Selectmen Meeting Minutes 12/19/05
The Board of Selectmen held a regular meeting on Monday, December 19, 2005 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 5:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer, one member of public, one member of press

VOTER PARTICIPATION:  Ms. Barbara O’Connor, Littlebrook Lane, spoke regarding the Tax Incentive Application that was approved by the Board of Selectmen at the last meeting.  She is against offer tax incentives to businesses, although she realizes that all other towns do it so we have to do it to get businesses to come to town.   She also feels that town employees should be “kinder” to businesses that are already here.  She was involved in getting a building permit and felt the way she was treated was “degrading”.  She asked First Selectman Rosenthal if CCM has discussed illegal immigration.  Mr. Rosenthal answered that it has not yet been on their agenda.

COMMUNICATIONS:  Selectman Brimmer reported that he met with the Board of Education Chairman Elaine McClure, Police Chief Kehoe, two members of the Police Commission and Queen Street resident Robert Geckle to discuss the school bus routing on Queen Street.  Both Ms. McClure and Chief Kehoe pledged their support.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the 11/21/05 meeting were unanimously accepted as presented.

NEW BUSINESS

Appointment of Town Agent
In the past, Selectman Bojnowski has been appointed as Town Agent to act in the absence of the First Selectman.  Mr. Bojnowski is now traveling more for his business so it was decided that Selectman Brimmer might be more available, if needed.
        Selectman Bojnowski moved to appoint Selectman William Brimmer, Jr. as Town Agent.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to authorize Selectman Joseph Bojnowski to preside in the event that the Town Agent is unable to perform his duties.  Motion seconded and unanimously carried.

Appointment of Clerk
Selectman Bojnowski moved to appoint Jan Andras as clerk to the Board of Selectmen.  Motion seconded and unanimously carried.

Appointment of Town Attorney
Selectman Brimmer moved to appoint Town Attorneys as follows:  David Grogins, Esq. of Cohen and Wolf, PC (General Counsel and co-Bond Counsel) and to appoint Robert Fuller, Esq. (Land Use Issues) and to appoint Fred Dorsey of Siegel, O’Connor, Zangari, O’Donnell and Beck, PC (Labor Issues) and to appoint Paul Pollock, Esq. (Zoning Board of Appeals) and to appoint Robinson & Cole, LLP (Bond Counsel).  Motion seconded and unanimously carried.

Road Acceptance, North Ridge Drive, Pond View Drive
Not yet ready, according to Town Attorney.  

Maintenance Bond Release, Winter Ridge Road, “Old Farm Hill Sec. 2B” Subdivision
Selectman Bojnowski moved to approve the maintenance bond release for Winter Ridge Road, “Old Farm Hill Sec. 2B” Subdivision in the amount of $19,500.  Motion seconded and unanimously carried.

Bond Reduction, Road & Drainage Work Agreement, Bentagrass Lane
Selectman Brimmer moved to reduce the bond for Road & Drainage Work Agreement, Bentagrass Lane, Sterling Associates, LLC from $104,500 to $50,900.  Motion seconded and unanimously carried.

Road Work Acceptance, Road & Drainage Work Agreement, Farrell Road, “Newtown Hunt” Subdivision
Selectman Bojnowski moved to accept road work for Road & Drainage Work Agreement, Farrell Road, “Newtown Hunt” Subdivision and to reduce the bond to $6,400 which represents a maintenance bond to be held by the Town for one year.  Motion seconded and unanimously carried.

Fire Suppression Tank Bond Release, Chestnut Hill Road, “Berkshire Woods” Subdivision
Selectman Brimmer moved to approve the Fire Suppression Tank Bond for Chestnut Hill Road, “Berkshire Woods” Subdivision.  Motion seconded and unanimously carried.

Driveway Bond Releases
Selectman Brimmer moved to release 5 driveway bonds as outlined on the attachment.   Motion seconded and unanimously carried.

Termination of Fence Licensing Agreement – Debra Clark, 7 Currituck Road
First Selectman Rosenthal reminded that this Board approved a fence licensing agreement in October 2003 for Debra Clark of 7 Currituck Road to build a fence well within the Town right-of-way.  The agreement stated that the fence had to be at least ten feet back from the road.  The fence was built and in a few places is only 8.5 feet from the road.  Mr. Clark had told the First Selectman that that he was waiting for the contractor to get back to move the wall but it never happened.  Later he denied saying that it would be moved.
        Selectman Brimmer moved to terminate the Fence Licensing Agreement for Debra Clark of 7 Currituck Road.  Motion seconded and unanimously carried.

Proposed Purchase of Open Space
Not yet ready.  Withdrawn from agenda.


Parks & Recreation Employee Contract 2005/2008
First Selectman Rosenthal went over the changes negotiated in this contract.  
        Selectman Brimmer moved to authorize First Selectman Rosenthal to sign the Parks & Recreation 2005-2008 Contract.  Motion seconded and unanimously carried.

Appointments/Reappointments
Selectman Brimmer moved to approve re-appointments as outlined on attachment.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to approve new appointments as outlined on attachment.  Motion seconded and unanimously carried.

Tax Refunds
Selectman Brimmer moved to approve December 2005 Tax Refunds in the amount of $6,668.45.  Motion seconded and unanimously carried.

Legal Matters
Selectman Bojnowski moved to enter executive session to discuss legal matters and to invite the clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 5:55 pm and returned to open session at 6:05 pm.
        Selectman Bojnowski moved to authorize legal defense in Lovely vs. Town of Newtown Planning & Zoning.  Motion seconded and unanimously carried.

Having no further business, the meeting was adjourned at 6:06 pm.
