Call to Order-7:00 PM with Selectmen Mullane, Ricker and Murphy present.
Public Comments and Questions-Tim Bass, Little League, provided status of Little League project on Swantown Hill Road.  Also asking if there was possibility that the Town could get a STEAP Grant for the project.  General Discussion on Town monetary support of a non-municipal entity and any STEAP request would have to compete with other Town projects.
Minutes-A motion was made by Selectman Murphy and seconded by Selectman Mullane to approve the minutes of January 21, 2009, carrying 2-0-1  Selectman Ricker was away on vacation for that meeting.

Old Business-
1.   Tribal Issues-The US Supreme Court without comment declined to hear MichGo v. Kempthorne, a lawsuit that tested the ability of the Federal government to acquire land for tribes.   The Town will monitor the results of Carcieri v. Kempthorne which was heard last fall, a case that could change the way that DOI deals with tribes that gained federal recognition after passage of the Indian Recongition Act of 1934.  
There has been many new members appointed to the Senate Indian Affairs Committee, Sen. Byron Dorgan of North Dakota remains Chairman and it is difficult to predict how they will respond to Indian issues.
2.   Subdivision Review and Planning and Zoning Issues-
Garden Court LLC-Record filed on August 4, 2008-Appeal dropped by Garden Court.

7.  Affordable Housing Committee-Agreement to use Mark Branse, Esq. as attorney unless PZC has not made other arrangements.  We will now try to get a date for the joint meeting.

10.   FY 2009-2010 Budget-Selectman Mullane should invite Highway Foreman to discuss budgets for next year.  Bob Shabunia and Joe Cassata were in from Fire Company and reviewed budget presentation with the Board, including Company contribution to offset costs to the Town.  Brian Elias, President of the NSAA discussed operating, capital and fixed charges for the Association.
11.   2009-2010 Legislative Agenda-State is pushing smart growth and economic sharing, looks like Town Aid will be cut for next year and possibly this year as well.
12    STEAP Grant applications-Selectman Mullane will have ready for next meeting

New Business
        1.  Wheeler Library-William Hescock, Wheeler Library Chairman was in to inform the Selectman Mullane that the Library will be receiving a $100,000 grant and hope the Town could increase the donation given this year to $25,000 to assist in facility improvements and a program expansion.
