The Board of Selectmen held a regular meeting on Monday, November 3, 2003 in the meeting room at the C. H. Booth Library,  Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 pm. 
 
PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski,  Selectman William Brimmer 
 
ALSO PRESENT:  Town Engineer Ron Bolmer, one member of public, one member of press 
 
VOTER PARTICIPATION:  None noted 
 
COMMUNICATIONS:  First Selectman Rosenthal received official notice from the State D.O.T. that the amount of Town Air Road Grants we will receive for this fiscal year is $92,436, which is approximately what we budgeted.  This is down from the $262,000 we have received in previous years. 
        Selectman Brimmer advised that the Tercentennial Committee has raised the question as to whether they can utilize the town counsel for advice when necessary.  Selectman Rosenthal and Selectman Bojnowski both agreed that would not be a problem.  Selectman Brimmer also stated that there are plans to look into the possibility of a fireworks display.   They do realize that there are Planning & Zoning regulations prohibiting fireworks.  This will have to be explored further. 
 
ACCEPTANCE OF MINUTES:  Upon motion by Selectman Bojnowski, the minutes of the 10/6/03 regular meeting were unanimously accepted as presented. 
        Upon motion by Selectman Brimmer, the minutes of the 10/16/03 special meeting were unanimously accepted as presented. 
 
ADD TO AGENDA:  Selectman Brimmer moved to add acceptance of a drainage easement to tonight’s agenda.  Motion seconded and unanimously carried.

NEW BUSINESS 
 
Road & Drainage Work Agreement, Hoseye Coach Road, “Hoseye Coach Estates” Subdivision 
Larry Edwards was present on behalf of this proposed 6 lot subdivision on Hoseye Coach Road.  The road work agreement requires widening, paving, curbing and drainage on a 1,500' section of Hoseye Coach Road beginning at its intersection with Old Mill Road.   
        Selectman Brimmer moved to approve Road & Drainage Work Agreement, Hoseye Coach Road, “Hoseye Coach Estates” Subdivision in the amount of $195,000.00.  Motion seconded and unanimously carried. 
 
 
 
Road & Drainage Work Agreement, The Old Road, “Currituck Heights” Subdivision 
This agreement consists of widening 250' of The Old Road and providing 1 foot thick gravel/processed stone base with a “hammerhead” turnaround at the entrance to the one proposed new driveway. 
        Selectman Bojnowski moved to approve Road & Drainage Work Agreement, The Old Road, “Currituck Heights” Subdivision.  Motion seconded and unanimously carried. 
 
Road Acceptance, Avalon Way, “Avalon” Subdivision 
The Town Attorney has not yet received all of the necessary paperwork.  This will be on next agenda. 
 
Road Acceptance, Abbey Lane, “Abbey Ridge Estates” Subdivision 
The Town Attorney has not yet received all of the necessary paperwork.  This will be on next agenda. 
 
Road Acceptance, Pumpkin Lane & Cornfield Ridge Road, “Cornfield Ridge” Subdivision 
Selectman Brimmer moved to accept Pumpkin Lane and to accept Cornfield Ridge Road into the Newtown Highway System and to set the maintenance bond in the amount of $19,500.00 for a period of one year.   Motion seconded and unanimously carried. 
 
 
Acceptance of Additional Drainage Easement – Wentworth Estates, Poverty Hollow Road 
Selectman Bojnowski moved to accept an additional drainage easement on Lot 9 on a certain map entitled “Resubdivision Plan Lot 3 Julian Gregory Subdivision now known as 'Wentworth Estates', Newtown, Connecticut” Scale 1" = 50', dated June 1, 2001, Rev. 10/29/01 and Rev. 07/29/02”, contingent upon review and approval by Town Attorney.  Motion seconded and unanimously carried. 
 
Driveway Bond Releases/Extensions 
Selectman Bojnowski moved to release nine (9) driveway bonds as outlined on Attachment.  Motion seconded and unanimously carried. 
        Selectman Brimmer moved to approve a six-month extension for two (2) driveway bonds as outlined on Attachment.  Motion seconded and unanimously carried. 
 
Resolution in Support of the Smoking Ban 
This resolution was received from Match Coalition, Inc. requesting that the Selectmen read it into the minutes to support those businesses going smoke free.  No action was taken at this time. 
 
Appointments/Reappointments 
Selectman Brimmer moved to appoint Ms. Paula Stephan, 65 Elizabeth Circle as a member of the Ad Hoc Cultural Arts Study Committee.   Motion seconded and unanimously carried. 
 
November 2003 Tax Refunds  
Selectman Bojnowski moved to approve the November 2003 Tax Refunds No. 6 in the amount of $14,574.84.  Motion seconded and unanimously carried. 
 
Legal Matters 
Selectman Brimmer moved to enter executive session to discuss legal matters and to invite clerk to attend.  Motion seconded and unanimously carried. 
        Meeting entered executive session at 8:05 pm and returned to open session at 8:10 pm. 
        Selectman Brimmer moved to defend the Zoning Board of Appeals in suit filed by Jane M. Payne and Charles Payne.  Motion seconded and unanimously carried. 
 
ANNOUNCEMENTS:  Selectman Brimmer has a conflict on November 17 which is the date for the next regular scheduled meeting.  The meeting may be rescheduled for November 24.
