minutes of 4/08/09 meeting.
MOTION by M. Gray, SECOND by G. Brown to approve the Draft Minutes of 4/08/09 with the necessary corrections. MOTION CARRIED UNANIMOUSLY.
4. PUBLIC HEARINGS: None
5. OLD BUSINESS:
A. SP #09-035 (Site Plan Extension) Application of North Stonington Bible Church, 100B Jeremy Hill Road, North Stonington, CT 06359 for an extension of approved site plan #04-078 for a 5 year extension to for the expansion of the existing church assembly facility and associated infrastructure on property located at 100B Jeremy Hill Road, North Stonington, CT 06359 in an R-60 Zone. Tax Map #115, Parcel #0343 (Commission received on 6/10/09)
MOTION by G. Brown, SECOND by R. Lewis to approve application SP #09-035 for a 5 year extension. MOTION CARRIED UNANIMOUSLY.
B. #09-051 (Single-Family Residence) Application of Roger Watrous, 351 Wyassup Road, North Stonington, CT 06359 to construct a single-family residence on property located at 355 Providence-New London Turnpike, North Stonington, CT 06359. Tax Map #111, Parcel #8370 (Commission received on 7/08/09)
MOTION by R. Lewis, SECOND by G. Brown to approve application #09-051 as submitted. MOTION CARRIED UNANIMOUSLY.
C. #09-055 (Single-Family Residence) Application of Don & Rebecca Welch, 580 Taylor Hill Road, Jewett City, CT 06351 to construct a single-family residence, garage, proposed driveway, electric service (underground & to place a footing drain in the 100’ upland review area on property located at 230/254 Mystic Road, North Stonington, CT06359 Tax Map #107/114, Parcel #6171/7078 (Commission received on 7/08/09)
MOTION by R. Lewis, SECOND by K. Geary to approve application #09-055 as submitted. MOTION CARRIED UNANIMOUSLY.
6. NEW BUSINESS:
A. #09-059 (Single-Family Residence) Application of Scot E. Deledda, P.O. Box 23, North Stonington, CT 06359 to construct a single-family residence on property located at 20 Billings Road, North Stonington, CT 06359. Tax Map #45, Parcel #3970
Mr. Deledda was present for this application and went over the site plan with the Commission. The Commission will do individual site walks of the property and the applicant will return for the September 9th meeting.
B. #09-061 (Shunock River Dam Repair) Application of the Town of North Stonington, 40 Main Street, North Stonington, CT 06359 for dam repair and compliance with CT DEP Dam Report and Town Engineer’s scope of work on property located at Hewitt Road, North Stonington, CT 06359. Tax Map #101, Parcel #2284
Mr. Mullane came before the Commission and went over the plans for the repair. The Commission determined that the State has jurisdiction over this project which is referred to in Section 5 of the Wetlands Regulations.
C. #09-062 (Single-Family Residence) Application of Robert Demara, 490A Providence-New London Turnpike, North Stonington, CT 06359 to construct a single-family residence on property located at 130 Hangman Hill Road, North Stonington, CT 06359. Tax Map #96, Parcel #9573.
Mr. Demara and Mr. Scott Deledda were present for this application.
Mr. Deledda went over the site plan with the Commission. The Commission will do individual site walks of the property and the applicant will return for the September 9th meeting.
D #09-065 (Accessory Structure) Application of Russ Stewart, 9 Billings Road, North Stonington, CT 06359 to install a 22’ x 21’ mini barn on property located at 9 Billings Road, North Stonington, CT 06359. Tax Map #35, Parcel #5813.
WEO Berardi represented the applicant who could not be present and stated the barn is in the buffer. The Commission will request the applicant stake of the area and do individual site walks of the property and return for the September 9th meeting.
E. #09-066 (Construction of a Driveway) Application of James Johnson, P.O. Box 353, Ledyard, CT 06339 for the construction of a driveway, which a portion lies within delineated wetlands & 100’ upland review area. Placement of 24 LF 15” cpp. Area of wetlands to be disturbed is 3,039 square fee on property located at 296 Cossaduck Hill Road, North Stonington, CT 06359. Tax Map #57, Parcel #4441
Mr. Johnson asked that his application be tabled until the September 9th meeting, in order for his attorney to look over some correspondence Mr. Johnson had received from an abutting property owner earlier that evening.
MOTION by G. Brown, SECOND by M. Gray to table application #09-066 to September 9, 2009 meeting. MOTION CARRIED UNANIMOUSLY.
7. WORKSHOP:
A. Julie & Byron Stillman, 31G Clarks Road to come before the Commission to discuss drainage issues pertaining to site improvements.
Chairman White stated that they are putting a culvert across the driveway toward the road to address this issue.
B. Milltown Commons to discuss proposed New England Design District.
Mr. Alan Pesch came before the Commission to give an overview of the proposal for Milltown Commons, which is a New England Village Special Design District. The Commission stated that when the project comes before wetlands they will need to discuss mitigation.
C. Gayle Gulaya, 241 Clarks Falls Road to discuss drainage issues on her property
Ms. Gulaya came before the Commission to revisit the drainage issues on her property which she believes is a result of work that was done by the abutting property owner.
The Commission stated they believe this is a civil issue between property owners, but asked Ms. Gulaya to come back for the September 9th meeting and the Commission will ask Mr. Winslow and Mr. Crider to come before the Commission to discuss the drainage.
8. DISCUSSION:
A. Donna LaPlante of 417 Wyassup Road came before the Commission regarding a complaint against her regarding maintenance on her property. Ms. LaPlante stated they rebuilt the dock pylons, dock and a stone wall. The Commission determined it was maintenance.
Mrs. LaPlante also submitted a complaint against William Ricker, 421 Wyassup Road who she states has recently started construction on an addition to his shed, constructed a floating dock and anchored it off shore, performed maintenance on an existing dock attached to land at his residence at 421A Wyassup Road and has constructed a dock fixed to land on his property at 421B Wyassup Road..
B. Complaint/response regarding 39 Ledgenwood Road/Kurimai
The Commission discussed a complaint they received regarding the above property. Ms. Kurimai replied to the Commission in a letter stating they are constructing a 16 x 4 solid wall at the location of the original shoreline, which was marked by a row of large stones laid before the lake level was raised.
The Commission determined this was a maintenance issue.
C. Complaint regarding erosion on property owned by Waco L.L.C. on Billings Lake, Tax Map #45, Parcel 8374
WEO Berardi looked at the site and stated there are no wetland issues with this site.
