Mr. Demetri moved, seconded by Mr. Weiss and voted 4-0;

        that the Conservation Commission accept the Minutes for June 13, 2006.

Members reviewed the Superceding Order issued by DEP and the area map showing the changes made in the delineation by the Superceding Order.

Ms. Trudeau will contact the owner.

addressStreet23 Williams Street

Mr. DeSousa, the owner of addressStreet23 Williams Street, was present.  He told the Commission that he was waiting for a letter on how to proceed and was unaware of the other meetings that took place after his initial meeting with the Commission.  He said he never filled in the wetlands but he did disturb the wetland buffer when removing the debris that Mr. Marlin left on his property after installing his fence within the wetlands.  Mr. DeSousa said it would be a hardship to him to lose his parking area that, as he says, “has been there forever” and he showed members pictures of how the site looked in the past.  Members advised him that the wetlands are 4’ onto Mr. Marlin’s property from the fence.  Members told Mr. DeSousa that they would like him to loam and seed at least 6’ from Mr. Marlin’s fence onto his property.  They told him that he could park his vehicle on the grassed area.

Ms. Trudeau advised members that she received a call from a neighbor about the owner of the property running a tile business out of his home.  He has expanded his stockpiles onto town-owned property, on a property at addressStreetShenandoah Road and may be filling wetlands.  Ms. Trudeau wrote the owner a letter asking him to come to this meeting but he did not show.

Mr. Weiss moved, seconded by Mr. Demetri, and voted 4-0;

        that the Conservation Commission approve of issuing fines on a daily basis, starting tomorrow, until the owner straightens out the situation with the Commission.

addressStreet2 Lantern Lane

Ms. Stone, owner of addressStreet4 Lantern Lane, was present, and stated her frustration with the slow progress of Mr. DePesa to clear up the violation on his property at addressStreet2 Lantern Lane.
She said that he still has not planted the two pine trees he was suppose to plant and the trampoline is still in the location that the trees are to go.  He was also suppose to install a privacy fence down the side boundary line between the two properties and installed a privacy fence half way and then a chain link fence the rest of the way.  Mr. DePesa will be sent a letter to advise Mr. Orchard, who was to oversee the work at the site, to write to the Commission and advise them that the work is completed by the next ConCom meeting on July 18th.

Certificate of Compliances

Ms. Trudeau said there is still a small area of lawn not established but otherwise, she didn’t see any issues.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

PersonNameRich Williams from Hayes Engineering was present.  Members advised him that there is a rip rap wall in the wrong location.  Members also discussed with him that there may be a vernal pool in the back woods.  Mr. Williams agreed that there may be a vernal pool on the property and will re-write his letter about the site noting that there is a vernal pool.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

Members talked with the owners during the site visit and advised them that a Certificate of Compliance would not be issued until the pile of debris on the backside of the fence is cleaned up.

Members saw no issues at their site visit.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

Mr. Allen advised members that the owner of this property is his neighbor, but he will make no financial gain from his decision.   There were no issues at the site

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

Members talked with the owners during the site visit and advised them that a Certificate of Compliance would not be issued until the pile of rocks is cleaned up.

Members saw no issues at their site visit.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

8 Jacob Raynor (placeLot 3)(245-1036)

Members advised Mr. Williams that the fall out for the detention basin was not installed correct.  Ms. Trudeau thought there wasn’t enough stone used.  Mr. Williams said that the roads and drainage would be reviewed when a Certificate of Compliance was requested under the subdivision NOI.  Members saw no other issues at this property.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission issue a Certificate of Compliance.

Members saw no issues at their site visit.

Public Hearings

addressStreet235 North Street – Request for Determination

Jim Kavanaugh, the engineer, was present.  Mr. Kavanaugh explained that the owner needs to add an additional grease tank and replace with septic tank with a new one.  He said plan “B’ is to replace the leach field.  Mr. Weiss asked if he would need to come back to the Commission if that were to happen.  Mr. Kavanaugh said the leachfield would be outside the 100’ buffer.  There was a problem with advertising in the paper but all the abutters were notified.  No abutters were present for the hearing.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

that the Conservation Commission close the Public Hearing and issue a Negative 3 Determination with no additional conditions.

addressStreet5 Hanah Graves Way (245-xxx)

Rich Williams, from Hayes Engineering was present.  Members didn’t see any flags hung when they visited the site.  Mr. Williams said they went by the old wetland delineation.  Other than the missing flags, members had no issues with the site.  The owner said the slope will be leveled off and a stone wall installed.  Mr. Williams will have the flags re-hung.  The DEP file number has not been issued yet.

M. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission accept the applicant’s request to continue the Public Hearing to July 18, 2006.

addressStreet4 Lindor Road (245-xxx)

Mr. Giovanangelo, the owner, was present.  He presented plans for an upgraded septic system.  Members had no issues on the site but there was a comment from DEP with regard to notifying Natural Heritage as to whether there was any endangered species in the area and no DEP file number has been issued yet.  

Mr. Demetri moved, seconded by Mr. Weiss and voted 4-0;

        that the Conservation Commission accept the applicant’s request to continue the Public Hearing to July 18, 2006.

addressStreet270 Haverhill Street (245-1212)

Luke Roy, from O’Neill Associates, was present for the applicant.  Mr. Innis, the applicant, is proposing to construct a new 60’ x 20’ single family house.  The septic system is to the left of the house with tight zoning setbacks.  The wetlands are 32’ from the limit of work. There is an intermittent stream along the left side of the property that is fed by a culvert and a wetland to the right.  A hill will be cut down to make room for the house.  Ms. Trudeau is concerned that if blasting is necessary, what impact will that
have on the stream.  Mr. Roy said, right now, he was unsure whether there will be a need for blasting.  The driveway is to be located on part of the septic system.  Ms. Trudeau said the stream is shown on the USGS map.  Mr. Weiss suggested that a condition be added that if blasting becomes necessary that the applicant should come back to the Commission with a plan for blasting.

Mr. Demetri moved, seconded by Mr. Weiss, and voted 4-0;

        that the Conservation Commission close the Public Hearing and issue the standard 35 conditions plus one additional condition for blasting.

Continued Public Hearings

addressStreet99 Marblehead Street (245-1209)

Laine Raia, the owner, was present.  Revised plans, dated 6/26/06, were submitted.  Ms. Raia stated her concerns regarding the location of the haybales and asked if they could be relocated.  Members advised her that she could relocate them 12’ off the edge of wetlands.  The contractor will be installing a versa lok wall with a poured concrete foundation.

        that the Conservation Commission adjourn the meeting at 9:30 PM.
