1. CALL TO ORDER:
Chairman Duane White called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, October 10, 2007 at 7:00 p.m.
COMMISSIONERS PRESENT:
Duane White, Chairman, Mark Grigg, Vice-Chairman (arrived 7:04 p.m.), Kevin Geary, Mac Gray , Ron Lewis (left at 7:25 p.m.), D’Arcy Cleveland and George Brown
STAFF PRESENT:
Cheryl Konsavitch, Administrative Assistant and Wayne Berardi, Wetlands Enforcement Officer (arrived at 7:04 p.m.)

3. MINUTES:
Review minutes of 9/12/07 meeting.
MOTION by G. Brown, SECOND by R. Lewis to approve the Draft Minutes of September 12, 2007 as presented. MOTION CARRIED UNANIMOUSLY.
4. PUBLIC HEARINGS: None
5. OLD BUSINESS:
A. #07-130 (Single-Family Residence Seasonal) Application of Thomas Burdick, Sr., 10 Old Depot Road, Charlestown, RI 02813 to construct a single-family seasonal residence on property located at 44Q Wyassup Lake Road (Armstrong Pentway), North Stonington, CT 06359. Map #70, Parcel #3935.
Tony Nenna of On-Site Engineering was present representing the applicant.
The Commission discussed the site-walk they did of the property and had no issues.
MOTION by G. Brown, SECOND by M. Gray to approve application #07-130 with the stipulation that any changes to house settings or septic, Wetlands to re-review. MOTION CARRIED UNANIMOUSLY.
B. #07-135 (Repair & improve existing berm & outlet to Lantern Hill Pond) Application of MPTN Planning Department, c/o Peter Georgetti, 102 Pequot Trail, Mashantucket, CT 06338 to repair and improve existing berm and outlet to Lantern Hill Pond. Tax Map #92, Parcel #089534
Mr. Buddy Gardner and Peter Georgetti of MPTN Planning Department were present for this meeting.
K. Geary recused himself.
Chairman White stated that R. Lewis did a little research on the application and discussed some of the issues they found on the site-walk. Chairman White stated there are two earthen dams that have different water outlets or storages that could affect the earthen dam. Chairman White stated the out-flow of the Long Pond Lake has the inflow of the Lantern Hill Lake and what the Commission is looking at is changing the amount of water that is stored up front as well as impounding more water that made have an impact in a major event downstream.
R. Lewis stated that if you look at Section 5.2 and 5.4 of the Wetlands Regulations it states the Commissioner of Environmental Protection shall have jurisdiction over activities authorized under a dam repair or removal order issued by the Commissioner of Environmental Protection under section 22a-403 of the Connecticut General Statutes.
R. Lewis stated he contacted Wes Marsh of the Department of Environmental Protection Dam Safety and the DEP wants full jurisdiction over this application.
Mr. Georgetti stated DEP does not recognize this as a dam and R. Lewis stated it is an impoundment of water and they want full jurisdiction of the site as they are familiar with it because it has washed out part of Lantern Hill Road
The Commission discussed the fill and clean out on the easterly portion of this site.
R. Lewis stated that Mr. Marsh said this is classified as a hazard because it washed out the road already and he was familiar with the site.
Mr. Georgetti stated that what they are trying to do is to help out the Town of Leydard and since it doesn’t appear that is going to happen they will go back to their original plan.
Chairman White stated they will give them approval for the Town of North Stonington, but not for the entire site.
Chairman White stated he would contact Mr. Marsh of DEP to discuss how to proceed on this application.
MOTION by G. Brown, SECOND by M. Grigg to table this application to the November 14, 2007 meeting. MOTION CARRIED UNANIMOUSLY.
6. NEW BUSINESS:
A. #07-150 (Single-Family Residence) Application of Green Falls Associates, L.L.C., 1641 Route 12, Gales Ferry, CT 06335 to construct a single-family residence on property located at 16 Wintechog Hill Road, North Stonington, CT 06359. Map #101, Parcel #7288.
The Commission designated the Wetlands Enforcement Officer to sign of on application #07-150 as wetlands would not be affected.
B. #07-154 (Bridge Crossing) Application of Joseph Mascaro, Raymond Trebisacci, Steven Reck & Steven Bossie, 53 Oshwigochie Hills Road, Niantic, CT 06357 to modify approved application #06-084 (12-lot subdivision with 2 wetlands crossings) to modify one crossing to allow for construction of a bridge crossing on property located behind 126 Babcock Road, North Stonington, CT 06359. Map #110, Parcel #2742 & #8197.
Ellen Bartlett of CLA Engineering represented the applicant and went over the site-plan with the Commission.
The Commission discussed this application and stated it was less impact than the original plan, but they will need to have some kind of a coffer dam around the project.
MOTION by K. Geary, SECOND by G. Brown to approve application #07-154 with the conditions of de-watering bag for sediment control and sediment control around abutment during construction. MOTION CARRIED UNANIMOUSLY.
