MINUTES OF BOARD OF SELECTMEN MEETING
MONDAY SEPTEMBER 29, 2008


Chairman Mauceri called the meeting to order at 7:00 p.m. in Room 14 at Town Hall in the presence of members Mr. O’Leary, Mr. Harris, Mr. Veno, and Mr. Delaney and the Town Administrator Greg Balukonis.

1.      MINUTES:        AUGUST 18, 2008 REGULAR SESSION

MR. CHAIRMAN, I MR.HARRIS MOVE TO APPROVE THE AUGUST 18, 2008 REGULAR SESSION MINUTES AS WRITTEN.

VOTED:          UNANIMOUS (5-0)

2.      TRANSFER OF LIQUOR LICENSE – RISTORANTE DANIELA, 303 MAIN ST.:

Ms. Darlene Buonopane was represented by her counsel Jill Mann of Mann and Mann Counselors at Law.  Her request for a liquor license was brought before the Board of Selectmen for discussion.  The Board of Selectmen asked many questions such as the target date to open, are the employees TIPS trained, what is the capacity of the establishment?

Counselor Mann answered these questions for the Board.

MR. CHAIRMAN, I MR. HARRIS MOVE TO APPROVE THE TRANSFER OF THE COMMON VICTUALLER/ALL ALCOHOL LICENSE FOR RISTORANTE DANIELA, 303 MAIN STREET FROM SOPAC, INC. TO DARLENE BUONOPANE.

3.      PROJECT STATUS – COMPREHENSIVE WASTEWATER MANAGEMENT PLAN

Mark Clark Superintendent of the Water Department presented to the Board of Selectmen a status update on the Wastewater Management Plan.  He discussed 5 issues; Betterment Cost, Implementation Alternatives, Capacity, Alternatives to Local Groundwater Discharge and the Department of Environmental Protection Status.  The Board discussed with Mr. Clark additional grant money alternatives, meeting with the Hillview Commission other options under the alternative plan and presenting the information in a larger forum.

4.      CHARGE OF THE FISCAL ADVISORY COMMITTEE

Mr. Mauceri read the charge of the Fiscal Advisory Committee.

5.      MEET THE FISCAL ADVISORY COMMITTEE

The FAC made a presentation which included the reason to have a Fiscal Advisory Committee and some potential areas for efficiencies/savings such as Sick time buybacks, Cost of medical benefits/collaboration of benefits, Split tax rate, School budget and Overtime rates.

After the presentation by the FAC the Board of Selectmen discussed the different ideas that were presented and a timeline to implement the changes.

6.      STATEMENT OF INTENET

MR. CHAIRMAN, I MR. HARRIS MOVE TO SIGN THE JOINT STATEMENT OF PUBLIC INTENET BY AND BETWEEN THE BOARD OF SELECTMEN, SCHOOL COMMITTEE AND FINANCE COMMITTEE.

Abigail Hurlbut, Finance Committee Chairman commented on the importance of the Statement of Public Intent which shows the committee’s involve are commitment to a goal.

Mr. Mauceri discussed the importance of sticking to a budget schedule to be able to have the financial number s the number earlier rather than later.

7.     RATIFY POLICE UNION CONTRACT

MR. CHAIRMAN, I MR. HARRIS MOVE TO RATIFY THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE TEAMSTERS LOCAL 25 AND THE TOWN OF NORTH READING FOR THE PERIOD JULY 1, 2006 THROUGH JUNE 30, 2009 WHICH INCORPORATES THE MEMORANDUM OF AGREEMENT SIGNED 3/24/2008.

VOTED:          2 AYE- 1 NO- 2 ABSTAIN

The Board of Selectmen discussed signing the document with the attached cover letter.

8.      OCTOBER TOWN MEETING

Mr. Balukonis submitted to the Board of Selectmen an Analysis of Police Details per the Boards request.  The Board members discussed the difference in fiscal years and the revenue realized by the town.  Mr. Mauceri request more information to be added to the Analysis.

9.      TOWN ADMINISTRATOR’S REPORT

·       Mr. Balukonis made public acknowledgement of members for the police department for their outstanding efforts and assistance to the Fire Department associated with a house fire at addressStreet3 Westward Circle.  Those members were Detective Michael McAuliffe and Thomas Encarnacao, Patrol Officers Bruce Heeter and James McCormack and Lieutenant Kevin Brennan.  
·       Mr. Balukonis shared with the Board of Selectmen a detailed breakdown of a Community Policing Grant provided by the Chief of Police, Edward Nolan.  Some of the proposed expenditures included supplies and Operating Expenses, Training and Overtime Training and replacement costs.
·       Mr. Balukonis provided the Board with a letter written by Mr. Angelo Petrosino who is developing a residential subdivision on the Andover/North Reading line.  Mr. Petrosino requests the North Reading and Andover BOS approve a Intermunicipal Agreement providing for water service to 11 lots located in the Town of placeCityAndover, Administration recommends the Town not enter into an Intermunicipal Agreement.  A number of issues still need to be resolved by the Community Planning Commission and the Town of CityAndover before a separate three-party agreement should be considered by placeNorth Reading.
·       Mr. Balukonis reports of several residents contacted him recently about their concerns over an ongoing problem with surface run-off on Mt. Vernon Street.  Town officials liked into the residents’ concerns and concluded the run-off is from the adjacent Chapter 40B development which in under construction.  The handling of the storm water was included as part of the comprehensive permit issued for the development.  As such, the issuance of the final occupancy permits of the 2 last units is conditioned on handling the run-off created by the project.
·       Mr. Balukonis request the Board of Selectmen for a Strategic Planning Session.

10.     OLD AND NEW BUSINESS

·       Mr. O’Leary urged voters to vote no on Question 1.
Mr. Harris
·       Mr. Harris Fire Department Open House on October 19, 2008 from 11-2.
Mr. Veno
·       Mr. Veno questioned the process of the renewal licenses on the Alcohol, requiring that all the employees of an establishment are TIPS (Training for Intervention ProcedureS) certified.

Mr. Delaney

·       Mr. Delaney commended the Police Officers and Chief Harris and his men for their response to the fire at 3 Westwood Circle.
·       Mr. Delaney commended his fellow members of the FAC on a job well done time and effort that they have put in since June in putting together their first presentation to the board.
·       Mr. Delaney discussed Mr. Sweeny’s letter from addressStreetDodge Rd concerning the parking, traffic and safety issues which are ongoing at the High School from time to time.  The expectation is that Chief Nolan will respond as well as they did to the Little School issues.
·       Mr. Delaney commended Mr. Hanlon and the Department of Public Works staff on two issues first the flooding of addressStreetHancock Street the DPW staff worked very hard to put that road back together so there was not a hazardous situation.  Secondly the water mainbreak on Chestnut Street a few weeks ago again the staffs quick response and problem solving they had that road opened to residents in that area.

Mr. Mauceri

·       Mr. Mauceri echoes all of Mr. Delaney’s accolades.
·       Mr. Mauceri thinks it is very important to take a stand on the issue of Question 1.
·       Mr. Mauceri encouraged all citizens to attend to October Town Meeting.
·       Mr. Mauceri thanked the FAC and their efforts.

11.     EXECUTIVE SESSION

MR.CHAIRMAN, I MR. HARRIS MOVE TO ENTER INTO EXECUTIVE SESSION FOR THE PURPOSES OF DISCUSSION OF COLLECTIVE BARGINING OR LITIGATION, AND FURTHER THE BOARD OF SELECTMEN WILL RETURN TO OPEN SESSION THEREAFTER FOR THE SOLE PURPOSE OF ADJOURNMENT.
