Selectmen Meeting Minutes 12/20/04
The Board of Selectmen held a regular meeting on December 20, 2004 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer,  Attorney Robert Hall, one member of press

VOTER PARTICIPATION:  None noted

COMMUNICATIONS:  First Selectman Rosenthal distributed copies of letters from the Commission on Aging regarding a senior center building at Fairfield Hills.  

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the December 6, 2004 meeting were unanimously accepted as presented.

Amendment to Road Work Agreement – Hundred Acres Road
Attorney Hall advised that a few months ago, this Board approved a Road Work Agreement for Ms. Judy Holmes.  The Holmes have now sold 13 of the 18 lots and are requesting that the Road Work Agreement be changed to the name of the new developer.
        Selectman Bojnowski moved to change Road Work Agreement, Hundred Acres Road and Dug Hill Road, Foxview Farm Estates in the amount of $180,000 from the name of Judith Holmes to BSS Development, LLC.  Motion seconded and unanimously carried.

Road Bond Reduction, Wentworth Drive, “Wentworth Estates” Subdivision
Selectman Brimmer moved to reduce Road Bond for Wentworth Drive, “Wentworth Estates” Subdivision from $160,000 to $40,000, upon recommendation of Town Engineer.  Motion seconded and unanimously carried.

Road Work Acceptance, Road & Drainage Work Agreement, The Old Road, “Currituck Heights” Subdivision
Selectman Bojnowski moved to accept work done under the Road & Drainage Work Agreement, The Old Road, “Currituck Heights” Subdivision and to set a maintenance bond in the amount of $2,000 to be held for a period of one year.  Motion seconded and unanimously carried.

Driveway Bond Releases/Extensions
Selectman Brimmer moved to approve the release of seven driveway bonds and one subdivision bond as outlined on Attachment A.  Motion seconded and unanimously carried

Appointments
First Selectman Rosenthal received a letter from Conservation Official Rob Sibley recommending that candidates for the Conservation Commission should complete at least one of three courses before being appointed, since this is a regulatory board (copy attached).   There is one candidate being recommended now.  After discussion, it was decided that this candidate be subject to requirements.
        Selectman Bojnowski moved to require that candidates for the Conservation Commission complete at least one of three courses recommended by the Conservation Official before they are appointed.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to approve appointments and re-appointments as outlined on Attachment C.  Motion seconded and unanimously carried.

Kendro Lease
First Selectman Rosenthal advised of two changes being made to the lease for space for town and school offices.
        Selectman Brimmer moved to authorize First Selectman Herbert Rosenthal to sign the lease between the Town of Newtown and Kendro Laboratories for office space.  Motion seconded and unanimously carried.

Open Space Acquisition
First Selectman Rosenthal advised that our bond counsel has recommended that the town consider two separate special appropriations for the purchase of open space.  One appropriation would be for any specific property and the other would be more open ended for future open space acquisition.  There is debt service in the current year budget for $2 million in borrowing.  Mr. Rosenthal advised that he would like to discuss a particular parcel of land.
        Selectman Brimmer moved to enter executive session to discuss a possible open space acquisition and to invite clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 8:20 p.m. and returned to open session at 8:45 p.m.

Announcements:  It was decided to cancel the regular meeting scheduled for 1/3/05 and, if necessary, hold a special meeting on 1/4/05.  Budget meetings will be held on January 19, January 31 and February 1.  

Having no further business, the meeting was adjourned at 8:50 p.m.
