ZBA Case #2015:05 – Applicant Rick Newman for property located at 219 Lafayette Road, North Hampton, NH, requests a variance to Article IV, Section 405.1 – permitted uses I-B/R zoning district. The Applicant requests a variance to Permitted Uses to allow Charitable Gaming as an accessory use to a permitted eating and drinking establishment. The Applicant also requests an Appeal of an Administrative Officer – Zoning Administrator, to determine whether or not Charitable Gaming, as allowed by the State Statute is an accessory use to an eating and drinking establishment in the I-B/R Zone. Property owner: Bercrom, Inc., 38B South Road, North Hampton, NH 03862; M/L: 021-002-000; zoning district: I-B/R.

Mr. Rick Newman, through his Attorney Bernard Pelech, has withdrawn the presently pending Zoning Board of Adjustment Application for variance and Administrative Appeal. Mr. Newman has made a decision not to proceed with his plans for the restaurant and charitable gaming at that site.
