Selectmen Meeting Minutes 08/20/07
The Board of Selectmen held a regular meeting on Monday, August 20, 2007 in the meeting room at the C. H. Booth Library, Main Street, Newtown, CT.   First Selectman Rosenthal called the meeting to order at 7:30 p.m.

PRESENT:        First Selectman Herbert Rosenthal,   Selectman Joseph Bonowski, Selectman William Brimmer

ALSO PRESENT:  Finance Director Ben Spragg,  Town Engineer Ron Bolmer, one member of public, one member of press

VOTER PARTICIPATION:   None noted at this time.   

COMMUNICATIONS:  Selectmen received copies of the proposed CIP.  

ADD TO AGENDA:  Selectman Brimmer moved to add discussion on procedures for approving CIP to agenda.  Motion seconded and unanimously carried.

ACCEPTANCE OF MINUTES:  Upon motion of Selectman Bojnowski, the minutes of the 8/6/07 meeting were unanimously accepted as presented.

NEW BUSINESS

Road Acceptance, Pearl Street, Charlie’s Circle & Tilson Lane, “Tilson Woods” Subdivision
Selectman Brimmer moved to accept Pearl Street, Charlie’s Circle & Tilson Lane into the Newtown Highway System and to set a maintenance bond in the amount of $81,000 to be held by the town for a period of one year.  Motion seconded and unanimously carried.

Construction of stone wall in Town r.o.w. – 25 Winton Farm Road
Town Engineer Ron Bolmer advised that a landscaper is constructing a stone wall in the Town’s right of way.  He has instructed them to stop construction and advised that they can only appeal that decision to the Board of Selectmen.
        Selectman Brimmer moved to have Town Engineer send letter to property owner at 25 Winton Farm Road indicating that the wall has to be moved out of the Town right of way.  Motion seconded and unanimously carried.

Driveway Bond Releases
Selectman Brimmer moved to approve release of two driveway bonds as outlined on Attachment A.  Motion seconded and unanimously carried.

Tax Refunds
Selectman Bojnowski moved to approve August 2007 Refund No. 2 in the amount of $6,109.63.  Motion seconded and unanimously carried.

Amendment to Investment Policy
The Pension Committee has requested that the Board of Selectmen confirm and authorize that Closed End Mutual Funds are covered with the investment policy.
Selectman Bojnowski moved that, as Trustees of the Pension Plan, the Board of Selectmen believe that Closed End Mutual Funds are covered with the investment policy.  Motion seconded and unanimously carried.

Appointments
Selectman Brimmer moved to approve that the First Selectman make two appointments, as outlined on Attachment B, with the stipulation that Ms. Clancy takes the required courses for Inland Wetlands as soon as possible.  Motion seconded and unanimously carried.

Capital Improvement Plan
It was decided to invite representatives of Parks & Recreation and the Police Department to the next meeting to answer questions about the projects in the CIP.  First Selectman Rosenthal advised that the Board should also decide whether to extend another year of Open Space purchase funds.  Also, Hook and Ladder has hired an architect/engineer to look at the property on Sugar Street to determine whether a building could be put on the parcel.  If so, they will be coming back to the town for support.

Legal Matters
Selectman Bojnowski moved to enter executive session to discussion legal matters and to invite the Finance Director and clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 8:05 p.m. and returned to open session at 8:20 p.m.
Selectman Brimmer moved to approve legal defense for Newbrook LLC vs. Inland Wetlands Commission and to bring legal action against property owners at 4 Berkshire Road to enforce clean-up of property.  Motion seconded and unanimously carried.

Having no further business, the meeting was adjourned at 8:25 p.m.
