Selectmen Meeting Minutes 07/21/03
The Board of Selectmen held a regular meeting on Monday, July 21, 2003 at the C. H. Booth Library, Main Street, Newtown, CT.  First Selectman Rosenthal called the meeting to order at 7:30 PM.

PRESENT:        First Selectman Herbert Rosenthal, Selectman Joseph Bojnowski,  Selectman William Brimmer

ALSO PRESENT:  Finance Director Benjamin Spragg, Town Engineer Ron Bolmer, five members of public

VOTER PARTICIPATION – Ms. Ivette Gerics, along with two other representatives, was present on behalf of “Relay for Life” an event sponsored by the American Cancer Society.   They had a video presentation.  For several years, this fund-raising event has been held in Bethel and in Monroe.  They are hoping to hold this “all night” event at Newtown High School.  They are not asking for funds from the Town but would like to have a formal “endorsement” by the Board of Selectmen before they start making arrangements and contacting local officials.  First Selectman Rosenthal advised that they would need to contact the high school principal to find out if the stadium would be available for this event.  This item will be on the next agenda for a vote on a formal endorsement by the Board of Selectmen.
        Mr. Andrew Willie, 51 Butterfield Road, would like to serve on the Fairfield Hills Authority when and if that is approved.  He was asked to submit a written request to the First Selectman’s office.

COMMUNICATIONS:  First Selectman Rosenthal received a letter from Miss Mara Scallon of 6 Farm Field Road requesting sidewalks in Newtown and Sandy Hook so that children, like herself, can use them for running, skating and bikes.
        
ACCEPTANCE OF MINUTES:  Upon motion by Selectman Brimmer, the minutes of the July 7, 2003 meeting were unanimously accepted as presented.

UNFINISHED BUSINESS

Maintenance Bond Release, Road & Drainage Work Agreement, Pine Tree Hill Road, “Winton Farms” Subdivision
Not ready at this time.

Town Hall Union Contract
At the last meeting, action was not taken to approve this contract since the transfer of funds was not yet available.  The transfer is on tonight’s agenda.  A copy of the cost analysis for this contract is attached to these minutes.
        Selectman Bojnowski moved to authorize First Selectman Herbert C. Rosenthal to sign contract between The Town of Newtown and The Newtown Town Hall Employees, CSEA, SEIU, AFL-CIO Local 760, July 1, 2003 – June 30, 2006.  Motion seconded and unanimously carried.



NEW BUSINESS

Bond Release, Fire Suppression Tank, Old Green Road, “Lauren Brook Estates” Subdivision
Selectman Brimmer moved release of bond for Fire Suppression Tank, Old Green Road, “Lauren Brook Estates” Subdivision in the amount of $30,000, upon recommendation of the Fire Marshall and Town Engineer.  Motion seconded and unanimously carried.

Driveway Bond Releases
Selectman Bojnowski moved to approve release of ten (10) driveway bonds as outlined on attachment.  Motion seconded and unanimously carried.

Road Work Acceptance, Road and Drainage Work Agreement, Washington Avenue, “Tilson Woods” Subdivision
Selectman Brimmer moved to accept road work, Road and Drainage Work Agreement, Washington Avenue, “Tilson Woods” Subdivision and to reduce the bond to $7,400 which represents a 20% maintenance bond to be held for one year.  Motion seconded and unanimously carried.

Transfer – Town Hall Salaries
Selectman Bojnowski moved to transfer FROM Account 01570-2000 Contingency $37,942.00 TO Various Accounts (list attached) $37,942.00.  Motion seconded and unanimously carried.
        This transfer is to cover the new Town Hall Union contract for 7/1/03 to 6/30/06, which was settled after the budget was adopted.

Transfer – Emergency Dispatchers
Selectman Brimmer moved to transfer FROM Account 01570-2000 Contingency $49,734.00 TO Account 01300-1001 Emergency Dispatcher Payroll $28,506.00 AND TO Account 01300-1005 Emergency Dispatcher OT $9,000.00 AND TO Account 01310-1004 Emergency Dispatcher Clerical $12,228.00.  Motion seconded and unanimously carried.
        This transfer is to cover the new Emergency Dispatcher Union contract which was settled after the budget was adopted.

Transfer – DW Public Safety Communication
Selectman Brimmer moved to transfer FROM Account 01570-2000 Contingency $282.00 TO Account 01426-0000 NW CT Public Safety Communication $282.00.  Motion seconded and unanimously carried.
        This is transfer is to cover the amount under-budgeted for frequency coordination services.

Appointments/Reappointments
Recommendations for each appointment was received from the respective town committees.
Selectman Bojnowski moved to appoint (D) Peter Giarratano, 40 Brookwood Drive as a member of the Board of Finance for a term to expire on 12/01/03.  Motion seconded and unanimously carried.    This is an elected position and Mr. Giarratano will be running for election in November.
        Selectman Bojnowski moved to appoint (D) Michelle Rosenthal, 70 Main Street as a full member of the Hattertown Historic District for a term to expire on 6/30/07.  Motion seconded and carried:  2 YES  (Mr. Rosenthal abstained)
        Selectman Bojnowski moved to appoint (R) Barbara Brimmer, 8 Hattertown Road as a full member of the Hattertown Historic District for a term to expire on 6/30/08.  Motion seconded and carried:  2 YES (Mr. Brimmer abstained)
        Both Mrs. Rosenthal and Mrs. Brimmer are currently alternate members of the Historic District who are becoming full members to fill vacancies.  
        Selectman Bojnowski moved to appoint (D) Deborah O. Malin, 219 Hattertown Road as an alternate member of the Hattertown Historic District for a term to expire on 6/30/07.  Motion seconded and unanimously carried.

Capital Improvement Plan
Finance Director Ben Spragg distributed copies of the CIP 2004-2009.   The Board of Selectmen must now prioritize the projects and forward to the Board of Finance in August.

Legal Matter
Selectman Brimmer moved to enter executive session to discuss a legal matter and to invite Finance Director and clerk to attend.  Motion seconded and unanimously carried.
        Meeting entered executive session at 8:45 p.m. and returned to open session at 8:50 p.m.
        Selectman Brimmer moved to authorize the Zoning Enforcement Officer to pursue legal action to enforce zoning compliance by Mrs. Glorianna Tardie of 13 Lazybrook Road.   Motion seconded and unanimously carried.

Having no further business, the meeting was adjourned at 8:51 p.m.
