1.   CALL TO ORDER:

Chairman George Brown called the Regular Meeting of the Inland Wetlands Commission to order on Wednesday, May 9, 2007 at 7:00 p.m.

COMMISSIONERS PRESENT:

George Brown, Chairman, Duane White, Vice-Chairman, Ron Lewis, Mark Grigg, D’Arcy Cleveland, Arthur Dobley, Kevin Geary, Mac Gray , Mark Grigg

STAFF PRESENT:

Cheryl Konsavitch, Administrative Assistant and Wayne Berardi, Wetlands Enforcement Officer (7:15 p.m.)

2.   ADDTIIONS TO THE AGENDA None

3.   MINUTES:

MOTION by D. White, SECOND by K.Geary to approve the Draft Minutes of April 11, 2007 as presented.  MOTION CARRIED UNANIMOUSLY.

4.   PUBLIC HEARINGS None 

5.   OLD BUSINESS

#07-055 (Excavation) Application of Joel Lamphere, P.O. Box 28, Hopkinton, RI  02833 for a Wetlands Permit to excavate and remove gravel from the site at property located at 112 Rocky Hollow Road, North Stonington, CT  06359 as indicated on the site plan to construct an agricultural pasture.  Proposed grading is outside the 100 foot buffer.  Tax Map #116/2731, Lot #78/7208

Mac Gray recused himself.

Mr. Tony Nenna, of On-Site Engineering, Inc. was present for this application.  Mr. Nenna went over the site-plan and stated the property is approximately 55 acres which the owner uses as an Agricultural Use and he would like to develop more pasture land in 3 phases.

The Commission asked if the applicant would be posting a performance bond and Mr. Nenna stated he believes the Planning & Zoning Commission would require an Erosion & Sediment Control Bond.

The Commission members stated they had walked the site and had no issues with this proposal.

Chairman Brown stated that the applicant will need to follow the site plan he has presented.

MOTION by D. White, SECOND by M. Grigg to approve Application #07-055 as presented.  MOTION CARRIED UNANIMOUSLY.

M. Gray returned to the meeting.

6.   NEW BUSINESS:

A.  #07-054 (Accessory)  Application of Douglas LaFaive, 6 Quarry Path, Stonington, CT  06378 for a Wetlands Permit for a 16 x 24 x 18” accessory building and for the placement of greenhouses on property located at 476 Norwich-Westerly Road, North Stonington, CT  06359.  Tax Map #94/2732, Lot #18/4693

Mr. Douglas LaFaive was present for this application and presented his application to the Commission showing them where he would be placing the accessory building and the greenhouses.

The Commission decided to conduct a site walk on this property on Tuesday, May 15, 2007 at 7:00 p.m.

The applicant will return for the June 13, 2007 meeting.

B.  #07-067 (Accessory) Application of Steven Bossie, P.O. Box 351, North Stonington, CT  06359 for a Wetlands Permit for part of an approved accessory structure to be a primary residence at property located at 165 Babcock Road, North Stonington, CT  06359.  Tax Map #110/2742, Lot #53/3029

Mr. Steven Bossie was present for this application and stated to the Commission that he would like to convert the approved accessory structure to a temporary residence.

Wetlands Enforcement Officer Berardi stated the original application was for a driveway and a barn with no septic system on the site.  The Commission asked WEO Berardi to look at the site and if there were no issues on the property to sign off on the application.

       

7.   WORKSHOP

A.  Mr. Gill Bliss, 145 Wyassup Road, North Stonington, CT  06359 for a follow-up                                      discussion on constructing a farm pond from a 2/14/07 Workshop.

Mr. Gill Bliss came before the Commission for a follow-up discussion on constructing a farm pond.  Mr. Bliss presented cut-sheets of the area proposed for the pond.  The Commission asked that the area be seeded and mulched and spoils around the edge. 

MOTION by D. White, SECOND by M. Grigg that it is the determination of the Inland Wetlands Commission that this is a Non-Jurisdictional issue.  MOTION CARRIED UNANIMOUSLY.

 B.  Mr. Gary Winalski to discuss constructing a farm pond and reviewing a previously approved wetlands crossing for a Single-Family Residence at 152 Wyassup Road

Mr. Winalski came before the Commission to discuss digging a farm pond and a wetlands crossing.  Mr. Winalski presented a site-plan of the previously approved sub-division and site-plan of the house with a wetlands crossing.  The Commission stated the wetlands need to be flagged by a certified soil scientist and the pond should have a beneficial reason.  The Commission directed Mr. Winalski to submit a formal application.

8.   DISCUSSION:

    

A.      Commission to discuss procedure on site-walk cancellations

The Commission stated that they would contact each other using a phone tree for the cancellation of site-walks due to inclement weather.

B.      Progress on the Regulation Updates

Chairman Brown stated he has not been able to get an appointment with their Commission Attorney to discuss the updates.

C.      Update on the IWC fee schedule

Vice-Chairman White stated he will report on the progress of the IWC fee schedule at the June 13, 2007 meeting.

D.  Existing conditions & proposed site clearing for property located at Bush Pond, 586A

Lantern Hill Road, North Stonington, CT  06359  (Informational)

The Commission reviewed the informational plans for the above project that was submitted to the Land Use Office.

9.  ENFORCEMENT OFFICER’S REPORT:

 

A.  WEO Berardi went over information on the Algonquin Gas Transmission proposed East to West expansion project.

 

B.  74A Anthony Road, Drainage Issues (Lewis)

WEO Berardi did a site inspection and took photographs of the run-off issues that are causing a problem on the Lewis Farm on Boombridge Road.  WEO stated there is a drainage swale and the bulk of the water comes off of that.  There is a running stream in the ditch and it dead ends into the corn field and this is where all the water is coming from that is causing the problem.  WEO stated that the  approximate 4 acres of corn that were under the water last year were at the edge of the pond, not out in the middle of the field and was a result of the pond being high.  WEO stated there are 5 run-offs that come off of there heifer lot onto the property, including the one that is a stream, with 2 being from the neighbors that are  minor in nature and not a wetlands issue.  WEO stated they do get some water from the neighbors, but it is not the cause of the flooded fields. The Commission discussed the water issue and stated that over the years the silt from the cornfields sealed the fields which have caused the drainage issues.  Vice-Chairman White and WEO Berardi will visit the Lewis’s and explain to them the situation.

C.  4 Chester Main Road, Run-off into the culvert

WEO Berardi stated the water comes from the Woods property where a wetland area was filled in.  The water runs through the horse field and goes into the culvert in a rain event. 

10.  CORRESPONDENCE

The commission went over their correspondence.

11.  ADJOURNMENT 

MOTION by, M. Gray, SECOND by K. Geary to adjourn the Inland Wetlands Commission Meeting at 8:45 p.m.  MOTION CARRIED UNANIMOUSLY.
