Selectmen Meeting Minutes 7/19/04
The Board of Selectmen held a regular meeting on July 19, 2004 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer,  3 members of public, 1 member of media

VOTER PARTICIPATION:  None noted at this time   

COMMUNICATIONS:  First Selectman Rosenthal received word from the Department of Environmental Protection that the Remedial Action Plan for Fairfield Hills has been approved and signed and the Acting Commissioner has also signed the “Covenant Not To Sue” which will become effective after the closing.

ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the 7/6/04 meeting were unanimously accepted as presented.

UNFINISHED BUSINESS

Road and Drainage Work Agreement – Fox View Subdivision, Hundred Acres Road and Dug Hill Road
Attorney Robert Hall and Engineer Holt McChord were present on behalf of Mr. and Mrs. Holmes.  A revised road and drainage plan was discussed at length.    The three Selectmen agreed with the concepts of this revised drainage plan.  
        Selectman Brimmer moved to authorize First Selectman Rosenthal to sign the Road and Drainage Work Agreement for Fox View Subdivision, Hundred Acres Road and Dug Hill Road as discussed with Board of Selectmen on 7/19/04 after complete review and preparation of estimates by Town Engineer.  Motion seconded and unanimously carried.


NEW BUSINESS

Appointments/Reappointments
Selectman Brimmer moved to approve five (5) appointments as outlined on attachment.  Motion seconded and unanimously carried.
        Appointee Phillipe Steimle was present and was thanked for being willing to serve on the Parks & Recreation Commission.

Driveway Bond Releases
Selectman Bojnowski moved to approve the release of two (2) driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.
        Selectman Brimmer moved to approve a six month extension for five (5) driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.

Fire Suppression Bond Release, 160 Taunton Hill Road, Kalomeris Subdivision, Sunset Acres, LLC
Selectman Brimmer moved to approve release of Fire Suppression Bond, 160 Taunton Hill Road, Kalomeris Subdivision, Sunset Acres, LLC in the amount of $30,000, upon recommendation of Town Engineer and Dodgingtown Fire Department.  Motion seconded and unanimously carried.

Open Space Task Force Charge – Revised
Selectman Brimmer moved to approve the Revised Open Space Task Force Charge as attached.  Motion seconded and unanimously carried.

Childrens Adventure Center Resolution
Selectman Bojnowski moved to the following resolution:  RESOLVED that the First Selectman of the Town of Newtown, Herbert C. Rosenthal, is empowered to enter into and amend contractual instruments in the name of and on behalf of this Contractor with the Department of Education of the State of Connecticut for a Child & Adult Care Food program, and to affix the corporate seal and to empower Finance Director Benjamin Spragg to sign in the First Selectman’s absence.  Motion seconded and unanimously carried.

Legal Matters – none

ANNOUNCEMENTS:  First Selectman Rosenthal advised that the Fairfield Hills Management Committee will be meeting tomorrow (July 20) at 7:30 pm.

Having no further business, the meeting was adjourned at 8:30 p.m.
