Selectmen Meeting Minutes 08/21/06
The Board of Selectmen held a regular meeting on Monday, August 21, 2006 in the meeting room at the C. H. Booth Library, Main Street, Newtown.  First Selectman Rosenthal called the meeting to order at 5:32 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer
        
ALSO PRESENT:  Finance Director Ben Spragg, Paul Mangiafico, Board of Education;  one member of press

VOTER PARTICIPATION: None

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the 8/7/06 meeting were unanimously approved as presented.

COMMUNICATIONS:  First Selectman Rosenthal received a letter from Jean Sander of Walnut Tree Hill Road expressing her concern for motorcycle traffic on Walnut Tree Hill Road and Glen Road.  Ms. Sanders feels that the motorcycles do not have legal mufflers creating excessive noise.  Mr. Rosenthal indicated that this is a police enforcement matter and they will be following up on it.
        First Selectman Rosenthal received a letter from Diane Warner of Fox Run Lane.  Ms. Warner is concerned that the intersection of Castle Hill Road and King Street is dangerous because of the curve in the roadway.  Mr. Rosenthal forwarded her letter to the Police Department and to Public Works.  

ADD TO AGENDA:  Selectman Brimmer moved to add discussion and possible action on modification of the Veterans Local Option Benefit Program and Assessment Exemption for Volunteer Fire and Ambulance.   Motion seconded and unanimously carried.

UNFINISHED BUSINESS

Capital Improvement Plan: Selectman Brimmer moved to accept the prioritized Capital Improvement Plan as outlined on Attachment A.  Motion seconded and unanimously carried.

NEW BUSINESS

Road Bond Reduction, Southbrook Lane, “Southbrook Estates” Subdivision
Selectman Bojnowski moved to reduce the road bond for Southbrook Lane, “Southbrook Estates” Subdivision in the amount of $108,000.00 as per recommendation of the Town Engineer.  Motion seconded and unanimously carried.

Maintenance Bond Release,  River Run, “Little Brook Knolls” Subdivision
Selectman Brimmer moved to release the maintenance bond for River Run, “Little Brook  Knolls” Subdivision as per recommendation of Town Engineer.  Motion seconded and unanimously carried.

Road Work Acceptance, Road & Drainage Work Agreement, Hoseye Coach Road, “Hoseye Coach Estates” Subdivision
Selectman Bojnowski moved to accept the road work for Road & Drainage Work Agreement, Hoseye Coach Road, Hoseye Coach Estates  Subdivision and to reduce the bond to $39,000 as per recommendation of Town Engineer.  Motion seconded and unanimously carried.

Driveway Bond Releases/Extensions
Selectman Bojnowski moved to release three driveway bonds and approve a six month extension for one driveway bond as outlined on Attachment B.  Motion seconded and unanimously carried.

Amendment to Fair Housing Marketing Plan
Selectman Bojnowski moved to accept the modifications to the Fair Housing Marketing Plan as recommended by the State Department of Economic and Community Development.  Motion seconded and unanimously carried. (Attachment C)

Tax Refunds
Selectman Brimmer moved to approve August Tax Refunds in the amount of $17,805.93.  Motion seconded and unanimously carried.

Appointments – None

Veterans Local Option Benefit Program
Selectman Brimmer moved to recommend to the Legislative Council to amend the above referenced Ordinance to increase the veteran’s tax benefit to 10% of the assessed value or $10,000.00, whichever is greater.  Motion seconded and unanimously carried.

Assessment Exemption for Volunteer Fire and Ambulance
Selectman Bojnowski moved to recommend to the Legislative Council to amend the above referenced Ordinance #79 to modify the language as outlined in Attachment D.   Motion seconded and unanimously carried.

Legal Matters
Selectman Bojnowski moved to enter executive session to discuss legal matters and to invite the Finance Director and the clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 6:35 p.m. and returned to open session at 6:45 p.m.

        Having no further business, the meeting was adjourned at 6:46 p.m.
