1. CALL TO ORDER:
Chairman George Brown called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, June 13, 2007 at 7:00 p.m.
COMMISSIONERS PRESENT:
George Brown, Chairman, Duane White, Vice-Chairman, Ron Lewis, Mark Grigg, Arthur Dobley, Kevin Geary, Mark Grigg (arrived at 7:07 p.m.)
STAFF PRESENT:
Cheryl Konsavitch, Administrative Assistant and Wayne Berardi, Wetlands Enforcement Officer (arrived at 7:18 p.m.)

3. MINUTES:
MOTION by D. White, SECOND by A. Dobley to approve the Draft Minutes of May 9, 2007 as presented. MOTION CARRIED UNANIMOUSLY.
4. PUBLIC HEARINGS: None
5. OLD BUSINESS:
A. #07-054 (Accessory) Application of Douglas LaFaive, 6 Quarry Path, Stonington, CT 06378 for a Wetlands Permit for a 16 x 24 x 18” accessory building and for the placement of greenhouses on property located at 476 Norwich-Westerly Road, North Stonington, CT 06359. Tax Map #94/2732, Lot #18/4693
Mr. Douglas La Faive was present for this application.
The Commission did a site walk on this property and discussed there findings. Chairman Brown stated when he drove by; it looked like the stream has been mucked out. Mr. LaFaive stated that the Commission recommended a plunge pool and stone to give him some acreage for his blueberries.
R. Lewis stated his concern with the site was that the applicant not get carried away like he did on the driveway. Mr. LaFaive stated he went bigger on the driveway because he got caught in there twice with his tractor and had to have it towed out. The Commission recommended that Mr. LaFaive put in 2 10” diameter culverts under the driveway and put stone along the shoulders to keep it stable and equal the pressure out because there is an obstruction there. Mr. LaFaive stated the beavers are damming the area and backing it up. Chairman Brown stated the applicant may want to talk to DEP about the beavers.
Vice-Chairman White stated the Commission saw some disturbance out in back and would like to see it refit into its hole and re-vegetated and stabilized. The Commission was satisfied where the placement of the accessory structure was to be located. Vice-Chairman White stated the 3 items they want done is the plunge pool and channelize the water coming off Route 2 through the blueberry bushes, culverts under the driveway and armor the banks of the driveway and re-grade the test hole in the back of the property.
MOTION by D. White, SECOND by K. Geary to approve permit #07-054 with the following modifications:
1. Water crossing Route 2 should be dumped into a stone lined plunge pool and then channelized into a stone lined channel running in an easterly direction to the wetlands.
2. Install two (2) 10” diameter culverts under the driveway to eliminate the
impoundment caused by the driveway
3. Place large stone along the shoulders of the driveway to armor it and keep it stable
MOTION CARRIED UNANIMOUSLY.
B. #07-067 (Accessory) Application of Steven Bossie, P.O. Box 351, North Stonington, CT 06359 for a Wetlands Permit for part of an approved accessory structure to be a primary residence at property located at 165 Babcock Road, North Stonington, CT 06359. Tax Map #110/2742, Lot #53/3029
Mr. Steven Bossie was present for this application and went over the site plan with the Commission.
WEO Berardi stated that the original plan was for a barn which was signed off by the IWC with the stipulation that erosion & sediment control be in place before any construction starts. WEO Berardi stated that when he did an inspection at the property the barn was built and there was no evidence of silt fence anywhere and there was a wetlands area that had been clear cut. WEO Berardi stated that he was led to believe the pond that is on the property was existing, and was just a maintenance issue and not a red maple forest that had been clear cut. R. Lewis stated the Commission did a site-walk on the property during the wet season and there was a foot and a half of water around the pond and grown up over brush. WEO Berardi stated he could not see where it had ever been a pond, but a red maple
swamp and if the applicant was going to do maintenance in a wetland area, a permit is needed. The applicant did the clear cutting and then came before the Commission to ask for a pond. WEO Berardi stated he could not find where a soil scientist had delineated the wetlands on the plan.
WEO Berardi stated the reason he did an inspection on the property was that the initial permit did not have a septic system and he went to see if the location was acceptable. WEO Berardi stated that where the septic system is going is some what wet, and it is not an upland area and the other problem is there is a water issue at the end of the driveway that was there before, but the driveway may have exaggerated it. WEO Berardi stated that if anything needs to be done to correct it, now would be the time to do it.
The Commission discussed the septic location and the pond/red maple swamp.
MOTION by D. White, SECOND by M. Grigg to approve Permit #07-067 with the septic system and barn modification with the following conditions:
1. To install a wood chip berm placed around the existing stone wall in the area of disturbance for the septic area and
2. To call the Land Use Office when the Erosion and Sediment measures are in place for inspection by WEO Berardi.
MOTION CARRIED UNANIMOUSLY.
6. NEW BUSINESS:
A. #07-076 (Single-Family Residence) Application of Daniel C. Amici, 228 Clarks Falls Road, North Stonington, CT 06359 for a Wetlands Permit for a Single-Family Residence on property located at 228 Clarks Falls Road, North Stonington, CT 06359. Map #105, Parcel #9724
Mr. Daniel Amici was present for this application and went over the site-plan with the Commission.
Mr. Amici will return for the July 11, 2007 Inland Wetlands meeting.
B. #07-101 (10- lot Subdivision) Application of Concord Equity Group, L.L.C./Courtyard 10, L.L.C., c/o Dana Barnes, Mgr., 16 William F. Palmer Road, Moodus, CT 06469 for a Wetlands Permit for a 10-lot subdivision with activity within the upland review area for property located on Babcock Road, North Stonington, CT 06359. Map #110, Parcel #3901
Mr. Dana Barnes of Concord Equity Group came before the Commission to review his application.
Mr. Barnes went over the site-plan and stated the property is a 74 acre piece on Babcock Road. Mr. Barnes stated there is minimal wetlands impact which he pointed out on the site-plan to the Commission. The Commission asked questions about the steepness of the driveway, which Mr. Barnes stated is a little under 20%. Mr. Barnes also stated they are trying to reduce curb cuts and would be requesting 6 lots off one driveway. Mr. Barnes stated the lot size goes from 2.8 to 34 acres.
The Commission discussed a site-walk with Mr. Barnes and the soil scientist and Mr. Barnes will get back to the Land Use Office on 2 potential dates of June 21 or June 27.
C. Election of Officers
MOTION by R. Lewis, SECOND by M. Grigg to nominate D. White as Chairman of the Inland Wetlands Commission. MOTION CARRIED UNANIMOUSLY.
MOTION by M. Grigg, SECOND by K. Geary to close the nominations for Chairman. MOTION CARRIED UNANIMOUSLY.

