Selectmen Meeting Minutes 11/15/04
The Board of Selectmen held a regular meeting on November 15, 2004 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer, one member of public

VOTER PARTICIPATION:  None noted

COMMUNICATIONS:  First Selectman Rosenthal received a draft Trail Conservation Easement for format approval.  Each individual easement will have to be approved by the Board of Selectmen and Legislative Council.  The other Selectmen will look over the format and advise if they have any comments.
        First Selectman Rosenthal distributed copies of an estimate to rehabilitate the Hook & Ladder building on Main Street.  These figures are for information purposes only at this time.
        First Selectman Rosenthal advised that the newly formed Trails Committee has held their first meeting.  They would like to have a member from the Rotary Club, the Forest Association and the NBLA.
        Selectman Brimmer received an e-mail from a real estate broker looking for a large warehouse space.  This will be passed on to the Community Development Director.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Bojnowski, the minutes of the October 18, 2004 meeting were unanimously accepted as presented.

UNFINISHED BUSINESS

Road Work Agreement, Castle Meadow Road, Newman Subdivision
Nothing has been received by the Town Engineer.

NEW BUSINESS

Maintenance Bond Release, Cornfield Ridge Subdivision, Pumpkin Lane and Cornfield Ridge Road
Selectman Brimmer moved to release the maintenance bond in the amount of $19,500 for Cornfield Ridge Subdivision, Pumpkin Lane and Cornfield Ridge Road.  Motion seconded.
        Town Engineer Ron Bolmer advised that the homeowner has erected a fence on the town right-of-way that creates a site line problem.  He is willing to move the fence but the developer planted a row of evergreens on the right-of-way.  After discussion, it was decided that the developer should move the trees so that the homeowner can move the fence.
        Selectman Brimmer moved to TABLE the motion until the Town Engineer contacts the builder to rectify the situation with the trees.  Motion seconded and unanimously carried.


Road Acceptance, Winter Ridge Road, Old Farm Hill Section 2B
Selectman Bojnowski moved to accept Winter Ridge Road, “Old Farm Hill, Section 2B” Subdivision into the Newtown Highway System and to set a maintenance bond in the amount of $19,500.00 to be held by the town for a period of one year.  Motion seconded and unanimously carried.


Driveway Bond Releases/Extensions
Selectman Brimmer moved to approve the release of 29 driveway bonds as outlined on Attachment A.  Motion seconded and unanimously carried
        Selectman Brimmer moved to approve the release of one subdivision (common driveway) bond in the amount of $19,000.  Motion seconded and unanimously carried.

2005 Meeting Schedule
Selectman Bojnowski moved to approve the 2005 Board of Selectmen Meeting Schedule.  Motion seconded and unanimously carried. (copy attached)

Childrens Adventure Center Resolution
Selectman Brimmer moved the following:  RESOLVED that the First Selectman, Herbert C. Rosenthal, is empowered to enter into and amend contractual instruments in the name and on behalf of this Contractor with the Department of Social Services of the State of Connecticut for a Child Day Care program, and to affix the corporate seal.  Motion seconded and unanimously carried.

Appointments/Reappointments
Selectman Brimmer moved to appoint (D) Ted Kreinik, 3 Cadey Lane as a member of the Economic Development Commission for a term to expire on 01/06/05.  Motion seconded and unanimously carried.  (replacing Naveen Kapur)
        Selectman Bojnowski moved to appoint as members of the Design Review Board,  Michael B. Manes of 21 Aunt Park Lane for a term to expire on 11/01/07; George Reichert of 70 Queen Street for a term to expire on 11/01/06; and Abbe D. Hoctor of 27 Oak Ridge Drive for a term to expire on 11/01/06.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to reappoint Rene Baade, Joseph Hovious, Sally O’Neil, Caraleigh Wilson and Martha Wright as members of the Ad Hoc Open Space Task Force for terms to expire on November 21, 2005.  Motion seconded and unanimously carried.
        First Selectman Rosenthal advised that he received a suggestion from our new Conservation Official that before appointment to the Conservation Commission, any interested individuals should be required to complete an inland-wetlands course offered by the State of CT.  This certification is needed for Conservation Commission members to walk property and make recommendations.  Mr. Sibley, Conservation Official, will be invited to the next meeting to discuss this matter.  

November Tax Refunds
Selectman Bojnowski moved to approve November 2004  No. 5 Tax Refunds in the amount of $3,257.79.  Motion seconded and unanimously carried.


Legal Matters
Selectman Brimmer moved to authorize legal proceedings to address a drainage discharge problem at 115 Currituck Road (Feola).  Motion seconded and unanimously carried.

ANNOUNCEMENTS:  First Selectman Rosenthal advised that two weeks ago, an article in The Bee indicated that the First Selectman told the Schools Superintendent that the Master Plan had no provision for any kind of school on the Fairfield Hills property.  That was an erroneous comment.  The School Superintendent had asked whether a school could be built on the open space at the west meadow.  A subsequent article corrected that information.

Having no further business, the meeting was adjourned at 8:15 p.m.
