Selectmen Meeting Minutes 7/06/04
The Board of Selectmen held a regular meeting on July 6, 2004 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski, Selectman William Brimmer

ALSO PRESENT:  Town Engineer Ron Bolmer, two members of public, one member of press

VOTER PARTICIPATION:  None noted at this time   

COMMUNICATIONS:  First Selectman Rosenthal received a letter from the Women’s Center of Greater Danbury thanking the town of Newtown for the grant in the new fiscal year budget.

ACCEPTANCE OF MINUTES:  Selectman Bojnowski moved to approve the minutes of the 6/23/04 regular meeting.  Selectman Brimmer seconded and moved to amend – Under Voter Participation, in Mrs. Johnson’s remarks, it should include “Mr. Brimmer asked if we could see a list of the members of the Friends of Fairfield Hills, because we need members for certain committees, and he thought this list would include interested residents who could be considered.”  Minutes were unanimously approved as amended.

UNFINISHED BUSINESS

Road and Drainage Work Agreement – Fox View Subdivision, Hundred Acres Road and Dug Hill Road
Mr. Robert Holmes and attorney Robert Hall were present.  A modified drainage plan has been submitted to Town Engineer Ron Bolmer.  Mr. Bolmer brought up possible problems with site lines in the curve at the intersection with Dug Hill Road.  After a lengthy discussion, the Board members agreed with the concept of the modified drainage plan.  When Mr. Holmes’ engineer, Holt McCord, returns from vacation, he will contact Mr. Bolmer to answer questions and this matter will be addressed at the next Selectmen’s meeting.  No action was taken.

NEW BUSINESS

Driveway Bond Releases
Selectman Brimmer moved to approve the release of three (3) driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.

Appropriation from Surcharge Account – Walnut Tree Ballfield Fencing
During the budget deliberations, the Parks and Recreation Commission volunteered to remove this project from the budget request and use surcharge funds.
        Selectman Bojnowski moved to approve the appropriation in the amount of $11,940.00 from the surcharge funds in the Capital Reserve Fund and to recommend to the Legislative Council for approval.    Motion seconded and unanimously carried.



Agreement for Operation, Maintenance and Management Services -  Water and Sewer Facilities -  Aquarion Services
This Agreement has been approved by the Water Pollution Control Authority and the Town Attorney and requires the signature of the First Selectman.
        Selectman Brimmer moved to authorize First Selectman Herbert C. Rosenthal to sign the Agreement for Operation, Maintenance and Management Services – Water and Sewer Facilities with Aquarion Services.  Motion seconded and unanimously carried.

Waste Supply and Disposal Agreement Amendment No. 3
Selectman Brimmer moved to authorize First Selectman Herbert C. Rosenthal to sign the Waste Supply and Disposal Agreement Amendment No. 3.  Motion seconded and unanimously carried.

Appointments
Selectman Brimmer moved to approve two appointments as outlined on attachment.  Motion seconded and unanimously carried.

Legal Matters
Selectman Bojnowski moved to enter executive session to discuss legal matters and to invite clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 8:20 p .m. and returned to open session at 8:25 p.m.  
        Selectman Bojnowski moved to approve legal defense in Robert Mathison v. Planning & Zoning Commission, Town of Newtown (re: JoMar Drive).  Motion seconded and unanimously carried.

ANNOUNCEMENTS:  First Selectman Rosenthal advised that we are still waiting for DEP sign-off in order to complete the closing of the purchase of Fairfield Hills.

Having no further business, and having been duly moved and seconded, the meeting was adjourned at 9:00 p.m.