MOTION by G. Brown, SECOND by D. White to nominate M. Grigg as Vice-Chairman of the Inland Wetlands Commission. MOTION CARRIED UNANIMOUSLY.

7. WORKSHOP:
Mr. George Peet to discuss logging, an access road and a farm pond on property located at 63 Mystic Road, North Stonington, CT 06359. Map #108, Parcel #74ll.
Mr. Peet came before the commission to discuss an access road for logging and digging a farm pond. The Commission stated that Mr. Peet would need to get permission from the State DOT for an access road.
8. DISCUSSION:
A. Progress on the Regulation Updates
Chairman Brown stated he has met with Atty. Eppinger to discuss the updates and to incorporate them into the Regulations. A Public Hearing will be held when the amendments are ready.
B. Update on the IWC fee schedule
Vice-Chairman White went over the revised IWC fee schedule and will present a clean copy at the July 11, 2007 meeting.
C. Application of Farm Ponds Estates North, L.L.C. to conduct regulated activity within 500 feet of the North Stonington Town Line (Referral)
The Commission reviewed the application and felt the lot was inadequate in size and shape.
Jeremy Hill Subdivision Project Bond Release
MOTION by D. White, SECOND by M. Grigg to release the bond for the Jeremy Hill Subdivision Project. MOTION CARRIED UNANIMOUSLY.
The Commission discussed the $60,000.00 they had in the Wetlands Fund for mitigation and would like to move it to a high yield CD.
MOTION by D. White, SECOND by M. Grigg to move the $60,000.00 in the Inland Wetlands Fund to a high yield 6 month CD. MOTION CARRIED UNANIMOUSLY.
9. ENFORCEMENT OFFICER’S REPORT:
74A Anthony Road, Drainage Issues (Follow-up)
The Commission discussed the drainage issues and Vice-Chairman White will talk to Mrs. Lewis about the situation.

The commission went over their correspondence.
